COLORADO,GRANTING SPECIAL REVIEW TO SPRINT FOR THE INSTALLATION OF
TELECOMMUNICATION ANTENNAS ON THE ROOF OF THE ASPEN VALLEY HOSPITAL

RECITALS
1. Sprint("Applicant"),has applied to the Board of County Commissioners of Pitkin County,
Colorado(`BOCC")for Special Review for the installation of 4-telecommunication antennas mounted flush
against the exterior wall of the existing penthouse on the roof of the Aspen Valley Hospital, and approval for
the associated base platform with related equipment to be installed adjacent to the penthouse.
2. The property is located at 0401 Castle Creek Road and is more specifically described in Exhibit A.
3. The Planning and Zoning Commission("Commission")at a regularly scheduled meeting on August
1,2000,reviewed the application,and forwarded a recommendation of approval to the BOCC.
4. The BOCC heard this application at a duly noticed public hearingon September 27,2000,at which
time evidence and testimony were presented with respect to this application.
5. The BOCC finds that the Applicant's proposal complies with applicable sections of the Pitkin
County Land Use Code,provided that conditions of this document are adhered to.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby grant approval to the Sprint Cellular Special Review, subject to the following conditions,
which shall run with the land and be binding on all successors in interest:
1. The Applicant shall adhere to all material representations made in the application and public
meetings
2. The antennas shall blend-in with the color of the existing penthouse. The Applicant shall use
materials for the platform structure that blend-in with the surrounding environment. Non-reflective
materials should be utilized.
3. All structures and antennas associated with this approval shall be removed when the lease expires
or when the use ceases.
4. The Applicant shall provide a radio frequency radiation(RFR) study to the Pitkin County
Communications Engineer for review and approval prior to building permit application.
5. The Applicant shall conduct annual RFR site assessments with grid measurements. This
information shall be submitted to the Pitkin County Communications Engineer on an annual basis.
6. Access shall be provided to Pitkin County to conduct an independent RFR study to ensure that
the applicant is operating within the FCC's Maximum Permissible Exposure(MPE) standards.

7. There shall be no exterior lighting associated with the telecommunications facility.
8. The Applicant shall receive administrative approval from the Community Development
Department for the"future"antennas represented on the north and east elevation plans,prior to
installation of these antennas.
9. This approval shall expire after five years on October 25,2005. The Applicant is required to
submit an application for extension of this permit no later than October 25, 2004 if an extension is
desired.
10. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin
County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land
Use Code, § 4-140 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on
October 25,2003.
