COUNTY, COLORADO, REZONING CERTAIN PROPERTIES WITHIN PITKIN
COUNTY TO THE RLJRAL AND REMOTE (RR), TRl and TR2 ZONE DISTRICTS

. The Planning and Zoning Commission adopted Master Plans for several portions of

"' 4. On January 26, 2005, on second reading at a public hearing, the Board rezoned propeRies

V~ LL u 5. To address an inconsistency in the public notice for the rezoning hearing in 2005, the

w BOCC directed Community Development Department Stafffo repeat the process of
~ rezoning subject to current rezoning and public notice procedures in the Pitkin County
Land Use Code.
6. The Pitkin Counry Planning and Zoning Commission considered the rezoning of
properties depicted on Eshibits 1-5 at a regularly scheduled meeting on September 4,
2007 and certified approval to the $OCC.
7. The BOCC finds that the proposed rezoning is consistent with the applicable Master
Plans, policies and reaulations of the Pitkin County Land Use Code, is suppoMed by
changed conditions in the affected areas, and advances the health. safety and welfare of
the Communiry.
8. Master Plans that provide general and or specific suppor[ for rezoning include the 2003
East of Aspen/Independence Pass Plan, (Smuggler/Hunter Creek and Aspen
Mountain/Richmond Ridge Neighborhood Planning Areas (NPA), specifically;) and the
2003 Maroon/Castle Creek Land Use Master Plan. At a minimum, these plans provide
the following direction:
• "Rezone (face of Smuggler) ...to allow for a tra~sition from high density within the
Aspen Urban Growth Boundaq~ Area to low density/]ow intensity/recreation and
RuraURemote zoning and uses (that exist;p'
• Rezone (face oFAspen Mountain) from AFR-10 "... to low density/low intensiry/open
space/recreational and/or rural remote (zone)...°
• "New development should be compatible with and not fundamentally change the
character ofany neighborhood or area;"
• "Lands outside the urban growth boundaries will be deemed most appropriate for the
preservation of agriculture, natural habitat, environmental resources, open space and
rura] residentia] uses "
• "Consider reviewing and revising the cunent boundary of the R/R zone district to
include parcels up Express Creek...;"
• "Ensure that zoning promotes and protects the agricultura] and rural residential
character and existing low density residential development patterns of the area,
providing incentives for the preservation of open, agricultural and other natural

resource lands, and allowing For very low density development of sensitively sited
single family homes;'"
). Changed conditions that have occurred to further support rezoning include, among other
things, the joint purchase of parcels on Smuggler Mountain by the City of Aspen and
Pitkin County for open space and recreational uses and management, and action taken by
property owners on Aspen Mountain to sterilize a number of private parcels through the
County s Transferable Development Right (TDR) program.
10. The rezoning complies with sections 2-20-100 (Public Notice Requirements) and Z-40-10
(Land Use code Text Amendments and Rezonings) ofthe Land Use Code.
NOW, THEREFORE, BE IT ORDAINED by the BOCC that it hereby rezones properties
shown on the maps attached as Exhibits 1 throu,h 5 m the RR Zone District and the TRl and
TR2 Zone Districts, as depicted on those maps. This ordinance is effective immediately upon
adoption pursuant to C.R.S. § 30-15-405 as it is necessary for the immediate preservation of the
public health and safety of the citizens of Pitkin County. The circumstances of the necessity far
immediate enactment are as follows:
Pitkin County has produced Master Plans for the areas affected by this zone
district, which were adopted by the Planning & Zoning Commission on October
28, 2003 and November 4, 2003. These Master Plans are the East of Aspen/
Independence Pass Master Plan and The Maroon / Castle Master Plan. i he
Master Plans are a product of a study that began in April, 2003, and was pursued
continuously until the adoption of the Master Plans.
The Master Plans provide recommendations for zoning changes to proteci the
public health, safety and welfare. The zone districts in this ordinance reflect the
recommendations af the Master Plans and aze consistent with those
recommendations. Fai]ure to make the rezoning effective immediately could
result iu patterns of development inconsistent with these Msster Plan
recommendations and with the changed conditions in the affected neighborhoods.
