This County will make the program of administration, identification and regulation of appropriate matters of state interest a part of this County's compre- hensive planning program. 2. This County will meet and continue to pursue standards established by the Department of Local Affairs relative to scope, detail and accuracy and compara- bility and to meet deadlines in accordance with the work program. 3. This County will submit a detailed, updated work plan in compliance with the requirements of said letter indicating how financial and technical assistance will be used for identification and regulation of matters of state interest and of local interest within the territory of the county, including all municipalities. Department policies for 1976-77 will continue to place emphasis on city, county, regional cooperation and continue to emphasize close liaison between municipal and county work efforts. The Department continues to stress that the identification and regulation program be coordinated with comprehensive planning programs of local governments, and that identifi- cation information be included within local comprehensive plans. Revised Technical Bulletin No. 4 will again be used by the Department of Local Affairs as a guide in monitoring local work programs. Three changes from the 1975-76 work program are: • Work programs for 1976-77 may include areas and activities "of local interest" as described in the Long Appropriation Bi11 (see Appendix). • Requests for supplemental funds should be included within the work program and not as a separate request and review process. • Comprehensive planning programs should include all local, state and Federal planning activities and funding. To be eligible for continued participation, a county must have ADOPTED by June 30, 1976, acceptable regulations in each of the four areas per- taining to flood, geologic, wildfire hazards and mineral resources, except where these were determined to be inappropriate by the Department of Local Affairs. Each county must submit a resolution indicating its desire to continue activities under House Bill 1041 (see enclosed sample resolution). The 1975-76 work plan should be modified to include 1976-77 work activities in accordance with this letter. Work programs should be submitted by October 8, 1976. Each county will receive a base grant of $26,750 in . two phases as follows: $6,750 upon receipt by the Department of Local Affairs of an acceptable county resolution indicating agreement of the county to continue participation in the House Bill 1041 program. APPENDIX A 1313 Sherman Street, Room 51$ Denver, Colorado 80203 (303) 892-2771 County Commissione~~ July 29, 1976 Page 2 $20,000 upon receipt by the Department of Local Affairs of an acceptable updated work plan outlining county House Bill 1041 program activities, and an overall planning program indicating how these House Bill 1041 activities are to be integrated into the county's comprehensive planning process. Counties that have adopted temporary regulations will not receive either phase of the grant until they have adopted acceptable permanent regulations for the four areas. Use of Base Funding and Budget It should be understood that moneys received under House Bill 1041 may not be used simply for ordinary administrative expenses by local govern- ments. The basic appropriation can be utilized for: • Salaries of personnel directly involved with the performance of House Bill 1041 activities (only for time expended on 1041 activities). • Day-to-day office and operating expenses for House Bill 1041 purposes. • Basic capital outlays should have been met in the 1974-76 period. Additional capital expenditures must be included for review and approval in the 1976-77 budget prepared for the Department of Local Affairs. • Travel should not exceed five percent of the basic grant for House Bill 1041 efforts. • For the identification/regulation program of the county and municipalities, integration of the identification program with local planning programs and House Bill 1041 related comprehensive planning activities. This includes consulting arrangements with regions or other governmental entities, leading to implementation of the program. If any of the work program is to be performed through a contract, the proposed contract must be submitted to the Area Field Rep- resentative for approval by the Department of Local Affairs. A detailed budget based on local governmental budget laws must be sub- mitted in the updated work plan for the use of the base funding. The budget and work plan must specify whether the funds, or any portion of them, will be transmitted to a regional organization and whether funds will be used for county planning staff, municipal staff or consultant. APPENDIX A County Commissioners July 29, 1976 Page 3 Minimum Work Requirements for 1976-77 Each county must accomplish the following work as part of their 1976-77 program: A. Develop a comprehensive planning program that will include appropriate local, regional, state and federal planning activities in which the county is participating and funding which they are receiving. The program should demonstrate how requirements of the various programs have been integrated into their comprehensive planning process. This process should be based upon identified local needs, problems and priorities and will usually be a multi-year program. B. A work plan and budget for land use administration, identification and regulation of areas and activities of state interest or of local interest that is acceptable to the Department of Local Affairs. The work plan will establish which areas and activities of state interest or of local interest will be regulated and which other work elements will be completed by June 30, 1977. The plan will be developed and tasks determined in a cooperative effort between the county planner or land use administrator and the field representative. Final work plans and budgets must be approved by the Board of County Commissioners. Work plans should be received by the Department of Local Affairs by October 8, 1976. C. Request for supplemental funds. As in past years, both counties and municipalities are eligible for supplemental funds. Requests from counties should be included as part of their annual work plan rather than as a separate request and review process. Municipalities are urged to cooperate with counties in their supplemental funds program but may submit individual requests. An attached memorandum provides additional information and guidelines for supplemental fund requests. All requests should be received by the Department of Local Affairs by October 8, 1976, to allow prompt review and approval of fund requests. The Department may require submission of one copy of maps, resolutions or other documents of completed work elements for 1975-76 and for 1976-77. The House Bill 1041 Field Representative assigned to your county under the Department of Local ~ffairs will be available for your assistance.
