Two Mile Ranch Management Trust LLC ("Applicant") proposes to construct eight new single family residences on the former Natal Rarich, while continuing to run the agricultural operation on the ranch.. A total of 11 building envelopes are proposed: eight for mw residences (one of which will be for the ranch manager); one for a barn and common wastewater treatment facilities; one for the historic Natal residence and other existing structures; and one for an historic cabin to be used as a "ranch store" for the occupants. of the residences. The Applicant does NOT propose to subdivide the property. 2. The Applicant has applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") for the following approvals: ~ 1041 Hazard Review and Conceptual Submission to establish building envelopes; ~ GMQS Exemption to replace one legally established dwelling unit, the 1950s Natal residence (demolished in 2000), with a new residence for the ranch manager of up to 5,750 square feet of floor area within Building Envebpe 4; ~ GMQS Exemption for one additional single family unit of up to 5,750 squaze feet of floor area within Building Envelope 1 via the designation and restoration of the original, historic Natal residence; ~ GMQS Exemption and Special Review to establishBirilding Envelopes 5-10 as TDR receiver sites; 3. The Applicant's parcel is zoned RS-20 and contains 245. acres, which is currently subdivided into four sepazate pazcels. 4. Said parcel is located on Woody Creek Road approximately 3.5 miles from the intersection of River Road and Woody Creek Road, and is more specifically described in Exhibit A. 5. The Planning and Zoning Commission reviewed the application at regularly scheduled meetings on Mazch 6 and Apri13, 2001, and recommended approval by a vote of 41. '/\ Resolution No. _-2001 Page 2 6. The BOCC reviewed the application at duly noticed public hearings on Apri125 and June 13, 2001, at which time evidence and testimony were presented with respect to this application. The BOCC finds that the application is generally consistent with the applicableprovisions of the Pitkin County Land Use Code, based on the following conclusions: A. The proposed density is 75% of what is allowed under the current RS-20 zoning. B. The Applicant proposes to limit the floor area within each building envelope (ranging from 2,350 to 5,300 squaze feet) for a total of 33,150 squaze feet of floor area (inclusive of gazage and subgrade space and exclusive of agricultural structures) on the entire property. C. The building envelopes are limited to one acre. or less in size, and all avodl wildlife habitat areas, geologic hazard aeeas (including slopes of greater than 15%°), riparian aeeas, and the 100 year floodplain. In addition, the wildfire hazard within the envelopes is low and can be mitigated. D. The development is consistent with the intent of the RS-20 zone. district to permit low density, single family residential development, to preserve agricultural operations, to maintain the rural lifestyle and to locate development outside of wildlife habitat areas. E. The Applicant has limited the size of the envelopes in order to be able to preserve a minimum of 95% of the "acreage historically available for human food production, or hay, grain and other feed crops for livestock." F. The Applicant has committed to preserve the historic structures on ire property. NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby designate Building Envelopes 3 and 11 to the Pitkin County Historic Inventory. BE IT FURTHER RESOLVED by the BOCC that it does hereby rescind BOCC Resolution No. 99-174 and does hereby approve the Two Mile Ranch GMQS Exemptions, Special Review, 1041 Hazard Review, and Conceptual Submission, subject to the following conditions which shall run with the land. and. be binding on all successors in interest: ~] L Prior to submission of any earthmoving, access, septic or building permit applications, the Applicant shall submit a 1041 Hazard Review Site Plan to the Community Development Department for approval and recording. The site plan shall also be submitted in digital format for integration into the County's GIS system. The mylaz copy of the site plan must be signed by the owner prior to submittal for recording. The site plan shall comply with the provisions of Section 5-70-040 of the. Code, and shall be amended as follows: A. Revise the utility corridor to avoid slopes greater than 30 percent wherever possible. Resolution No. _-2001 Page 3 2. Prior to recordation of the 1041 site plan, the Applicant shallconvey the four existing, separately described parcels into one parcel 3. Prior to recordation of the 1041 site plan, the Applicant shall record document(s), in a form acceptable to the County Attorney, restricting the property against any further it subdivision or condominiumization. The Applicant shall also agree not to use any of the proposed residences for short-term rental or any other commercial use. 4. The Applicant shall submit access permits for the common road improvements to the County Engineer for review and approvaC Access permits for roads shall. be submitted prior to building permit application for the specific boiling envelopes accessed from those roads. A fugitive dust control plan shall be included with the permit(s) for review and approval by the Environmental Health Department. 5. Prior to submittal of any septic permits for the property, the Applicant shall pnvide documentation of adequate quality and quantity of water from a well or other approved water source to the Environmental Health Department. Wells must be located within the building envelopes unless alternate locations are approved by the Communitylkvelopment and Environmental Health Departments. 6. Prior to issuance of any building permits, the Applicant shall submit a traffic mitigation plan to the Environmental Health Department to address the project's contribution to air quality degadation. Prior to submission of a building permit for each new residence on the property, the Applicant shall: A. Obtain approval of a septic permit from the Environmental Health Department. Septic systems shall be located within the approved building envelopes and utilty corridor, and must comply with the setback requirements from surface and groundwater sources. A qualified professional engineer must design the system. B. Obtain afireplace/woodstove permit from the Community Development Department. C. Obtain an access permit for each individual driveway, if not constructed as part of the common road improvements, which shall be approved bythe County Engineer. If the driveway exceeds 30 inches above or below natural grade within the setbacks, the Applicant shall submit and the Board of Adjustment shall consider a variance application prior to submission of the Access Permit. D. Submit asite-specific drainage and erosion control plan for review and approval by the County Engineer. Said plan shall address positive grading away from the residence, diversion of up-slope water from the building site, and on-site detention of flows from roofs and other impervious surfaces. E: Submit a fugitive dust control plan for review and approval by the Environmental Health Departrnent. F. Submit a Construction Management Plan in accordance with the Asset Management Plan, for reviewand approval by the County Engineer. The Construction ManagementPlan shall indicate that vehicles associated with Resolution No. _-2001 Page 4 construction (i.e. employee traffic, construction vehicles, staging and deliveries) shall not violate County Law, such as parking on County rights-of--way. G. Submit a landscaping plan for review and approval by the Community Development Department. This landscape plan shall depict all screening plantings to occur outside of the building envelopes including screening of the dwelling unit within Building Envelope 1 from the wildlife habitat area to the south, screening of Building Envelope 7 from the wildlife movement corridor to the east, and screening of Building Envelopes 9 and 10 from Woody Creek Road. 8. All development. shall.. comply with the provisions of Pitkin County's Noxious Weed Management Plan. 9. All structures shall comply with the standards and requirements of the AspenFire Protection District. 10. The Applicant shall comply with the following provisions regarding irrigation ditches: A. Grant access to irrigation ditches to ditch owners. B. Construct buildings immediately uphill of irrigation ditches unless a ditch is culverted. C. Design land uses to avoid flooding problems from flood irrigation. D. Place basements and soil absorption sewage disposal. systems in locations where they will not be impacted by flood irrigation or seepage from irrigation ditches. 11. The Applicant shall comply with the following measures to mitigate impacts on wildlife: A. B. C. D. E. F G. The width of the driveway to Building Envelopes 5 and 6 shall be minimized to the extent possible to limit disturbance to native vegetation. The bridge shall be a single span with all abutments located outside of the floodplan. II Cottonwoods within or adjacent to Building Envelope 6 shall not be removed. ', Plant a vegetative screen along the west side of Building Envelope 7 to further screen the residence and its associated activity/disturbance from the wildlife movement corridor. No more than two dogs per residence shall be permitted, and all dogs shall be kenneled. Kennels shall be constructed prior to issuance of a Certificate of Occupancy for each residence. No dogs shall be allowed on site during construction. All trash garbage shalt be kept in approved bear proof containers, as required by BOCC Ordinance No. 010-2001, the Wildlife Protection Ordinance. `All pets shall ~ be fed inside or within fully enclosed kennel(including roof). All bird feeders (including hummingbird feeders) shall be suspended 10 feet from the ground, between trees and away from homes. ~~ All horse hay shall be fenced with 8-foot high mesh game-proof fence at owner's expense. Any horse grains should be kept in approved bear proof containers. ~ Develop and. implement a habitat mitigation plan as specified in the April 13, 2001 memo from Jonathan Lowsky, Wildlife Biologist, which is attached as Exhibit B. The plan shall be reviewed and approved by the Pitkin County Wildlife Biologist ~ prior to submission of any building permits. Resolution No. _-2001 Page 5 12. The Applicant shall comply with the following wildfire mitigation standards: A. Vegetation of less than 6 inches in height shall be maintained within a 1 afoot perimeter around all structures. Woody plants shall be avoided; B. For a minimum of 30 feet around all. structures, future landscaping (trees) should be spaced so that the outer edges of tree crowns will not be closef than 10 feet. C. Remove all deadfall within 150 feet of all structures D. ~ Roofs shall have a Class A, non-combustible roof system. Wood shake/shingle ~(~~ roof coverings aze prohibited in all wildfire hazard areas. Roofs with less than a 3:12 pitch are not permitted in 1041 Wildfire Areas unless they comply with the following: 1) All roof coverings shall be noncombustible materials asdefined in the Uniform Building Code (UBC) 1997 Section 1504 and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of cleazing the roof. 3) All roof designs shall facilitate the natural process of clearing roof debris. Protrusions above the roofline, such as pazapets, shall be prohibited. 4) Roofs shallbe installed as required by UBC 7997 Chapter 15 and shall have a minimum slope of 1:48:. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. E. Vents shall be screened with corrosive resistant wire mesh with mesh''/o inch maximum. F. Roofs and gutters shall be kept clear of debris. G. Yards shall be kept clear of all litter, slash, and flammable debris. H. All flammable materials and firewood/wood piles shall be stored on a parallel contour a minimum of 15 feet away from any structure. I. Swimming pools or ponds shall be accessible to Fire Department vehicles. J. Fences shall be kept olear of brush and debris. K. Wood fences shall not connect to the structure. L. Fuel tanks shall be installed underground with an approved container. M. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation aoound any above-ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour firaresistive construction on the exterior side of the walls. N. Each structure shallhave a minimum of one 10 pound approved ABC fire extinguisher placed in a visible and accessible location O. Addresses shall be clearly mazked with 2 inch noncombustible letters and shall be visible and installed on anon-combustible post. P. New utility lines shall be buried within the utility corridor or along roadways/driveways. 13. The Applicant is not required to submit annual reports attesting to conformance with the conditions of this approval, nods the proposed use required to commence within 12 months of the date of this approval; as would otherwise be required under the Special Review provisions in the Land Use Code. 17. The Applicant shall pay cash-in-lieu fees for Pazks/Recreation/Open Space (Land Use Code Section 3-130-040), Schools (Land Use Code Section 3-130-tl80) and Roads (Ordinance No. 22-2000) as would be required for subdivision, prior toissuance of a building permit for each new residence. These fees shall be paid in'accordance with the Code provisions in place at the time building permits are obtained. 18. The Applicant represents and agrees that the "store" building located to the east of Building Envelope 3, will be used to store goods for use on the property by the family and guests at the ranch only. The Applicant shall survey and mark all areas where United States Forest Service 'V (USFS) land crosses the property so the public knows where these access points are.., located. In one location, on the east side of the ranch and designated by N-SS, 1/256 corner, Section 24 & Section 19 on the site survey, the rail fences 'nnld be removed to allow access through Forest Service property. The USFS boundary may be signed as if passes through and splits the ranch on the south side of Woody Creek Road. The ~ Applicant shall work with the USFS to establish appropriate access to adjacent public lands. ~ 20. The Applicant shall submit an application for a permanent wastewater treatment system for the historic Natal Residence by August 1, 200 L 21.
