The Board of County Commissioners of Pitkin County, Colorado,
met at 10:OOo'clock AM, March 18, 1968, with the following members present:
Chairman T. J. Sandy; Commissioners Orest A. Gerbaz and J. Sterling Baxter;
County Attorney Robert Delaney; County Clerk Peggy E. Coble.
as follows:
Bills were audited, approved and order paid from Various Funds
OLD AGE PENSION FUND: $2,630.00
PUBLIC WELFARE FUND: 1,651.09
Public Hearing was conducted on application of ASPEN
HIGHLANDS SKIING CORPORATION for a 3.2 beer license for the
Merry-go-round Restaurant. Notice had been posted and published
of hearing for March 4, 1968, at which time the hearing and con-
sideration of the license were duly recessed until this date.
No persons appeared, either at March 4 or March 18, 1968 meet-
ings to object to the issuance of the license. Mr. Lee Bottorf,
Manager of the Merry-go -round Restaurant was present, and testi-
fied on behalf of its issuance.
After due consideration, the following Resolution was
unanimously adopted:
WHEREAS, the Commissioners have found and determined
that a 3.2 beer license is required to serve the
reasonable requirements of skiers and other persons
patronizing Aspen Highlands Skiing Area, and the
license applied for is intended to replace a former
license issued to premises that burned down, and
notice has been duly posted and published,
THEREFORE, BE IT RESOLVED, That the application for
3.2 beer license of Aspen Highlands Skiing Corporation
is hereby approved for Merry-go-round Restaurant.
The Commissioners discussed the reappraisal program
and the appraisal service being performed under contract by
Justin Haynes & Company. Mr. Max Arnold, Vice-President of
that company and Miss Dorothy Mikkelsen, County Assessor, advised
that while good progress was being made by Pitkin County in the
reappraisal program and most of the basic data had been com-
piled with which to put this program in effect, no equitable
or equalized pattern of valuation could b~ established, parti-
cularly with respect to the Aspen RE-1 School District and
Roaring Fork RE-1 School Districts, unless and until a comparable
method of appraisal and valuation for tax purposes were arrived
at with surrounding counties, particularly Gunnison, Eagle and
Garfield Counties.

It was thereupon decided that mee{~ing should be
scheduled and held with the Assessors and County Commissioners
of these surrounding counties to attempt to arrive at a basis
for equalized valuations consistent with the reappraisal pro-
gram, and the Assessor was requested to attempt to schedule a
meeting for May 6, 1968 with the Commissioners and Assessors.
Mr. & Mrs. Patrick Henry and Miss Kate Blakely pre-
sented a petition which they advised was signed by 1,045 per-
sons, primarily tax payers and voters in Pitkin County request-
ing that Wagner Park located within the City of Aspen be
retained as a Park permanently and that the Commissioners take
action to set the property aside and declare it to be permanently
committed to park purposes. The petition was initiated because
of suggestions that have been made by representatives of the
City of Aspen that a convention center and related services
be constructed on the park site. The Commissioners advised
that it had been a policy for several years to utilize this
property for park purposes for the general public; that a
committee representing the City, the County and the School District,
had been active in improving the property for these purposes,
and that they had no intention of making a change, and thereupon
unanimously adopted the following Resolution:
WHEREAS, the Board of County Commissioners have
found and determined that Wagner Park in the City
of Aspen, Colorado, is needed as a Park and that
the open space provided thereby is of great value
to the people of Aspen and many property interests
have been acquired and become vested with the ex-
pectation that Wagner Park would continue to be
used for park purposes, and the desires of most
of the community and residents of Pitkin County //,
are that the property continue to be used for f'-~
park purposes,

THEREFORE, BE IT RESOLVED That the Commissioners
do hereby find and determine that Wagner Park is
needed and required for use as a public park and
should be, and is hereby, declared to be a public
park.

.-_ _________. The Commissioners discussed with Mr. David Hoffer
and other representatives of the U. S. Forest Service the -
program and prior planning that had been done in connection
with the management and use of County owned mining claims
surrounded by the National Forest.
The Commissioners authorized further proceedings
looking to the negotiation of a satisfactory lease for park
and public purposes of a small area belonging to the D&RGWRR
located westerly of the Slaughterhouse Bridge.
The Commissioners further heard suggestions of
Mr. John Doremus, Chairman of the Pitkin County Parks Associ-
ation, suggesting cons id eration of establishment of a
Recreation District in the Aspen area, to operate and manage
parks. It was suggested that if such a district were created,
it should be broad enough to include the various forms of
recreation in addition to parks.
The Commissioners discussed a proposal with Three M
Company to provide micro-film equipment in the County Clerk's
Office on a quoted price of $11,691.00.
Mr. R. L. Brawn requested abatement of taxes for
1952 on Lots E, F, G and the West Half of Lot H, Block 60,
Aspen, advising that some question existed in the Treasurer's
records as to whether the taxes had or had not been paid in
that the remark column showed the word "Paid," but that no
other record of payment was apparently made, and the property
was not advertised. After discussion, the following Resolution
was unanimously adopted:
BE TT RESOLVED That, interest and penalties in
the sum of $25.06 shall be abated on 1952 taxes
as to Lots E, F, G and the West Half of Lot H,
Block 60, Aspen, provided the taxes of $21.13 are
promptly paid.
The Commissioners discussed with Mr. Charles Vidal,
representing Snowmass at Aspen, the matter of paving about
6.23 miles of the Brush Creek County Road, extending from
highway 82, southerly to the Janss Development at a cost of
$7,650.00 per mile on a participating basis with the developers.
No definite decision was reached.
The Commissioners discussed various zoning and plan-
ning matters with Mr. Edgar Stanton. A Public Hearing was
scheduled for May 3, 1968 in the District Court Room, Court
" House, Aspen, at 7.30 P.M. to consider petition for rezoning
from A -F to A -R of a tract of land northerly of the Vroom
property near the Buttermilk development, the Public Hearing ,
to be held before the Commissioners and the Planning & Zoning ='~
Commission. ~~
Mr, John Doremus presented a proposed plan of develop- ~/~
ment for the Airport Ranch area, advising that it was for con- ,~
sideration only and was not approved by the property owners or ~~j'1
zoning officials.
The Commissioners were advised that the negotiations
for operation of the City-County Dump by Mr, Sherbondy had
failed and approved continuing dump operations under Mr. Buffington
on a temporary basis.
The Commissioners, after discussion,

A petition for abatement and refund of taxes filed
by Dorothy M. Mirick, as to Apartment Unit No. 4, Aspen Alps,
in the sum of $538.92 for the year 1966, payable in 1967, was
after consideration, approved unanimously, based upon certifi-
cation by the Pitkin County Assessor that this constituted a
double assessment.
A petition for abatement of 1967 taxes in the sum of
$19.04 filed by Keating Coffey and Virginia Coffey was approved
on certification by the Pitkin County Assessor that it was a
double assessment on Schedule 40 for 1967.
A further petition for abatement filed by Keating
Coffey and Virginia M. Coffey for taxes for 1966, payable in
1967, in the sum of $17.86 was approved and taxes in that amount
directed to be abated on certification of the Pitkin County
Assessor that such taxes represented a double assessment. '-~-~

problems that have arisen in connection with the issuance of ~ ~ '/
certificates that taxes are paid to date as required by statute,
in situations where mistakes, contradictions, errors and omissions
appear on the tax books in the Treasurer's Office, particularly
as to taxes assessed more than thirty years ago.

The Treasurer reported that many situations exist
where the best evidence obtainable indicates taxes have been
paid but evidence of payment is sometimes incomplete, and the
uncertainty existing renders it impossible to enforce collection,
and collection would probably result in double payment. The
Commissioners agreed that in this situation and as to taxes
and certificates concerning matters more than thirty years ago,
that the Commissioners would confirm and approve certificates
of taxes paid where the best evidence available indicates pay-
ment was made.
On that basis, the following Resolution was unani-
mously adopted:
BE IT RESOLVED That all taxes assessed more than
thirty years ago, and all tax sale certificates
issued to Pitkin County more than thirty years,
shall be, and the same are hereby declared abated
or cancelled as to property covered by the follow-
ing numbered certificates that taxes are paid to
date issued by the Pitkin County Treasurer's Office,
and that said certificates are hereby ratified,
confirmed and approved, being Certificates Numbered
2562 through 2590 inclusive, Pitkin County Treasurer's
Records.
The County Commissioners further considered
additional tax sale certificates duly certified by the Treasurer
to be subject to cancellation, and thereupon the following
Resolution was unanimously adopted:
BE IT RESOLVED That the certificates of taxes held
by Pitkin County, each of which is more than thirty
years old, having been duly certified to Commissioners
by the County Treasurer, shall be and the same are
hereby cancelled, to -wit:
