Proper notice procedures, including the notification of all adjoining property owners, has been demonstrated. 2. The required hazdship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfaze and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. FLOOR AREA) I~ MINUTES Meeting of the Pitkin County Board of Adjustment August 5, 2003 Members Present: Jim Rifkin, Co-Chair Rick Head, Co-Chair Michael Cooper Bob Throm Deanna Olson Members Absent: Taber Sweet, alternate Patrick McAllister, alternate Staff Present: Joanna S. Schaffner, zoning officer and acting secretary Rick Head opened the meeting at 5:35 pm and introduced the Board members. CASELOAD: 2003-07 Paul Chasley / Alexander Anderson 43351 East Highway 82 Architechts, Bill Pollock and Dillon Johns, and owner's representative, Chuck Frias were present on behalf of Chesley/Anderson in their request for a 50 foot Major Road setback variance where 100 feet is required from the Highway 82 right-of-way for the construction of a single-family residence on this 12 acre parcel in the AFR-10 zone district. The Affidavit of Posting was presented. The Public Notice that was mailed to the Preserve (HOA) was returned to the Zoning Office because of Schaffner asked the applicant to discuss the plans president, Lee Pardee, but Mr. Pardee has been out six weeks. Schaffner spoke with him today, and he he has not been able to review the proposed plans, file an objection on behalf of the 11 homeowners. 3omeowners Association a bad address. with the HOA's of town for the last indicated that since he regretfully, must Frias stated that although they tried to mail plans to Pardee, he refused to cooperate, basically refusing to be notified. No other HOA member was apparently available to cover in Mr. Pardee's absence. Rifkin stated that this was an important defect, and he made a motion to reschedule the meeting. Throm seconded the motion. The Board discussed whether a special meeting should be held. Attorney, Herb Klein, representing two different adjacent property owners, was present for this case, and commented that he would not be in town later this month. Schaffner stated that delaying the meeting until next month will not impact submission of the building permit application. The Board then decided that the case should be heard at the next regularly scheduled meeting. Since the next meeting is the day after Labor Day, the Board discussed whether that meeting should be rescheduled and it was decided that all members would be in town and able to attend the September 2, meeting. Schaffner commented that the next month's agenda was already quite full, and the Board decided to begin the meeting at 5:00 pm instead of the usual 5:30pm. The vote was taken to reschedule the meeting and it passed 9-1 with ? voting against. ii Uil ~~~ 000005 2003-09 Gibson, Btuazt and Theresa 32 Avalanche Creek Road Architect, James Harris was present to represent the owners in their request for a 38 foot rear yard setback variance where 50 feet is required for a ranch gate on this 35 acre parcel in the RS-30 zone district. Harris submitted the Affidavit of Posting, as well as letters supporting the request from adjacent property owners, Parker and Klostermann. Harris stated that he $ad a verbal ok from neighbor, Hutchins, and that the gate received approval from the Carbondale Fire Department with regard to access issues. Harris suggested that the topographic constraints of the parcel, including the Crystal River'to the west of the driveway and steep slopes to the east make the variance request necessary. Cooper asked if the gate will break the skyline as viewed from the right-of-way. Harris submitted photographs representing the proposed gate location and design, and said that he did not think that the skyline would be breached. Rifkin made a motion to approve the request as presented due to topographical hardships. Cooper seconded the motion and it passed 5-0. 2003-10 Chromy, John and Nancy 366 Redstone Blvd Lots 82, 82A, 84, 84A, Redstone Blvd. John and Nancy Chromy were present requesting a 5 foot front yard setback variance where 30 feet is required for the construction of a small addition to a single-family residence on this 11,266 square foot parcel in the VC zone district. The Affidavit of Posting was submitted. Mr. Chromy submitted photos of the existing condition within the residence and indicated how the addition was necessary to improve access to an existing loft. Chromy stated that theirs is an historic house on the Blvd located within the 30 foot frontyard setback. Letters of support were submitted from the Historic Preservation Officer, Suzannah Reid, andneighbors, Peter Martin and Pamela Darnell. Throm made a motion to approve the request as submitted due to downzoning. Olson seconded the motion and the Board voted 5-0 to approve. OTHER: There were no minutes for the Board to review. Cooper commented that it is helpful if staff could introduce the case for the Board prior to the applicant addressing the Board, since often times the applicant doesn't know where to start. The Board agreed that .this was a good idea. There being no further business before the Board, the meeting was adjourned. The house was built in the 40's or 50's and was positioned at an angle (north/south) unlike other structures on the boulevard. It was also located with a front yazd set back of 13.8' at the northwest corner of the house. The floor azea increase is necessary to provide a safe and legal stair to our existing loft. This space is F.A.R. countable, and is currently serviced by a library ladder. For my wife and I this is a safety issue. Although our home is not of the "turn of the century" Osgood era, we feel that its' scale and charm need to be respected. With this in mind, I met with Suzannah Reid of HPC at the site to discuss ow needs. She was comfortable with the concept of maintaining a 12" deep alcove on the north facing wall, that would not require any roof changes. The combination of house angle, set-back, and bend in the road, make this scenario a one-o~-kind on the B9ule~+azd. Please consider our request. BATE: August 1, 2003 John & Nancy Chromy received Redstone HYC approval for minur alterations to 366 Redstone Boulevard, on July 22, 2003. The approval included a small expansion of the building foot print into an existing notch in the building wall. This area of the building is currently sitting within the front yard setback. The building was built in 1949 and does not conform to the traditional street pattern, but the position of the building on the site is characteristic of this style of building and the Rl{PC feels it should be respected. The RHPC found that the proposed alterations are appropriate, minimize the overall impacts to the structure, and conform to the Redstone Historic Preservation Destgn Guidelines.
