The minutes df the meeting of June 18, 1969 are hereby amended to include the following
resolution:
R E S O L U T I O N
APPROVING ZONING CHANGE
WHEREAS, Petition for change in zoning of land herein-
after described was duly filed on behalf of the WALTER P, PAEPCKE
LIFE INSURANCE TRUST and J, V, SPACHNER, requesting change from
A & F, Agriculture and Forestry uses to B-Business, and Public
Hearing was duly conducted after Notice advertised as prescribed
by law before the Pitkin County Planning & Zoning Commission and
before the County Commissioners, and the Planning & Zoning Com-'
mission, after due consideration, has recommended that the change
in zoning requested be granted subject to conditions hereinafter
stated,
AND, WHEREAS, additional Petition for change in zoning
from A & F, Agriculture and Forestry to B-Business was also filed
by L-P Gas Company for a tract of land hereinafter described, which
is adjacent to the other tract of land, and Public Hearing was like-
wise .conducted before the Board of County Commissioners and the
Pitkin County Planning & Zoning Commission, after Notice duly
published concerning such change, and the Planning & Zoning Commission
has recommended that the change be granted under conditions here-
inafter stated,
AND, WHEREAS, in each instance the property owners have
submitted a plan of development, with restrictions and safeguards
which are found and determined to be necessary as a condition to
granting such rezoning and the County Commissioners find and deter-
mine that there is a public need for additional business zoned
property in the County, and that such zoning changes should be
granted, with the exception of an area 200 feet in width adjacent
to Colorado Highway 82, which should remain as A & F,
THEREFORE BE IT RESOLVED That the Petitions for Change
of Zoning from A & F, Agriculture and Forestry to B-
Business are hereby granted as to the land belonging
to the WALTER P. PAEPCKE LIFE INSURANCE TRUST and J. V,
SFACHNER, shown upon map marked Map "A" attached hereto
and incorporated herein, and also the area owned by
L-P GAS COMPANY, as shown upon map attached hereto
and incorporated herein marked Map "B", with the excep-
tion that the area located within 200 feet of the
northerly right-of-way of Highway 82 shah not be
rezoned, but shall remain A & F, Agriculture and
Forestry; the zoning change hereby granted to be
expressly conditioned upon compliance with the orotect-
