Proper notice procedures, including the notification of all adjoining property owners, has been demonstrated. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfaze and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment, that a Major Road Setback variance be granted for the construction of a wastewater treatment facility as shown on Exhibits "B" and "C" due to downzoning. WARNING: Any violation of the terms of this resolution may result in rehearing and possible revocation. Case # 2004-06 Aspen Pitkin County Housing Authority Woody Creek Mobile Home Park Waste Water Treatment Facility Project Manager, Ben Ludlow, was present to represent the City ofAspen in their request for a Collector Street setback variance where 50 feet is required as measured from the Woody Creek Road right-of--way, and for a side yazd setback where 10 feet is required on this 6 acre pazcel in the SR zone district for the construction of a waste water treatment facility. The Affidavit of Posting was submitted. Ludlow posted two site plans on the wall and described where the subject site was located. He explained that the existing sewage facility has failed and has been cited by the Environmental Health Department. The new facility will bring the system up to State standazds and enable the red-tag to be lifted. Ludlow explained that all yard setbacks are being met. It is only the Collector Street setback that is an issue. Head pointed out that the request is also fora 5' side yard setback variance. Ludlow stated that he did not request a side yard setback in the application. Schaffrier stated that she added the side yard request. She explained that the mobile home park has not yet been subdivided, and that the entire parcel contains 6 acres. It is not a small pazcel as shown on Ludlow's map. However, she could not remember why she thought a side yazd setback was necessary, and after reviewing the file, concluded that she must have misread the lines on the plan that was submitted (which was not the plan presented by Ludlow). The Board conc]uded that a side yard variance was not necessary. 000006' r __ _. Cooper asked who was paying for this improvement. Ludlow responded that money was currently coming from the Housing Authority, but that funds would be recovered from the sale of the Mobile Home Park to the homeowners. Ludlow responded that the facility costs about $820,000.00. Cooper asked how many gallons a day the plant could handle. Ludlow responded about 35,000. Cooper asked what other areas were to be served with this plant. Ludlow explained that the system will serve the Mobile Home Park, the store, the restaurant, and two other homes. Cooper asked at what percent of capacity the facility will be operating when they go on-line. Ludlow stated that they were running about 17,000-18,000 gallons a day right now. Cooper asked whether there was capacity to add on to the service area. Ludlow did not know. Olson commented that the drawings were not dimensioned. She commented that for permit submittal, the building location should be dimensioned. Ludlow responded that the drawing was to scale. Throm asked Schaffner to confirm that River Road use to have less of a setback requirement. He noted that the existing structure lies within the setback. Schaffner stated there was a lesser setback requirement, but that she did not know when the current facility had been built. Thom made a motion to approve the request as submitted due to downzoning. Cooper seconded the motion and it passed 4-0. The Board discussed whether they could all meet on July 6 (due to the holiday), and decided that they would all be in town to meet. Schaffner informed that Board that there are two cases scheduled for July. The Board discussed whether to elect a new Chair, and decided that they would wait until all Boazd members were present. Case # 2004-OS Dudley Hawkins Planted Earth at 12744 Highway 82 Architect, John Baker and owner, Dudley (Bill) Hawkins were present to request an Arterial Highway setback variance where 200 feet is required from the Highway 82 right-of--way, and side and reaz yard setback variances where 20 feet and 30 feet respectively are required on this 1 acre pazcel in the AFR-10 zone district for the construction of a greenhouse addition to the existing commercial structure, and for a shade structure. The Affidavit of Posting was presented to the Co-Chair. Baker stated that the proposed expansion received approval from the BOCC for an Expansion to anon-conforming use. He showed the Board a site plan and illustration of the proposed structures and stated that these are the same plans approved by the BOCC. He mentioned that there is an existing one story structure on the site. Baker explained that there are two setback issues. First, the entire parcel lies within the 200 foot Arterial Highway setback. Second, the existing structure lies 11 feet from the reaz property boundary; therefore the existing structure is also within the rear yard setback. The side yard setback requirement is 20 feet, and they are requesting a 7 foot variance for the side. The existing lattice structure will tum 90 degrees and will be relocated on the site. In order to maximize the solar exposure that the greenhouse will need, Hawkins wishes to locate the new structure on the side of the existing structure. There is no negative impact on or objection from any adjacent property owners. He reiterated that the BOCC has 00000 already approved this project expansion. Schaffner confirmed that there were no objections from the public. Sweet asked if the neighboring parcel was Parcel D of Burlingame and isn't there a new trail going in there. Baker stated yes. Baker stated that there would never be any development on the south side of the building. Cooper asked why not. Is it greenspace? He clarified that when Baker said south, he meant the side towards town. Baker said yes. Baker didn't think that the lot was zoned for development, and besides the 200 foot setback would preclude any development from occumng on the parcel. Schaffner stated that there is no zoning which precludes development, and certainly, variances from the Arterial Highway setback could be acquired. Adjacent property ownerships were clarified. Cooper observed that the proposed structure doesn't encroach into the setback as much as the existing structure. Sweet commented that that was only true for the Arterial setback. The Board struggled to find a hardship. Hawkins stated that he's lost money each year he's been on this site. Last June he lost $40,000 due to the late frost. He needs the structures to preserve/protect his inventory. Cooper made a motion to approve the request as submitted due to downzoning. Throm seconded the motion and it passed 5-0. Head stated that this was another project approved by the BOCC, and again urged staff to find a more streamlined approach. Head requested the Affidavit of Posting. Ludlow stated that he did not post a sign and does not have the Affidavit of Posting. Head suggested that the Board hold a Special Meeting to hear this case. Cooper asked why, absent duress, the applicant should be granted a Special Meeting. Ludlow stated 000009 that the system must be installed before the end of the year to comply with the State's permit. Head added that the current facility is failing. Cooper agreed that that was a compelling argument. Head made a motion to table the case until June 15 at 5:30pm. Cooper seconded the motion and all voted in favor. The Board again decided to wait until all members could be present before choosing a new Chair. Head made a motion to adjourn the meeting. The building is 37 feet at its closest point to the right of way and 42 feet from the edge of pavement. For this building to be allowed in this location, a setback variance is required. The site plan and location for the building was developed and determined through public process and many reviews by the State of Colorado Department of Public Health and Environment, the Aspen Pitkin County Housing Authority, the Woody Creek Homeowners Association, and the Woody Creek Caucus. All of these governing bodies wanted the new plant to be in the same location of the existing basin for the septic system. The existing non-conforming system is approximately 17 feet from the- ROW and 22 feet from the edge of pavement. The front yard set back is 6 feet, which also is non- conforming. We are fixing the front yard setback, and alleviating the ROW setback by and additional 20 feet. APCHA is aware that the City of Aspen Project Manager, Ben Ludlow, is requesting a variance for the 50 foot setback from the Upper River Road right of way because of the proposed location of the new waste water treatment plant. We do not object to the variance request and are very anxious for the approval of the building location because of the long process it has taken to get the building built. We have chosen that location for the building because of it's lower impact to the neighborhood and the improvement that it will make over the existing system for the property.
