DEVELOPMENTACTIVITIES OF THE PITKIN COUNTY I,AND USE CODE

RECITALS
1. Upon adoption of the Revised Land Use Code in July, 2006, the Board of County
Commissioners of Pitkin County, Colorado ("BOCC") directed the Community
Development Deparhnent Staffto follow up with amendments to address necessary
clarifications and modifications identified during the first six months of use of the Revised
Code. This Ordinance revises section 7-10-30 ofthe Pitkin County Land Use Coda
(PCLUC) as set forth in aitached Exhibit A.
2. The Pitkin County Planning and Zoning Commission considered the proposed Code amendments on
first reading and continued frst readiry~ at Special Meetings held jointly with the BOCC on July 17,
and October 2, 2007, and recommenQed approval of the amendments to the BOCC.
3. The BOCC finds that amendments to the above referenced Code Section are consistent with the
policies and regulations of the Land Use Code, are in compliance with applicable Master Plans, to
the extent they apply, and in conformance with Section 2-40-10 of the Land Use Code regarding
Land Use Code Text Amendments.
4. The BOCC fmds that adoption of this ordinance is necessary for the immediate preservation of the
public health, safety and welfare of the citizens of Pitkin County and therefore declares this
ordinance and legislation to be effective immediately pursuant to C.R.S. § 30-15-405.
NOW, TI3EREFORE, BE TT ORDAINED by the Pitkin County Board of County
Commissioners that it hereby amends the above-referenced Section of the 2006 Pitkin Land Use County
Coda, as set forth in E~ibit A hereto.

EXHIBIT A
7-10-30: EXEMPT DEVELOPMENT ACTIVITIES
The following activities are exempt from review for compliance with the standards in tkiis-S#apte~
~Sections 7-10'-40 throuqh 7-20-90, provided that the specific developmenf has previously
received approval covering pre-existing development and construction pursuant to the Pitkin
~ County Land Use Code in effect at that time. Although compliance with this these portions of
Chapter 7 is not required in the following exempt situations, compliance is encouraged.
(a) Agricultural activities directly related to the raising of crops or raising/grazing of livestock, and
that do not result in the construction, expansion, or renovation of any structure.
(b) Remodeling, expansion or reconstruction of any existing structure provided there is no
expansion or construction of a structure into a Constrained Area. For the purposes of this
areas.
(C) Development activity not exceeding twenty thousand (20,000) dollars in construction costs,
that avoids or adequately mitigates Constrained Areas.
(d) Other activities exempted from the provision of one or more of the Sections of this Chapter
shall be exempted from the application of that Section, but shall be subject to standards in other
Sections of this Chapter from which they are not specifically exempt.
