J. Sardy; Commissioners Orest A. Gerbaz and J. Sterling Baxter; Robert Delaney County Attorney; Peggy E. Coble, County Clerk. Bills were audited, approved and ordered paid from Various Funds as follows: OLD AGE PENSION FUND: PUBIC WELFARE FUND: The U. S. Forest Service in connection with road extension and improvements in the upper Woody Creek area, above Lenado, designated by the Forest Service as Larkspur Mountain Road No. 15104.1, requested confirmation from the Commissioners of public roadways as now located and in place across portions of certain patented mining claims in that locality and upon motion duly made and seconded the following Resolution was adopted: BE IT RESOLVED That existing roadways as now located and constructed, with the right-of-way width of sixty feet are hereby confirmed as public roadways and declared to be necessary for public use, as located and shown upon the maps prepared by the U. S. Forest Service dated August, 1968, entitled Right-of-way Plat, Larks- pur Mountain Road No. 15104.1, White River National Forest, as said roadways cross the Whale, Texas and Alps Mining Claims,M.S. #12691, the Excelsior Lode, M.S. #12695, the Harpoon, M.S . #$12691 and the J. C . Freeman, M.S . ##7750. The Commissioners discussed with John Doremus, representing Pitkin County Parks Association, the matter of creating and obtaining title to the Smuggler Mountain area as a county owned public park and recreation area, and reported that the Parks Association over a period of months had been working on a plan of development, and presented copies of the plan of development to the Commissioners. After examination of the same, the Commissioners declared their continuing interest in proceeding with the acquisition of this area for a public park and recreation area as soon as surveys were completed and the application could be processed through the U. S. Bureau of Land Management, but requested that a revised plan be prepared by the Parks Commission and submitted to the County Commissioners. The County Treasurer reported that the following described tax sale certificates had been inadvertently omitted from a list previously cancelled; That the same were over thirty years old, were held by Pitkin County, and should be cancelled pursuant .. to law, whereupon on motion duly made and seconded the following -~~ resolution was adopted: BE IT RESOLVED That tax sale certificate No. ~ fG 200, of 1899 and No. 94 of 1901, shall be and ~ the same are hereby found and declared to be over thirty years of age, held by Pitkin County and therefore cancelled and extinguished, and the County Treasurer is directed to make appropriate entries in the County Tax Records. approved: The following liquor license renewals were unanimously Tower Restaurants, Inc., dba Tower Bar & Restaurant, including extended hours David L. Peterson dba Refectory Steak House A letter to Aspen City Attorney, Albert Kern, from the D&RGWW Railroad concerning abandonment of tracks from Woody Creek to Aspen was considered, and the Commissioners agreed to meet with railroad and city representatives at a convenient date to discuss conditions of abandonment. Mr. Lew Hollard and Mr. Frank from Redstone, requested advice and assistance from the County Commissioners as to having a roadway serving the Crystal River Park Subdivision declared to be a county maintained road, based upon the number of residents using the road, and were advised that it would be necessary to have the road constructed to county standard, and a clear dedi- cation to public use with the required right-of-way width before county maintenance could be considered. ' ~, i A revised plat of Lots 1 and 2, Block 5, Knollwood Subdivision presented by Jack Holst and Don Rathbon of an area ,~~1 along Colorado Highway 82, in Lots 4 and 9, Section 17, Township 10 South, Range 84 West of the 6th P.M., was examined, found to be in order and approved by the County Planning Commission, and thereupon was upon motion duly made and seconded, unanimously approved by the Commissioners for filing. - The Commissioners discussed various zoning matters with Mr. Edgar Stanton, Chairman of the County Planning Commission and based upon recommendations of the County Planning Commission decided that the provisions of the Zoning Resolution concerning construction of duplexes in R-6 areas should not, at this time, be changed, and thereafter on motion duly made and seconded, unani- mously adopted the following resolution: WHEREAS, the Pitkin County Planning Commission, following duly advertised Public Hearing has recommended change in setback regulations as hereinafter stated, and the Commissioners having duly considered the matter and taken into account comments and statements made at Public Hearing, duly advertised concerning the same, and recogniz- ing the extreme importance to Pitkin County and particularly the Aspen Community of good visibil- ity, widened four lane use, free traffic movement and adequate service and parking areas along Colorado Highway 82, do hereby find and determine that the setbacks should be revised as hereinafter stated, THEREFORE, BE TT RESOLVED That the Pitkin County Zoning Resolution shall be and the same is hereby amended to provide that: The Minimum Setback in the zoned area of Pitkin County along Colorado Highway No. 82 shall be 75 feet measured from the contiguous highway right-of-way line in areas zoned R-30, R-15, R-6, Residential, B-Business and T-Tourist. Pursant to previous agreement, Mr. Charles Vidal, representing Snowmass-at-Aspen, a joint venture, presented check to the Pitkin County Treasurer in the sum of $6,416.58, to apply against monies owed to Corn Construction Company for paving on the Brush Creek Road; this was received and ordered appropriated as a supplemental appropriation to the Road and Bridge Fund to be disbursed on regular County voucher. On motion unanimously adopted the Treasurer was ~~°~/ directed to transfer from the Pitkin County Airport Improvement Fund to the Road and Bridge Fund the sum of $15,013.34 as reimburse- ment for monies expended covering paving and work on the Pitkin County Airport.
