HomeMy WebLinkAboutbocc.ord.012.2000 ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, GRANTING A REZONING OF A PORTION OF THE UPPER FRYING PAN VALLEY WITHIN PITKIN COUNTY AND ADOPTING THE UPPER FRYINGPAN VALLEY OVERLAY ZONE DISTRICT Ordinance No.Ola-2000 RECITALS 1. The Pitkin County Planning and Zoning Commission adopted the Frying Pan Master Plan on April 18th of 2000. 2. The Pitkin County Planning and Zoning Commission reviewed the proposed implementation of the Master Plan and specific rezoning proposals on July 25 and August 16,2000.On August 16, 2000 the Planning and Zoning Commission made the following recommendations to the Pitkin County Board of County Commissioners. a. To approve the rezonings as requested with the exception that the proposed RS-35 zone district be rezoned to RS-30(unanimous). b. That the allowable Floor Area within the Planning Area shall be 4,000 square feet (unanimous). 3. The Pitkin County Board of County Commissioners reviewed the proposed zoning changes on September 13 and October 11,2000. The later being a duly notice public hearing. 4. The Pitkin County Board of county Commissioners found the proposed rezoning and the creation of a new Overlay Zone district to be consistent with the Frying pan Master plan and with the rezoning criteria in Section 3-220-020 of the Pitkin County Land Use Code. NOW THEREFORE BE IT ORDAINED by the BOCC that it hereby rezones all AFR-10 lands in the upper Frying Pan Valley within Pitkin County from AFR-10 to RS-30 with the exception of two parcels specifically noted below to rezoned from AFR-10 to RS-160 as follows: Specific re-zonings apply to AFR-10 zoned properties to be rezoned RS-30. Intent: The UFV, Upper Frying Pan Valley Overlay Zone District, is intended to implement the recommendation of the Upper Frying Pan Valley Master Plan. The theme of the Master Plan is the preservation of the rural and recreational nature of the Upper Frying Pan Valley, while at the same time sustaining the viability of its unique community. Where the County's Official Zone District Map designates a property as being within the Upper Frying Pan Valley Overlay, then the provisions of this Overlay, including its use limitations and dimensional requirements, shall supercede those of the underlying zone district.The overlay shall apply to lands in the Upper Frying Pan Valley zoned RS-30,RS- 35,RS-160,B-I and AFR-2. B. Allowed Uses: The following uses are allowed as of right in the Upper Frying Pan Valley (UFV) Overlay Zone District: 1. Accessory buildings and uses. 2. Animal production and husbandry services, other farm and agricultural uses (not including commercial feed lots). 3. Bus stop. 4. Crop production. 5. Farm buildings. 6. Uses not listed. 28. Vehicle and aircraft sales and service. E. Dimensional Requirements: The dimensional requirements that shall apply to all permitted and special review uses in the Upper Frying Pan Valley (UFV) Overlay Zone District shall be those of the underlying zone district, with the exception that the maximum floor area for any dwelling unit in the UFV Overlay shall be four thousand(4,000)square feet based on the current definition of floor area F. Additional Review Standards for Development Applications. When the County is evaluating an application for a special review use, or for a subdivision or PUD within the Upper Frying Pan Valley Overlay,the following additional criteria shall be considered: 1. The proposed development shall be compatible with the unique rural and recreational character of the Upper Frying Pan Valley. 2. The proposed development shall be consistent with the land use goals of the Upper Frying Pan Valley Master Plan, which are: (a) to limit residential development in the Valley to the maximum extent possible; (b) to support commercial development that provides quality growth and serves the community without creating a financial burden; and (c) to preserve the land in the Valley primarily for agricultural and recreational purposes. The proposed development shall also be consistent with the environmental and scenic goals of the Master Plan, which are to protect the water supply, air quality, wildlife areas, riparian areas,and wetland areas of the Upper Frying Pan Valley. 3. New residences and access roads shall comply with the provisions of Sections 3-60, Environmental and Aesthetic Standards, and Section 3-80, 1041 Environmental Hazard Areas, of the Land Use Code as applicable. and shall not be located in meadows, wetlands, riparian habitat areas, and critical wildlife habitat. Development shall not occur on slopes in excess of thirty percent (30%), or on ridgelines, as viewed from the Frying Pan River Road. Development is encouraged to be clustered near the Frying Pan River Road,to preserve continuous tracts of land in open space.
