On August 6, 1990 you granted us a foundation permit as a result
of Jack Wheeler's blueprints or drawings, and one of your inspectors approved
the footers that Mr. 47heeler installed in anticipation of building our house.
Only after all of this happened did we learn by visiting your
department on September 7 that there were structural deficiencies in the
building plans. An employee of your department suggested we phone James
Wilson, a building consultant for your department, to get the details.
In turn this led us to consult Mr. Peter Dobrovolny of StimUp Architects
in Basalt, an architect and structural engineer, who gave us amore critical
evaluation o£ Jack Wheeler's„plans. As a result I fiave written the enclosed,.,
letter to Jack Wheeler, giving him an opportunity to explain, if he wants
to, how he justifies what has happened..
Obviously he has not had much time to reply. However, the December 19
deadline for an extension of our foundation permit will soon be here. In
view 'of the circ~unstances and our dstanoe'from face-to-face contact with
officials in your department, potential builders, and a new arrangement with
an architect, we request a suspension in the requirement for an extension
beyond December 19.
If your department had alerted us before the footings ire poured and
approved, while we were still in our present `summer `residence at'24869 Frying

deadline. As it is, we would appreciate your holding in abeyance in this
situation your rules regarding the timing of an extension,
Sometime in the spring when we can arrange to come to Aspen, with an
advance appointment with the person in charge of such matters in the Building
Department, we will seek a discussion of next steps pexmi.tted under your
procedures.
Please let me know as soon as possible your decision about this suspension
of your requirement that we grequest.

Dear Jack Wheeler:
I wrote you on September 12 to .tell you that I had talked by phone the
weekend of Septembers 7-9 with James Wilson, who is a Building Consultant
for the Aspen/Pitkin Regional Building Department. I was referred to him
by that department because of structural deficiencies in the building plan
you submitted to the Pitkin County Building Department..
I want to share with you a portion of Mr. Wlson's,September 11th letter
to me: "As we discussed, the review has been canpleted but one structural
deficiency must be resolved prior. to final. approval. The design specifies
2 x 8 rafters ('Doug. Fir No. 2 assuined)on 16" centers on Sheet 6. -The
designed span of the rafters is;_15'O".....Assuming a design snow load of 85
psf for the locale, and allowing a snow load reducti.on_of 32.5 psf for the
slope of the roof, the rafter design 1s inadequate."
He continued, "Numerous attempts to ~rrect the deficiency through the
designer, Jack Wheeler, have been unsuccessful," This was a complete
surprise tows. The day we left you mentioned briefly that something still
•• needed to be done aboyt,our,house plans to satisfy the Pitkin County `Building
Code; however, during July and August you repeatedly told us this was
bureaucratic delay by Pitkin County..
In my telephone discussion with Mr. Wilson and later with a busy building
wntractor whom°I met but did,not ask to build for us, I learned that it

would be advisable to refer the plans you drew for our house to an azchitect
who is also a structural engineer. I did consult such an azchtect and have
just received his letter which_oontains the following problems as quoted
from that letter .,M.
"l. The roof rafter deficiency mentioned by Jim Wilson --what is shown as
2x8 rafters spaced at 15" o.q. need to be Zx12 at I2" o.c.
2. The ridge beam carrying these rafters, shown as 8 3/4" X 12" at the middle
part of the building needs to be 8 3/4" X 15 3/4". While not appearing a
significant increase in size, the beam shown on the drawings is structurally
under-designed by 66~.
3. The column shown under the ridge beam, located between the doors to the
two second floor bedrooms at the reaz of the house canes down over the hallway'

below -- no support. At the foundation level there i.s,no footing even close
to where this load (maximum design load by tJBC`cocie of 21,600 lbs. --nearly
11 tons) needs to be supported,
4. The drawings would i[tq~ly, but don't clearly indicate, that the floor
joists'. supporting the second floor span the width of the building-and are

presiunably supported at the center of that span by the. hallway walls at the
center of the main floor. On that assumption, what is shown as 2X8's @ 16"
o.c. need to be 2X10s @ 16" o.c. However there i.s no indication of girders,
beams or a~ foam of support to transfer these floor loads to the foundation.
5. As you have observed there is quite a bit of low ceiling space on the
second floor. The roof slope is difficult to determine because dimensions,
shown don't agree with what i.s drawn if one scales the drawings. Based on
di.mensi:bns shown, the slope 3s 10.4/12 or 41 degrees. Where this becomes
most important is i.n the bathroom. The cej.ling height at the front face
of the vanity is 5'6", at the wall behind the vanity, only 3'10", a little
low to hang a mirror and you'd surely bump your head brushing your teeth.
The bathroom needs to be relocated.
6. The 'ceiling height in the bedrooms is a lesser consideration, hri,iever
the width of the two upstairs bedroans, before the ceiling height drops to
6'6" is only 8'6", not nearly as spacious as the floor plan would indicate.
7. Downstairs, as the stairs are drawn, the headroom underneath 1n the
pass-thru varies from 5'1" to 7'2" -- watch your head`agai.nl A careful
reconfiguring of the stairs which will still meet code requirements for rise
and run (a rise of 8"and a run of 9") can retain the stair in its current
location and provide full ceiling headman at the pass-thru."
He also contradicted what you told us about Pitkin County not permitting
the a~~unt of glass Marjie proposed to you in her original design. `This
is what he said: "As to your letter regarding the amount of glass on the
front of the house, you're correct. Wiah the proper orientation, and without
going through the calculations, it is likely that a design very similar to
your original vision could have been achieved. Portlier, with the proper
orientation, to the south, and with proper amsideration of i.nsulati.on and
type of 'glass, the annual space heating requirements of the house could be
reduced by at least one half,"
Jack, as you know, we agreed to suspend and end the second contract,
dated July 30, which we signed with you that related to the excavation and
foundation. We-did so after several canpetent building people hacl thought
we were paying too much for what we were getting.
However, the first contract dated April 21, with respect to your drawing
of building plans, for which we paid $2,000-plus, was not fulfilled, and
it would seem you dial not want to respond to James Wilson's various phone
calls. I was dismayed to learn this. I am even more dismayed by the second
architect's opinion outlined above. I hate to think that your various
representations to us about the plans and your knowledge about building were
not accurate. You are such a nice guy that I hope you can explain to us what
went wrong, and how it can be crorrected.
Most serious seems to me the above statement, "At the foundation level
there is no footing even close to where this load (maximum design load by
UBC code of 21,600 lbs --nearly 11 tons)-needs to be supported."

would lake to think you were not intending to hurt or defraud us.
I am aware that when we asked you to terminate the July 30 foundation
contract because of excessive oust you insisted on the following wordings

release Jack Wheeler..from any responsibility for the cronstruc- ,
tion and work on our property on the fYying Pan Road adjoining
the"Mountain Haven Ranch, including footers he has installed

It never occurred to me that. this wording might be used to exempt you
from any faulty workmansYu.p. SUS'ely you must have some. reasonable explanation
to renew our confidence in you....
In our first contract dated April 21 you gave us a copy of your original
plans. Do your original plans have accurate stiippoiting footers which the
architect we consulted sa~.d are missing? Were there adequate headman

plans with an explanation?

identified your lot to be located in the Thomasville area. I
definitely need more specific information about your location and

plan review on your proposed residence at 2550 Frying Pah Rd., in
Meredith... As we discussed, the review has been completed, but one
structural deficiency must be resolved prior to final approval. The design
specifies 2x8 rafters (Doug-Fir No: 2 assumed) on 16" centers on sheet 6.
The designed span of the rafters is 15'-0". Assuming a design snow load
of 85 psf for the locale, and allowing a snow load reduction of 32.5 psf for
the slope of the roof, the rafter desigh is inadequate:
Numerous attempts to correct the deficiency through the designer, Jack
Wheeler, have .been unsuccessful. Because .you indicated that Mr. Wheeler
had been dismissed, I will assume that you will correct the roof design by
increasing the rafter size; reducing the span or8thervrise bringing the

ISSUE: The applicant, John and Marjie Swomley submit ed a,
request for a Minor 1041 Hazard Review for a single f roily
.residence on 30.19 acres zoned AF-1. The property is loctated'
about l 1/2 miles SE of Thomasville on Frying Pan Road, in ~J18S,
R83W,'Section 21 West of the 6th P.M. Access to the property is'
on a".:gravel road shared by adjoining properties. An acc`ess'
easement is indicated on the Plat. Attached „is, proof that he
lot is legally created, by County Attorney Tom Smith. After'
visiting the site staff finds that the site is,_suitable, for a
Minor 1041 Review.. Attached is the site. plan.
FINDING:
1) The building envelope and driveway 'access"'is located
outside of any 1041 Hazard areas.
2) The applicant has: provided proof that the lot was'
legally,created._
3) The, applicant has provided a site plan for sign-off.
RECOMMENDATION: Sections 5-400.3(b) and 5-400.5(b) of the Land
Use Code provides' that the Planning Director is authorized to
approve a site plan' and application for a Minor 1041 Hazard
Review,, Based on the findings referenced above, Planning Staff
recommends approval of the Swomley 'Minor 1041 Hazard Review and

Dear Herb,
An environmental and sanitation survey was conducted by
this office at De Haven Resort and Trailer Court on 10-12-72.
The findings are as follows:
LEGAL VIOLATIONS
1. The source of the domestic drinking water supply
determined to be unsatisfactory due to high turbidity,
unreliability, and high potential hazard for stream
contamination. This condition has been noted on pre-
vious inspections and brought to the attention of the
owners together with the suggestion that an infiltra-
tion chamber or a well be used as an alternative
source for the supply. If the source is not changed
by spring runoff 1973, it is obvious that sample re-
sults will be so bad as to necessitate a Cease and De-
sist Order and compliance date be issued.
2. It appears that open burning is conducted as a
means of solid waste disposal rather than utiliza-
tion of trash collection service and landfill which
is available to residents of the area. This consti-
tutes a current violation of Colorado air pollution
resolutions and will result in immediate Cease and De-
sist Order.
HAZARDOUS AND/OR UNDESIRABLE CONDITIONS
1. Extremely high ground water conditions (2-3feet)
combined with use of cess pools and other unapproved
types of sewage disposal systems indicate certain con-
tamination of the ground water in the area of the
cabins. This condition is in turn aggravated by the
artificial diversion of surface waters throughout the
area. It has been recommended to the owners and man-
ager that the artificial diversion of surface waters
be curtailed in an attempt to dry out the soil mantle
currently being used for sewage disposal and to facili-
tate installation of new sewage treatment facilities at
such time as the old facilities fail out and necessitate
repair.

2. Ilwnerous surface uninsulated sewer pipes were
noted in the trailer court area. This condition will
allow for freezing problems this winter and no doubt
leave many dwelling units without any form of sewage
disposal.

' 3• General conditions in the trailer court were
somewhat less than desirable in that there were numer-
ous junk cars, unskirted trailers, junk accumulations
in and around trailers, extremely unservicable access
roads, no designated parking spaces, etc.
(Note: It must be born in mind that the three above
items are strictly observations of potential future
problems and should not be considered violations of
any existing regulations at this time.)
FAVORABLE COPdDITIONS FOUND
1. Water supply is currently chlorinated as recently
ordered by this department.
2. The preliminary inspection of existing dwelling
units indicated no severe sewage disposal surface dis-
charges or surface water contamination points at this
time.
3. There were tangible indications that sincere efforts
were being made by both the owner and manager to upgrade
the entire facilities as required.
SUMMARY
In view of the above findings, it would seem unlikely that
the Commissioners or the Planning Council would approve the
requested. waiver and thereby give approval to the existing con-
ditions without requiring in some manner that these conditions
be corrected either before or immediately following the approval
of the requested waiver. It is estimated by this office that
the economic feasibility is extremely good for correcting these
problems since it appears to be in the neighborhood of $2000
worth of improvements on the development area, valued in excess
of $100,000.
However it should be noted that in the event these conditions
are not corrected by means of the subdivision regulations with
approval, they will be corrected in the long run by the efforts
of this department.
