Reimbursement for Tax Certificate Error
WHEREAS, the Pitkin County Treasurer's Office has written two
Certificates of Taxes Paid dated August 9, 1974 and September 6, 1974, Certi-
ficates 8372 and 8455 respectively on the attached metes and bounds descriptions;
and
WHEREAS, said Certificates show only Tax Sale Certificate of Pur-
chase #48, but should have shown both #48 and #46 Tax Sale Certificates on said
parcels and subsequent taxes paid by the certificate holder, Mr. Thomas U.
Cummins, the certificate against the property being sold at the annual tax
sale held on December 3, 1973; and
WHEREAS, due to a clerical error made in the Pitkin County Treasurer's
Office in the amount of $407.98 on August 9, 1974, on Certificate of Taxes Paid
8372, which will result in a loss of $403.98 (the $4.00 being automatic redemp-
tion and recording fees) to Mr. Thomas V. Cummins, unless a check in the amount
of $407.98 is issued to the Treasurer's Office; and
WHEREAS, 39-10-115 C.R.S. 1973 states that any loss resulting to any
person from an error in a Tax Certificate issued by the Treasurer shall be paid
by the County represented by the Treasurer issuing such Certificate.
NOW, THEREFORE BE IT RESOLVED that a check in the amount of $407.98,
the amount necessary for Charles W. Aikins, Jr. to redeem this property through
April, 1976, be issued to Charles W. Aikins, Jr.
