The Board of County Commissioners of Pitkin County, Colorado, met at
10:00 o'clock AM, September 3, 1968 with the following present: Chairman T. J.
Sardy; Commissioners Orest A. Gerbaz; J. Sterling Baxter; County Attorney Robert
Delaney; County Clerk Peggy E. Coble.
Mr. Francis Whittaker of Aspen appeared before the
Commissioners to discuss the proposed County wide two percent sales
tax stating he had opposed the City Sales Tax, but recognized that
a source of revenue of this nature was necessary and that the County
proposal should be supported under certain conditions. In parti-
cular, he stated that a capital improvements program should be
established, including projects such as were recommended in the
recently completed Park & Recreation Plan of the City of Aspen.
Mr. R. L. Herberg and Mr. C. A. Vidal representing
Snowmass-at-Aspen, also discussed the proposed sales tax with the
Commissioners, Mr. Herberg stated he felt it would be preferable
if the City of Aspen collected its own tax, and the County of Pitkin

collected the tax required for County purposes. He further stated
he felt an apportionment whereby taxes collected within the City ,~~ !~`~~`'

world be paid to the City and those collected outside the City would
be paid to the County was grossly unfair, and inequitable, and that
a substantial part of the tax should be allocated to County purposes
such as the Hospital, the Airport and similar projects, especially
capital improvements.
A letter from the Colorado Health Department to the
City of Aspen requiring a "Certificate of Designation" of the dump
was considered and the following Resolution was on motion duly made
and seconded unanimously adopted:
WHEREAS, the City of Aspen and the County of Pitkin
jointly operate and maintain a public dump on a
tract of approximately 100 acres acquired by the
City & County westerly of Aspen and expect to con-
tinue such joint operation as a sanitary land fill
dump,
THEREFORE, BE IT RESOLVED That the
operated and maintained jointly by
Aspen and the County of Pitkin is
as a Solid Waste Disposal Site and
this Resolution shall constitute a
as required by Article 23, Chapter

The Commissioners after conferring with Mr. Leon
Wurl, City Administrator of Aspen, approved installation of a
nine gauge chain link fence surrounding a 200'X 200' tract at the
dump site to be used for protectirn of impounded cars, and further
approved the construction and installation, under the low bid
submitted by Elcar Fence of $2,039.00, with the County to pay one
half of such amount, with the understanding that the City would
apply amounts received in excess of fees and costs to the dump
project.
Mr. Mike Strang requested road improvements on the
Snowmass Road above the large slide in order to serve a mining
operation which, he stated, expects to begin shipping ore soon.
Mr. Ron Blackburn requested information as to how
a tract of land near Lenado might be acquired from the County,
stating that he and eight other persons had been living in a house
there, which they believed might be on County land. The Commissioners
advised they would investigate the ownership of the tract in question
and that any sale of County owned land would be at public auction
after determination that such land was not required for public pur-
poses.
The Commissioners discussed the matter of arranging )
a joint maintenance program with Eagle County concerning the Frying- Y~~~d7
pan Road and decided that investigation should be made to see if `
economies could be effected in this manner, and if so, then the Eagle ~~
County Commissioners should be contacted.

The Commissioners examined certificates of deposit ~~'~`
of County funds at interest and directed that the Treasurer reinvest
certificates that had matured within limits that will keep funds
available for current requirements.
A petition for abatement of taxes by James A. Vale
for the years 1965, 1966 and 1967 was considered and it was deter-
mined that no basis was stated upon which the County could either
abate or refund taxes for which reason the petition was denied, it
appearing that the complaint related primarily to raising of taxes,
which was the result of annexation into the City of Aspen and the
formation of the Metropolitan Sanitation District.
Mr. Frank Delaney and Mr. Tom Griffin on behalf of
McCullough Oil Company rec{uested a statement of position by the
Commissioners with respect to the road leading up to McCullough
Oil Company property on Hunter Creek, which road intersects the
Red Mountain Road. Mr. Delaney stated investigation disclosed
that this was originally a toll road of the Company organized in
1887, and that in 1891 the road was taken over by the County, and
the County paid in excess of $13,000.00 for the road, and that as
far as he could determine it had never been abandoned. The Com-
! missioners advised that they considered the road to be a public
road, but that it had been removed from the County system some
years ago because of lack of use, and further that they did not
at this time see any basis upon which they could reopen the road
or improve it as a County Road,
They also advised that if development occurred
in the Hunter Creek area, then the access road should be placed
in the best location available for modern highway requirements
and should be designed to fit into the County's Arterial Road
System, presently under study.-
Mr. Edgar Stanton discussed zoning matters with
the Commissioners. A plat of the West Aspen Subdivision, Filing
No. 2, presented by the West Aspen Company, having been approved ~,_~

A further plat, filed by the same Compan°,J concern-
ing Lest Aspen Subdivision, F'ilnq ~Io. 3, was likewise approved.
A plat of the Jukati Subdivision filed by _~ohn ~7. Snyder for property
in the Riverside Placer was also approved. ~'~,11 of such plats were
approved under the express condition that the approval does not
extend to utilities and does not constitute any acceptance of
platted roads by the County.
The Commissioners inspected the Snowmass Road from
Colorado Highway 82 to the new bridge and directed that this section
of road be paved, and that one corner be improved and two areas be
filled, provided right-of-way clearance was either available or
obtained.

Commissioners heard a proposal by Mr. Dick Perrain
representing Colonial Life & Accident Company
Carolina, wherein they proposed to create a group
policy among County employees. The Commissioners
study the policies and investigate the company

The Commissioners directed that Public Hearing be
conducted at 11.00 a.m. on September 18, 1968 concerning the forma-
tion of a Pitkin County Airport Authority.
The Commissioners considered a petition by Mr. Gredig
as to acceptance of Horseshoe Drive, within a subdivision near Emma,
Colorado, as a County Road, and deferred action pending additional
road improvements by the subdivider.
The Commissioners were advised that Mr. Charles
Shumate, Chief Engineer of the Colorado Department of Highways,
had agreed that the Department would cooperate with the City of
Aspen and Pitkin County in order to consider a future highway
program to serve the Aspen community. Mr. Shumate advised that
new aerial photography was being obtained, and when available
would be glad to meet with officials of Pitkin County for dis-
cussions.
