Quad III Revocable Trust (hereafter referred to as "Applicant") has applied to the Community Development
Director of Pitkin County, Colorado ("Director") for Activity Envelope and Site Plan Review to construct a barn
clustered next to an existing single family residence, a 900 cubic yard berm on the northern portion of the Lot, and
to establish envelopes around existing loafing sheds.
1. The parcel is located at 3333 Snowmass Creek Road. PID#: 2645-024-00-010 (Legal Description,
Attachment A).
2. The Applicant submitted an application after July 6, 2006, therefore, the application is being considered
pursuant to the 2006 Land Use Code, as amended.
3. The Lot is approximately 69 acres, is in the RS-30 zone district, and is conforming in size.
4. The pazcel is currently developed with a legal single family residence that received a Certificate of
Occupancy in 1990. The parcel received 1041 Hazard Review approval pursuant to P & Z Resolution
No. 86-27 with envelopes recorded at Book 19 Page 11. Afrer the residence was constructed, it was
discovered that it was built outside the approved envelope. A minor plat amendment approved the
relocation of the residential building envelopes with the plat recorded at Book 43, Page 4.
5. The Lot is visible from Snowmass Creek Road (a scenic corridor) and is mapped within big game ranges.
According to the CDOW, critical habitat on the higher azeas above the existing house and the proposed
envelopes avoid this area. Wildfve mapping does not exist for this parcel. Upon a site visit, Staff
determined that because of the flat topogaphy and the large existing mature vegetation surrounded by
irrigated pasture, the site could be considered a low wildfire hazazd. The Applicant will be conditioned to
comply with the low wildfire hazard standazds in the code and conformed to the scenic view protection
standards.
6. The Application was referred to the Snowmass Creek Caucus and the Basalt and Rural Fire Department.
Comments were not received from either entity.
7. Staff asked the Applicant to respond to section 2-ZO-10(e): Prohibition of Commercial Agriculture
Activity. Upon review of the criteria, which can potentially require a covenant to prohibit commercial
agriculture, Staff determined that the request for a barn did not change the land use or character of the
land to require such a covenant.
8. Public notice was published in the paper on November 4, 2007. No comments were received within 30
days.

2. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have
been conducted. These requirements will be considered at the time of building permit review. Structures
represented in the application might not be permitted under building and zoning regulations.
3. Prior to submission of any future building permit applications, the Applicant shall be required to submit
for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope
in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above
referenced approvals shall be a condition precedent to finalization and recordation.
4. No structural development, with the exception of fencing, in excess of 30" shall occur within the
setbacks of the Lot. Landscaping in the form of berms shall not exceed four feet from the most
restrictive grade. Any external development located within setbacks mandated by County zoning
regulations shall require a variance from the Board of Adjustment. Approval of a landscape envelope
within such setbacks does not assure approval of a variance.
5. The parcel is exempt from Growth Management up to 5,750 square feet and cannot exceed this floor
area limitation without approval for use of a TDR or successfully competing in the Growth Management
competition.
6. The barn shall utilize earth tone colors and non-reflective roofing.
7. Vegetation on the berm shall include native vegetation that is consistent with the surrounding areas such
as gamble oak and sage brush.
8. Prior to issuance of a building permit application, the Applicant shall:
a. Complete a fireplace/woodstove registration form with the Community Development
Department, if necessary.
b. Obtain a stormwater permit from the State of Colorado if site disturbance exceeds one (1) acre.
c. If necessary obtain a County access/driveway/turnaround permit acceptable to the Basalt Fire
Protection District and County Engineer.
d. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. All
slopes steeper than 2:1 shall utilize erosion control blankets.
e. Submit a construction management plan for review and approval by the County Engineer
showing the locations of staging, material storage and employee and construction traffic
parking.
f Pay the applicable road and employee housing impact fees.
9. Standards Applicable to All Wildfire Hazard Areas: Development is allowed in wildfire hazard areas
subject to conformance with the following development standard.
A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may
limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire
defensible space considerations as follows (note: actual vegetation manipulation to meet these
conditions may not be necessary where the natural vegetation patterns have already fulfilled these
conditions):
a) Brush, debris and non-ornamental vegetation shall be removed within a minimum ten-foot (10')
perimeter around all structures.
b) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a
minimum of a thirty (30) foot perimeter aoound a structure built on flat ground. (For greater
slopes, reference the CSFS Safety Zone char[ in Wildfire Guidelines For Rural Homeowners,

which provides general guidelines that may be modified by a wildfire expert acceptable to the
County).
c) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a
minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be
equal to the height of the fuel. All measurements shall be from the edges of the crowns of the
fuel.
d) All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a
height of ten (10) feet above the ground with removal of ladder fuels from around trees and
brush.
e) Tree crown sepazation within the thirty (30) foot perimeters shall have a minimum of ten (]0)
feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels
have been removed. In areas of aspen regeneration, understory shrubs and down and dead
materials shall be removed.
f) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen
(15) feet of chimneys shall be removed.
g) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced
where natural reduction has not already occurred.
h) All deadfall up to a one hundred (100) foot perimeter shall be removed.
i) No new conifer trees shall be planted within ten (10) feet of a residence.
j) No flammable mulches shall be placed within two (2) feet of a residence.
k) The property owner shall be responsible for the continued maintenance of the defensible space
vegetation requirements.
B. Access
a) Access roads and driveways shall be built to County standards; however, these standazds may
be increased to mitigate wildfire hazards based on comments provided by the Colorado State
Forest Service, the Sheriff s Department, local fire protection districts and/or a person approved
by the County as an expert in wildfire area designation and mitigation.
C. Water Supply for Fire Safety
a) When access to a public or private pressurized water system is not available or if it is necessary
to augment fire protection water systems, private ponds may be used if approved by the
Community Development Department and the local fire district.
b) Any fire department recommendation for individual structure water supply and storage shall be
accessible to fire deparhnent vehicles from the exterior of the structure through a fire
department approved mechanism (such as a fire hydrant). The amount of storage capacity on the
parcel shall be determined by the Fire District.
c) All new development shall conform to the appropriate building Code(s) with regard to
sprinklering structures..
D. Roofing Materials, Roofing Vents and Projections At and Below Roof Line. Unless the wildfire expert
has recommended a different method of construction, roofs and projections at or below roof line in Low,
Medium and Severe Wildfire Hazard Areas shall be constructed according to the following
specifications:
a) Low Hazard Area

2. Class A covering or Class A Assembly as defined by the currently adopted
Building Code.
3. No wood shakes or shingles.
4. All other adopted Building Code compliant methods and materials permitted.
E. All Hazard Areas: Roofs with less than a 3:12 pitch are not permitted in Low, Medium, or Severe
Wildfire Hazard Areas unless they comply with the following:
a) All roof coverings shall be constructed of non-combustible materials and installed on a Class A
roof assembly.
b) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof
debris.
c) Protrusions above the roofline, such as pazapets, shall be prohibited.
d) Roofs shall be installed as required by the adopted Building Code and shall have a minimum
pitch of 1:48.
e) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire
Marshall prior to submittal of a building permit application.
F. Maintenance and Miscellaneous Requirements
a) Roofs and gutters shall be kept clear of debris.
b) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one-fourth (''/4) inch
maximum.
c) Yards shall be kept clear of all litter, slash and flammable debris.
d) All flammable materials shall be stored on a parallel contour a minimum of fifreen (15) feet
away from any structure.
e) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more
than six (6) inches.
f) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifreen (15) feet away
from the structure.
g) Swimming pools and ponds shall be accessible by the local fire district.
h) Fences shall be kept cleaz of brush and debris.
i) Wood fences shall not connect to other structures.
j) Fuel tanks shall be installed underground with an approved container.
k) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a
contour away from the structure with standard defensible space vegetation mitigation around
any aboveground tank. Any wood enclosure aoound the tank shall be constructed with materials
approved for two (2) hour fire-resistive construction on the exterior side of the walls.
I) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher.
m) Structures greater than 5,000 square fee shall be sprinklered.
n) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible
at the primary point of access from the public or common access road and installed on a non-
combustiblepost.
] 0. The Applicant shall comply with the following general conditions regarding wildlife:
A. When existing native vegetation must be altered within the Activity Envelope, the
Applicant may be required to prepaze a habitat mitigation plan acceptable to the County.
Such mitigation plan may substitute (in a nearby area on the subject property) vegetation
equal in type and quantity to that being removed to mitigate effects on wildlife species.
Should there be no opportunity on the property for habitat mitigation or restoration, off-site

mitigation benefiting the same species may be required, or financial mitigation may be paid
into a County habitat mitigation fund should such a fund be established in the future.
B. Manipulation of vegetation outside of the Activity Envelope is prohibited.
C. Mesh or woven wire fences aze prohibited outside the Activity Envelope except hay
storage.
D. Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall
not exceed fifty-four (54) inches in height above ground level, and twelve (12) inches in
width (top view), and shall have at least eighteen (18) inches between the lower two (2)
rails.
E. Wire fencing must be three (3) strands or less. The top wire should be atwelve-point-five
(12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The
middle strands (which may be barbed) should be located a minimum twelve (12) inches
apart and from the top wire preventing entanglement when mule deer jump over. The
bottom strand should be sixteen (16) inches from the ground.
F. Tall overly mature trees and standing dead trees (snags) should be retained at the rate of two
(2) to five (5) per acre whenever possible as nesting and perching habitat.
G. Fruit bearing trees and shrubs shall be prohibited within the Activity Envelope. This does
not include pre-existing native trees and shrubs.
H. Access shall be provided to the Colorado Division of Wildlife for trapping, tagging,
studying, or otherwise managing wildlife.
I. Trash/garbage shall be kept in an approved beaz resistant container or enclosure. These
containers shall be accessible to and use at all times by contractors on site.
J. Bird feeders, including hummingbird feeders, shall be hung away from any deck or
window, and be at least Yen (10) feet from the ground suspended between two (2) trees or
posts. All seed feeders shall include a seed catchment pan to catch discarded seed.
K. Horse grains, pellets, and cookies shall be stored in bear resistant containers.
L. Pet food shall not be left outside.
M. All dogs shall be kenneled.
11. No development shall occur outside the approved activity envelope with the exception of vegetation
removal necessary to comply with the wildfire mitigation measures described above. No structures
shall be permitted outside of the approved building envelope. Applicant shall be required to obtain an
Earthmoving Permit for any work outside the approved envelope.
12. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the
corners of the activity envelope and install construction fencing azound the construction site within the
perimeter of the building envelope. The fencing shall remain in place until issuance of a Certificate of
Occupancy.
13. All areas disturbed by construction shall be re-vegetated with native shrubs and grasses within one
growing season of the project's completion.
14. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land
Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, §
2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on June
2~ , 2011.
15. Failure to comply with the conditions of this approval may result in revocation of this approval, or any
subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property.

It is the intent of the owners and architect to comply with all of the specific
sections of the 2006 Pitkin County Land Use Codes identified in the pre-
application conference summary. The site in question is a relatively flat space (no
slope greater than 5%) on the ranch. With concern to vegetation, there is a mix of
native and non-native grasses. While no formal landscaping plan exists, it is the
intent of the owners to use native vegetation to screen portions of the barn from
the neighbors and road. The ranch utilizes two irrigation ditches for seasonal
irrigation.

The owner insists on maintaining the natural character of the ranch. The size of
the site chosen includes the kennel for power and enough space for material
storage/staging for barn construction. The natural grade, topography, vegetation
and drainage will not be disturbed around the activity envelope.
Sec. 7-20-20' Steep & Potentially Unstable Slopes
The site chosen is not on any steep slopes, which do exist on the ranch. The
existing site plan shows contour lines at two-foot intervals. The barn will be sited
into this very gentle slope.
Sec. 7-20-10 Site Preparation & Grading
No grading will take place to alter slope or the drainage plane of the site except
to insure positive drainage away from the barn. The berm will be undulating and
graded gently on all sides to be as natural in appearance as possible. The
existing trees on the berm will be re-located on the new parts of the berm and
twice as many trees will be additionally planted.
Sec. 7-20-30' Water Courses & Drainage
There will be no changes to the drainage plane or the seasonal irrigation ditch
flow on the site. Silt fencing will be utilized during construction and landscaping
activities to protect areas outside of the activity envelope and drainage into the
ponds or irrigation ditch. The barn and berm construction will not introduce any
contaminants to the groundwater or affect its ability to recharge
Sec. 7-20-130' Landscaping and Vegetation Protection
The ranch will continue to protect the natural vegetation. No grading will occur
that changes the existing drainage plane or the seasonal irrigation ditch flow.
Grading or landscaping will not create any enclosures. Landscaping will include
the planting of trees and shrubs to attractively screen the barn from neighbors
and the road. These will include Aspen and Cottonwood trees native to the
Snowmass Creek valley. Large areas of native and non-native grasses will
remain as to preserve the pastures. The pastures will continue to be irrigated by
the seasonal irrigation ditches. The berm construction will not be greater than a
4'1 ratio or built over four feet above grade It will not affect road traffic visibility
The ranch already practices replacement of dead or unhealthy trees as part of its
maintenance
Sec. 7-20-70: Wildlife Habitat
The ranch is in Mule Deer and Elk winter range, critical habitat, winter
concentration and severe winter range The ranch lies within an elk migration
pattern. Electric fencing utilizes 12.5 gauge, single strand, barb less wire. It is the
practice of the ranch to drop the wire to the ground every fall to ensure
unimpeded flow for deer and elk. The kennel is fully functional if necessary. Pet
food is stored inside the kennel structure. The owners currently do not have any

pets No additional fences will be constructed. No fruit bearing trees will be
planted.
Sec. 7-20-60: Wildfire Hazard
The ranch installed a fire hydrant to the seasonal, high pressure (108 psi)
irrigation system in 1994. The Basalt fire marshal was consulted for its
placement, specifications, signage and insurance break. It was determined at
that time that the house and kennel were easily defensible from wildfire The
ponds are available to the fire department in the event additional water is
needed. The driveway turn-a-round is larger than cul-de-sac standards.
Sec. 7-20-120(d) Scenic View Protection
The barn will not impair any ridge line views and will comply with the "earth tone"
standards set forth in this section. It will be sited into the existing gentle slope.
All disturbed areas will be re-vegetated with Carbondale Roaring Fork CO-OP
"Irrigated Pasture Seed Mix" applied at 40# per acre
Sec. 7-20-120(e) Rural Character
As mentioned before, the owner insists on maintaining the natural character of
the ranch. The barn will be sited/integrated into the existing ranch compound.
This will preserve the maximum amount of pasture open area. Native plant
materials will be utilized in re-vegetation.
Sec. 2-20-10(e) Prohibition of Commercial Agricultural Activity
The construction of the barn and berm will not change the current land use It is
the full intent of the owner to maintain a residential and agricultural character. No
commercial activity, agricultural or otherwise will be permitted.

2 APPLICANT understands and agrees that Pitkin County Ordinance No. 32-2002 eskablishes a fee
structure for land use applications and the payment of all processing fees is a condition precedent to a determination of
application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the
cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to reflect the
expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed PROJECT, it
may not be possible at the time of application to ascertain the full extent of the costs involved in processing the
application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall
accumulate if an application includes more than one type of land use review.
5. CO[JNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to
enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project
approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full
fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $
which is based on _ hours of staff time, and if actual time spent by staffto process the application exceeds the average
number of hours by more than 20%, then the COUNTY will bill the APPLICANT quarterly for the additional time spent.
Such periodic payments shall be made within 30 days of the billing date. APPL[CANT further agrees that failure to pay

Dear Mike:
On behalf of Quad III Trust, owner of the above-captioned property, Mr. Joel Scott has
asked that a letter be prepazed addressing the issued raised by Code Section 2-20-10(e),
Prohibition of Commercial Agricultural Activity, relative to the submitted application for
Activity Envelope and Site Plan Review approvals to enable development of a barn and a
900 cubic yazd berm. Per the Pitkin County Assessor's records, the 69 acre subject
property maintains a 5,553 square foot ranch-style residence (plus 755 squaze foot garage)
that was built in 1989. The balance of the property is a hay meadow that is leased for
grazing, which is an agricultural use.
Section 2-20-10(e) ofthe Code states that,
At the time a development approval, including subdivision or PUD is
considered for any lot or parcel, an evaluation shall be conducted b_v the
Community Development Department to determine if the resulting land
use or character of the land is or will be essentially and primarily
residential, commercial, or another use or character other than
agricultural. If the development approval will change the primary and
fundamental use from being agricultural, then a covenant prohibiting
commercial agricultural activity shall be required as a condition of
development approval. [emphasis added]
Given the cited language, Section 2-20-10(e) of the Code does not apply in the subject
case as the applicant has merely requested development approval for an Actin Envelope
and Site Plan Review. This standazd applies only to development approvals that include
subdivision or PUD requests. The language does not say or otherwise imply development
approvals "includmg but not limited to subdivision or PUD..." Rather, the language limits
the application ofthe standard to subdivision and PUD requests.
Even if one disagrees with this plain reading of the Code and determines that the provision
is indeed applicable, it is still cleaz that the language does not allow room for ~~/

that a residence exists on the property is completely irrelevant under the terms of the
review. The evaluation is specifically limited to only the land use(s) that would result from
the requested development approval, which in the subject case are a barn and a berm
which do not change the primary and fundamental use of the property and thereby make
the imposition of a covenant inappropriate.
Development of a berm is merely an earthmoving request aimed at providing a buffer
between the subject property and neighboring uses, including a public thoroughfare.
Berms are commonly found on all kinds of parcels, including agricultural, residential,
commercial, industrial, office and lodging properties. The development of a berm cannot
be said to have any effect on the primary or fundamental use of any property.
The applicant has requested approvals necessary to enable development of a barn under
the terms and limits of Code Section 6-30-140 which, on this 69 acre parcel, allows up to
4,002 square feet ofbarn exempt from GMQS and floor azea limits. Moreover, said Code
section requires at subsection "(e)" that a deed restriction be recorded against the property
prior to issuance of a building permit for the barn, with said deed restriction specifying
that the barn "may only be used to shelter or enclose livestock, horses, poultry, feed or
field equipment..." The same deed restriction must "also allow the County to inspect the
barn at any time for compliance with the specified use limitations, subject to provision of
reasonable notice to the owner."
The required deed restriction will be approved by the County Attorney and executed by
the applicant prior to issuance of a building permit for the barn. Given that just
construction of a barn deed restricted to limited agricultural uses wIll be enabled, the
development approval will serve only to confirm the subject property's agricultural status.
The proposed development is of a structure (a deed restricted barn) accessory to the
primary agricultural use of the property.
The remaining portions of Section 2-20-10(e), includmg subsections (2) and (3), are
rendered immaterial since the resulting land use so plainly serves only to confirm and
support the agricultural use of the subject property. The size of the property is recognized
by the Code as deserving of up to approximately 4,000 square feet of barn to support
agricultural usage of the property. Valuations of the property and the proposed
improvements, the history of the property, the viability of prospective agricultural uses, the
legal history of the property relative to any subdivisions or other divisions, the potential
for future subdivision, and the type of historical agricultural use of the property aze of no
consequence as the result of the development approval will be a deed restricted barn that
is accessory to the primary agricultural use of the property.
In closing, there is no reason under the terms of the Code as to why the requested Activity
Envelope and Site Plan Review approvals for development of a berm and a GMQS exempt
and deed restricted barn should require a covenant prohibiting the continuation of

commercial agricultural activity on the Quad III Ranch. Such a prohibition would run
counter to Pitkin County Land Use Policies and the Snowmass-Capitol Creek Valleys
Master Plan goals for maintenance ofrural character as the applicant would be left without
the motivation or ability to continue livestock grazing of the acreage. Accordmgly, it is
respectfully requested that the desired approvals will be granted without a prohibition
against these or any other commercial agricultural activities. If you should have any

WHBRBAS, on September 2, 1986, the Pitkin County Planning
and Zoning Commission (hereinafter "Commission") reviewed an
application submitted by Robert N. Jensen (hereinafter "Appli-
cant"), requesting 1041 Wildlife and Geologic Hazard Review
approval for two (2) residential homesites on a 269 acre parcel
located on Snowmaes Creek Road adjacent to the eastern boundary
of the Windstar property, as more fully described in Bxhibit "A"
attached hereto and incorporated herein; and
WABRBAS, the Commission conducted a public hearing on
September 2, 1986, at which time evidence and testimony were
presented with respect to the aforesaid application.

does hereby approve the Jensen 1041 Hazard Review for the
construction of two residential homesites on the property
described in Exhibit "A", subject to the following conditions:

Dear Mr. Peterson:
I have viewed the driveway accessing the upper meadow where
the Jensen improvements are. The driveway is cut in
Quaternary age glacio-fluvial terrace deposits which consist
of poorly sorted and poorly graded clays, silts, sands,
gravels and cobbles.
Although the driveway is a little steep, approaching eight to
ten percent grade in one stretch, it is well constructed with
a good base. There is no evidence o4 slumping or other
instability at this time on the cut bank side of the road.
The underlying bedrock in this area is the Cretaceous age
Mancos Shale which dips approximately twenty degrees to the
south, ar generally into the hillside. On balance, this is a
positive factor, but the eroded surface of the shale beneath
the glacial deposits probably slopes into the valley. This,
in conjunction with an irrigation ditch which crosses the
hillside above the steeper part of the access road, could
cause instability and potential failures along the road cut.
This potential, of course, would be magnified if the ditch
itself were to fail.
My recommendations are to irrigate this section of the
pasture on the terrace above the road carefully, and to leave
water in this particular ditch for as short a period of time
as possible. Obviously, the ditch should be well maintained
so as to keep the potential for failure at a minimum. In the
fall, after the irrigation season is over, this portion of
the ditch above the road should be made to catch and carry as
little spring runoff as possible_ Despite possibly decades
of irrigation at this site, I saw no significant signs of
instability along the access road and expect little trouble
with mass wasting, especially if the above recommendations
are followed. Please contact me if there are further

I have completed my geologic investigation of Lot 12 of the
Jensen property in the Snowmass Creek valley. The
roughly triangular shaped lot is approximately 7U acres along
the west side of the Snowmass Creek Road. This is within the
SE 1/4 of Sec. 2, T 9 S, R 85 W of the Sixth P. M., within the
Woody Creek 7 i/2 minute quadrangle, Pitkin County, Colorado.
None of the property goes beyond the base of the steep
hillside to the west. The building site as shown on the
accompanying map is near the west central portion of the lot.
The topography of the proposed site consists of irrigated
pasture interspersed with groves of scrub oak. The site is
quite flat and is mare than 80 feet away from the base of the
steep hillside. There are no existing structures on this
site.
The geology of the site consists of surficial deposits of
glacio-fluvial origin of Quaternary age. This is in the form
of poorly sorted silts, sands and gravels on a terrace above
the present level of Snowmass Creek. :Underlying this
material, perhaps 50 to 100 feet below the surface, is the
Cretaceous age Mancas Shale which in this general area dips
approximately 15 degrees to the south.' There are no other
geologic structures which could advertiely affect this site.
The building site as depicted is far enough away from the
base of the steep hill to the west so :as not to be affected
by any gravity related phenomena there. There are no
significant gullies on that hillside which could have an
affect on the building site. This is jan excellent site for
the development of a single family dwelling, but high ground
water conditions should be expected, especially during
irrigation season. It will still be necessary to have a
soils engineering study prepared to insure proper foundation
design and to protect against potential high ground water
conditions.

Access to the site should be easily attainable off the
Snowmass Creek Toad on grade to the site, but several
culverts may be necessary because of the irrigation system in
place. Water for domestic use should be available through
the drilling of a well to a depth of perhaps 170 feet. Waste
disposal should be available through the construction of a
septic system with accompanying leach field in these
permeable soils, Once again, the complicating factor may be
the potential for high ground water, the Fitkin County
Sanitation Engineer should be consulted far his specific
recommendations. Flease contact me if you have further

The location of the proposed bam and berm lie within elk and mule deer winter range with the more critical habitat
along the ridge immediately behind the residence and bam site. The barn will be clustered with existing buildings
and should not result in increased negative impacts to wildlife. The application mentioned that the kennel is fully
functional if necessary. It is important to control pets when living within winter range and adjacent to severe winter
range and winter concentration area. The kennel should be utilized in order to prevent harassment of big game
during the winter months and migration periods.
The following recommendations will help minimize impacts to wildlife as well as minimize human-wildlife
conflicts:
1. all horse hay should be fenced with 8' mesh game proof fencing in order to minimize game damage
problems as well as minimize an ariractant along a busy county road, thus reducing game-motor
vehicle accidents
2. all pet food stored in the kennel (as stated in the application) should be stored in a bear proof container
in order to minimize an attractant for black bears.
3. all horse grains, cookies, pellets, etc should be stored inside a beaz proof container in order to
minimize an attractant for black bears
4. No nut, fruit, or berry producing trees or shrubs should be used in the landscaping for the berm (i.e.
serviceberry, chokecherry, crabapples)
