This shading could possibly be implemented by simply spraying the existing glass baffle with an inexpensive can of black spray paint on the side towards my house. On two occasions, you told me you would inquire of Holy Cross Electric what could be done to shade the light: Finally, on Tuesday, January 28th, I ask you if your inaction as to any resolution of this matter meant you intended to do hothing. When you replied you indeed intended to do nothing, you left me with no alternative but to complain to the Pitkin County Building Department; which I did, that"same afternoon. Lot is 5.1 acres in size and is a conforming lot in the zone district. ZONING: AF-2. APPLICANT'S REQUEST: Sc2nid Foreground Review approval to con- struet an addition to a single-family dwelling unit. The existing structures on the site contain approximately 28'00 square feet of floor area. After the remodel and addition, the floor area will amount to about 5400 s`quare'feet. REFERRAL COMMENTS 1) Planning Engineer: Tom Newland comments in Attachment 2 that the applicant has done everything .possible to minimize the view of the structure from State Highway 82. PLANNING OFFICE CO1~Il~SENTS Section 3-1.13 of the Land Use Code establishes nine review criteria to be used to review development proposals in the Scenic Foreground. Criteria - Whether the development has utilized existing topography, such as dry ridges and hills, to screen build- ings to the maximum extent possible. Criteria - Whether the development has 'been located outside of the designated Scenic Foreground, or on a suitable site at the greatest possible distance from State Highway 82. Van Domelan began that presently there is a garage attached to the House with a four foot overhang. The variance request was to extend the overhang from 4 ft. to 8 ft. to convert the garage to living quarters and have a porch on Front. This would improve the appearance 'of the house. The porch would be at ground level. °The other request was to permit an addition. They wanted to remove the present structure which encroaches on the 100 ft. Highway 82 setback. There would be a very sma I additional encroachment. The footprint would be 92 ft. from the Highway edge of right of way. They would like to place a 4 ft. roof overhang on the addition. The original house was constructed in 1960. 'Sparovic was not required to get a variance at that time. Newbury explained that in 1965 the setback requirements were changed. She thought the highway was realigned about the time the house was built. Van Domelan explained that the river bordered the south side of the property; there are restraints imposed by the floodplain. Charles Cuniffe, the architect was also present. He explained that they were trying to add an a~3ditian that was clean and simple. Van Domelan explained that this was only the first step in the review process due to the fact that they were in the Highway 82 view plain. Pearson had a problem adding the 4 ft. overhang to the existing garage because it encroached further into the 100 ft. Highway 82gsetback. Cuniffe explained that even with the additional overhan the new front would be a much quieter look, it would help with the next step of the review process and it would give the house a covered entrance. Shaffran felt it was downzoning problem, the house was' built prior to the current zoning. Pearson moved to grant a 51 ft. frontyard setback variance for the expansion of the roof over the existing garage and a 13 ft, frontyard setback variance for the proposed addition as demonstrated an the attached drawings. A backhoe prt excavated in the fill area showed man- laced fill to a depth of about 4 1/2 feet, the pit depth. Groundwater level was at the bottom of the pit. A swell-consolidation test was performed on a relatively undisturbed hand driven liner sample of the natural clay exposed at footing grade. The results of the swell-consolidation test, shown on Fig. 1, indicate moderate to high com- pressiblity under light to moderate surcharge loadings, At this time we recommended subsurface exploration in the addition area .'east of the glacial moraine soil to determine depth to adequate bearing soils.` tJe returned to the site on September 28 and drilled two exploratory borings. The exploratory boring logs are shown on Fig. 2.
