CONCERNING COUNTY GOVERNMENT AGENCIES, DEPARTMENTS, COM-
MISSIONS AND OFFICES AND THEIR PROGRAMS, AND ESTABLISHING
A SYSTEM FOR THE PERIODIC REVIEW AND FOR THE TERMINATION,
CONTINUATION, MODIFICATION, OR RE-ESTABLISHMENT THEREOF
WHEREAS, the expansion of County government has produced an
increase in numbers of agencies, departments, commissions, offices, programs
and rules and regulations; and
WHEREAS, establishing a system for the termination, continuation,
modification or re-establishment of such agencies, departments, commissions,
offices, and programs will put the County in a better position to evaluate
the need for their continued existence.
NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners
shall review, at least yearly, all governmental operations of the County with
an annual budget in excess of $50,000, and may review any other government
operation, said review to be conducted at a public hearing.
That at such review hearing the individual or agency responsible
for operation of the program shall have the burden of proving the public need
for the progran's continued existence.
That at such review hearing the Board of County Commissioners shall
receive testimony from all interested persons.
That in determining whether the program fulfills a public need,
and is deserving of continued existence, the Board of County Commissioners
shall take into consideration the following factors, among others:
(1) the extent to which affirmative action requirements have been
complied with by the agency responsible for operation of the
program;
(2) the extent to which the program has operated in a most efficient
manner;
(3} the extent to which members of the public affected by the
program are satisfied with the operation of the program and
with the responsiveness of County government personnel to the
public. The program or department shall keep a record of, and
summarize for the Board, comments and criticisms by the public,
as well as the program's or department's responses to them.
(4) The extent to which members of the public at large have been
encouraged to participate in making rules, and arriving at
decisions, as opposed to participation solely by the public
affected.
(5} The extent to which changes in County law or organization are
necessary for the program to operate successfully.
That, upon receiving the above information, the Board of County
Commissioners shall take the appropriate action to terminate, continue, modify,
or re-establish the program or agency under review.
That, in the event of termination, each agency or program shall be
accorded at least 30 days for the purpose of winding up its affairs, and
after this 30 day period, or whatever greater period is established by the
Board of County Commissioners, said agency or program shall cease all activities.
