RESOLUTION OF THE PITKIN COUNTY, COLORADO
BOARD OF ADNSTMENT
GRANTING A COLLECTOR STREET SETBACK VARIANCE
FOR TWO MILE RANCH, LLC
Resolution No. 2003-06
WHEREAS, Two Mile Ranch, LLC, owners of 3448 Woody Creek Road, aze requesting a fifty
foot (50') Collector Street Setback Variance where fifty feet (50') is required from the Woody
Creek Road right-of--way, for the construction of a driveway and retaining wall that will exceed the
six feet (6') in height allowed within a setback, by two feet (2'), and
WHEREAS, the parcel contains 39.637 acres, is located in the RS-20 zone district, and is fully
described in Exhibit A; and
WHEREAS, the Boazd of Adjustment is vested with the power to grant or deny such variances by
virtue of Title II, Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised
Statutes, 1973, 30-28-118(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment makes the following
findings:
1. Proper notice procedures, including the notification of all adjoining property owners, has been
demonstrated.
2. The required hazdship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment to the public welfare and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Boazd of Adjustment, that a fifty foot (50')
Collector Street Setback Variance be granted for the construction of a driveway and retaining wall
as depicted on Exhibits B - D, due to topographical hazdships.
WARNING: Any violation of the terms of this resolution may result in rehearing and possible
revocation.
The Resolution was adopted by vote of the Boazd of Adjustment of the County of Pitkin, State of
Colorado.

Head opened the meeting at 5:28pm. The Boazd's newest alternate member, Taber Sweet
was introduced to the Boazd.
Case #2003-OS Olson, John and Barbara
Lot 2, R&O Subdivision, aka 1444 Lower River Road
John Olson was present to request a 20 foot Collector Street Setback Variance where 50
feet is required from the Lower River Road right-of--way, to construct a barn on this 24.8
acre pazcel in the AFR-10 zone district.
Olson did not have his affidavit of posting. He admitted that the rainstorm on Saturday
ruined the sign. He was directed to submit the affidavit to the Community Development
Department on Wednesday.
Schaffner explained that last September the Boazd of County Commissioners approved
Collector Street Setbacks along various county roads, including Lower River Road. This
parcel is contains the Roazing Fork River, a lazge floodplain azea, State Highway 82, and
steep slopes. A narrow bench exists between Lower River Road and a slope to the bench
adjacent to the river.
Cooper asked what the required setback was before last September. Schaffner explained
that based on the lot size and zoning, the pazcel has a 100 foot front yard setback. Since
the proposed structure lies within the 50 foot requirement, the Collector Street setback
takes precedence.
There were no members of the public present, and no objections were filed.
Head stated that several easements encumber the pazcel, and made a motion to approve
the request as presented due to topographical constraints. Throm seconded the motion
and it passed 5-0. Sweet did not vote.

Case #2003-06 Two Mile Ranch, LLC
3448 Woody Creek Road
Steven Kaup was present representing the Two Mile Ranch, LLC in their request fora 50
foot Collector Street Setback vaziance where 50 feet is required, for the construction of a
driveway that will exceed 6 feet in height within the setback.
The affidavit of posting was submitted.
Schaffner informed the Boazd that last September the BOCC voted to increase the grade-
change allowed for driveways within setbacks from 30 inches in height to 6 feet in height.
Schaffner reminded the Board that the applicant had been before them a few times
already requesting Collector Street setback variances for other driveways that exceeded
the " 30 inch rule". This proposed driveway exceeds 6 feet in height within the setback.
The pazcel contains over 100 acres and is approved for numerous homesites. The ranch
fronts Woody Creek Road for about two miles, and all access points to the various
homesites aze off of Woody Creek Road. The drop in elevation from the road to the
parcel necessitates these variance requests.
Head stated that based on other vaziances being granted on the parcel for the same reason,
he saw no reason to deny this application.
Olson made a motion to approve the application as presented due to topographic
constraints. Head seconded the motion and it was approved by a vote of 5-0. Sweet did
not vote.
Minutes: The minutes from the April meeting were reviewed. Head made a motion to
approve the minutes as written. Olson seconded the motion and all five were in favor.
Sweet did not vote.
The Board decided to hold the July meeting on July 8, due to the July 4`h holiday.
There being no further business before the Boazd, the meeting was adjourned.

In the following text, significant events aze described which initiate the requirement for a
variance that would authorize the Two Mile Ranch, LLC., to construct an access road
connecting to Woody Creek road. The hazdships that categorize this variance request aze
existing terrain in relationship to approve building envelope locations, visibility requirements
and the owner's intent to co-locate disturbance.
Terraiu and approved enve~iooe locations
Point of access from Woody Creek road to envelope's #9 and #10, where the least amount
of structural fill and impact for road construction may take place has been determined to
have, at its greatest height, a fill of eight feet. This point of highest fill is 42' from the
centerline of Woody Creek Road. In order to overcome existing, consistent steep slopes and
to m;n;m;ze grading run-out into the natural meadow, the road's centerline mav;m;7es a
natural buttress at proposed location and descends at a 7% to 8%. Due to existing steep
slopes throughout the length of possible access points, design analysis has determined that
this access location is most well suited for low-impact development at this location.
Visibt7ity
The design location fox entry to Woody Creek road to envelope's #9 and #10 has the
greatest on-coming traffic visibility east and west due to the fact that the access road is
located at the greatest tangent to the curve which describes the centerline of the public road
in this location. In addition, the access road takes advantage of a natural land buttress at this
tangent which also minimizes impact and construction materials for constructing the road as
well as creating a vantage point by which both directions of on-coming traffic can be safely
analyzed. In addition, two specific groupings of woody vegetation that expand foliage
extensively doting the spring and summer months would also impact visibility at various
locations throughout the embankment leading to the site. In response to this potential sight
obstruction, the proposed access road lessens the obstruction of site lines by utilizing the
natural butrress which does not support the establishment of vegetation east and west of
this formation.
Go-location of impact its
In accordance with Piktin County resolutions to minimize impact by co-locating disturbance
and to continue to fulfill an on-going effort by the owner to utilize low impact construction
techniques at the Two Mile Ranch, the design for the access road to envelope's #9 and #10

has been located to overlap the utility corridor. (See site map included.) This is primarily
achieved by establishing the proposed access location and synchronizing the wide azcing
road curve that aligns the overlap of utility corridor and road. The necessary utilities; potable
water, propane, communications, fire suppression and electrical transmission lines will be
installed in the utility corridor during staggered events in the same construction envelope
that is defined by the center line of the road.
Given these hazdships, we aze requesting that the Pitkin County Board of Adjustments
review our request fora 50 foot vauance in the public right-of--way to Woody Creek Road
For construction of an access road to envelope's #9 and #10 at the Two Mile Ranch.

1. Pursuant to Section 3-Z00-080 of the T„and Use Code, Two Mile Ranch Management Trust I,I~C
("Applicant") has applied to the Community Development Director of Pitkin County, Colorado
("Director") to amend the prior approvd to permit the following:
Y Establish "activity envelopes" adjacent to each building envelope turd the proposed bridge
locations to accommodate wnslruction staging.
v Relocate a portion of the utility corridor.
Y Relocate and establish a building envelope for the hydroelectric plant,
Y Reconfigure the access to Building Envelopes S a»d 6.
2. The property is zoned RS-20 and contains 245 acres.
The property is located on Woody Creek Road, and is more specifianlly described in Exhibit A..
4. 'The Board of County Commissioners ("BUCC°) approved the Two Mile Ranch GMQS
Exemptions, Special Review, 1041 Hazard Review, Conceptual Submission and historic designation,
which acconunodazes the conswction of 8 new single family residences on the property, pursuant [o
Resolution Nos. 109-2001 and 144-2001.
5. '1-he Director finds that the proposed amendments do not create a»y additional [mpacts on 1041
areas, will not change the use of the proposed development or the basic character of the land, arc consistent
with action taken during the original review, do not increase of€site impacu, aad will not endanger the
public health, safety or welfare.

hydroelecvic plant; and the relocated pottiou of the utility cvtridor.
3. The "activity envelopes" shall only be utilized for parking, material and equipment staging, and
deliveries. Construction trailers shall only be staged within building envelope 3.
