HomeMy WebLinkAboutbocc.ord.054.1999 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO AMENDING VARIOUS SECTIONS OF THE PITKIN COUNTY CODE TITLE VI ANIMAL CONTROL REGULATIONS ORDINANCE # 99- _ 1. In 1972, the Board of County Commissioners ("the BOCC") enacted Title VI Animal Control Regulations of the Pitkin County Code. This Title establishes guidelines and a fine and fee structure as it relates to animal control regulations for Pitkin County. 2. In 1981, the BOCC passed Resolution #81-57, which repealed and reenacted the Title VI of the Code which increased the fines and fees for various violations of the code. There have been no fine or fee increases since 1981, making it 18 years since an increase. 3. An amendment to change references to old terminology such as "Dog Control" to read "Animal Safety" and "Dog Catcher" to read "Animal Safety Officer" is also contained in this ordinance. 4. The Board desires to repeal and reenact sections of Title VI ANIMAL CONTROL REGULATIONS of the PITKIN COUNTY CODE increasing fines and fees for various violations and to change references to old terminology to read as follows: ARTICLE 1 —DOGS 1-2 License and Registration Required,Application 1-2.2 No dog over the age of six (6) months shall be kept harbored, or maintained, within the County of Pitkin, Colorado, unless the owner, keeper or person in charge of such animal shall annually pay a designated agent of Pitkin County for collection (as may from time to time be determined by the Board of County Commissioners of Pitkin County) a license fee of Six dollars ($6.00) for an altered dog and Sixteen dollars ($16.00) for an unaltered dog to be remitted to Pitkin County as directed from time to time by the Board of County Commissioners for each and every dog owned, kept or harbored. For purposes of this Section 1- 2, persons authorized to perform vaccinations against rabies may be designated as agents for Pitkin County for the collection of license fees hereunder. Section 1-3 Rabies Vaccination It shall be the duty of every person who owns or harbors any dog or dogs in the County of Pitkin, State of Colorado, to have such dog or dogs vaccinated against rabies with either a one year or three year vaccine by a person legally authorized to do so. Section 1-4 Tag and Collar Ordinance#99--t_L Page 2 In case a dog licensing tag is lost, destroyed, mutilated, a duplicate will be issued by the Pitkin County Animal Safety Officer or his authorized agents, or a designated licensing agent of Pitkin county, upon the presentation of the receipt showing the payment of the license fee for the current period and upon a payment fee of Two Dollars ($2.00) for each duplicate. Section 1-7 Dogs Running at Large 1-7.1 (a) (a) A dog which is on private property (whether of its owner, possessor, keeper or any other person) shall be deemed running at large unless accompanied by (and within sight and hearing distance of) its owner, possessor, and keeper, or his agent or within the positive control of said person;positive control meaning tethered, structural fencing of any size and/or invisible fencing system. Section 1-13.2 Notice to Owner; Redemption When a dog is impounded, as provided in Section 1-13.1 of this Article, it shall be the duty of the Pitkin County Animal Safety Officer and his/her authorized agents to make reasonable efforts to notify the owner, possessor, or person who harbors or keeps the same, if known, and if not known to post at the Pitkin County Courthouse and at the place of the shelter and at such other place or places as may from time to time be designated by the Board of Pitkin County Commissioners, a notice contain a description of such dog and when and where caught. A charge of Thirty Dollars ($30.00) shall be made for impounding a dog. An additional charge shall be made for maintaining an impounded dog, which shall be Ten Dollars ($10.00) each day or part thereof, while the dog is kept in the place of impoundment, including the day of removal, but not including the day of impounding. No dog shall be released form the place of impoundment until the owner shall have paid all charges for impounding and maintaining the dog and until the dog has been licenses and vaccinated against rabies in accordance with this regulation. Section 1-14.3 (a) In addition to the impoundment fee provided for in Section 1-13.2 above, administrative assessments and the nature of the violation for which the assessment may be accepted and paid by the violator under the privileges of the Section shall be as follows: (1) Failure to display tags $ 20.00 (2) No dog license 25.00 (3) No rabies vaccination 40.00 (4) Dogs running at large,first offense Altered Dog 35.00 Unaltered Dog 45.00 (5) Dog running at large, second offense Ordinance#99-� _ Page 3 Altered Dog 65.00 Unaltered Dog 85.00 (6) Dogs running at large, third offense Requires a court appearance Altered Dog 130.00 Unaltered Dog 170.00 (7) Dogs running at large,fourth offense Requires a court appearance Altered Dog 260.00 Unaltered Dog 340.00 (8) Barking 40.00 1-18 Kennel License Delete entire section. (Annual kennel licenses are issued through the State of Colorado) 1-20 Violations and Penalties (a) Any violation of any provision of this regulation not involving bodily injury to any person shall be a class 2 petty offense, punishable by a fine of not more than six hundred dollars ($600.00), or imprisonment in the County jail for not more than ninety (90) days, or both such fine and imprisonment. Article 2—CATS 2-1 Impoundment 2-1.3 There shall be paid, by any owner claiming any impounded cat, Five Dollars ($5.00) for each day said animal was held, plus any additional charges for veterinary services rendered during impoundment. NOW THEREFORE, be it ordained that the Board of County Commissioners of Pitkin County, hereby amend the Pitkin County Code Title VI Animal Control Regulations Section 1- 2.2, Section 1-3, Section 1-7, Section 1-13.2, , Section 1-14.3(a), Section 1-18, Section 1-20 (a) Section 1-4,and Article 2 Section 2-1.3. and be it further ordained that all references to "Dog Control" to read "Animal Safety'; all references to "Animal Control" to read "Animal Safety', all references to "Dog Catcher" to read "Animal Safety Officer'; all references to "Pound"to read "Shelter"and all references to "Warden"to read "Animal Safety Officer"as it relates to Title VI Animal Control Regulations.
