You are responsible for the information contained in the attached EarthmovingPermit
Requirements handout.
State law (Senate Bill 93-155) requires that you contact the Utility Notification Center of
Colorado at (809)922-1987 before commenting any earthmoving.
1~f5Y~.e.- Work in a wetlands area is generally prohibited; however, some activities are permitted. Any
work ocurring in a wetlands area. requires a permit from the Army Corps of Engineers. If you are
/ working in a wetlands area, please call the Corps at (303}Zg3-1199.
rd' You will be required to post a bond with the Building Department for revegetation if your
project:

b) Has a potential for visual impacts from public viewing corridors (roads; rnunty
..parks, traiIs);
c) Has steep (15°l0 or greater) slopes or unstable soils;

EARTHMOVING PEPI?IT REQUIRE.`ti.NTS
1.01 General
1.01.01 Purpose. The purpose of thesz requirements is to
establish engineering, inspection and permitting
policies by which excavation, grading or fill
procedures (hereinafter referred to as
"Earthmoving")..may be properly controlled.
1.01.02 Permits Recuired. No person shill begin
earthmovirg work, except as specifically exempted
herein, withcut first obtaining a Earthmoving
permif from t'~e County. A separate permit will be
required for each site or parcel cf land. A
permit w=11 not be required for tae following:
a.
Excavations less than 4 feet in depth
and fills less than 4 feet in height
whic?^. are not intended to support
structures; do not exceed 50 cubic yards
cn any ore_lot, parcel cr property, and
do nc~ obstruct a drainage course.
b. Excavaticns 'fcr basements, footings,
retaining walls, or ether structures
authcrized by a valid Buildinc Permit,
This shall not exempt ary fill or
excavaticn having an unsupported height
greater thari 4 feet after the completion
cf said structures.
c. Cemeteries, mining, cuarrying,
excavating, prccessinc, and stcckailing
of rock, sand, gravel, aggregate, or
clay commercially where established and
provided for by law, including but pat
li:~ited to the Pitkin County Land Use
Code, given that such operations do not
affect lateral support or unduly
increase the stresses in or pressure
upon 'any adjacent or contiguous
property.
d. Puhlic works construction, provided that ,
the. public entity conducting the work
submits a plan to the County designating'-
earthmoving-sites (cuts and fills), and
that the earthmoving sites. have received
zny other permits required by other
jurisdictions or agencies (see paragraph
1
l.oz.o3b).
e. Excavated materials taken directly to
the County landfill or other fill
receiving area foraally designated by
the County.
1.01.03 Hazardous or Harmful Conditicns. Wherever any
existing excavation, embanlcient or .fill has become
a hazard to public safety or welfare, or endangers
property, or adversely affects the safety, use or
stability cf a public way or drainage channel, the
owner of the prcperty upon which the excavation is
located, or other person or agent in control of
said property, upon receipt of written notice from
the County shall, within the pericd specified
therein, repair er eliminate such excavation, fill
or erban!c3ent so as to erases the hazard' aid be in
conformance with the require*~ents. contained
herein.
1.01.04 Enforcement. Recuirer:~ents contained herein may be
enforced by the authorized representative of the
County, or by injunctions resulting in work
steonace issued by the District Ccurt in and for
the County of Pitkin, Stag of COlOradC, PurSUant
tc law, or suit may be commenced by the County
Attorney on behalf of the Bcard of County
Commissicners for damages or hazardous or harmful
conditions due to non-compliance.
1.01.05 Definitions.
a. County: The County Representative or any
one of his authorized agents.
b. Develon.er:... - Individual -. conducting
earthmoving work under an approved
Earthmovirg Permit.
c. Earthmovinc. Any excavating, filling or
combination thereof.
d. Existira Grade: Vertical location of the
existing ground surface prior to excavation
or filling.
e. Fi11: Deposits of soil, rock, or other'•
materials placed by man.
f. Finish Grades. The final grade or
elevation of a fill or excavation.

- g. Site: Any' lot or parcel of land or
contigucus combination thereof.
1.0'2 Permit Requirements. To receive a permit, each applicant is
required to submit a permit .application form and any
associated plans cr specifications required by the County.
The applicant is advised to meet with County zoning and
engineering staff membzrs prior to application submission to
insure that the site is compatible with applicable land use
or development policies (i`.e. scenic impacts, 1041 hazards,
subdivision modifications).
1.02:01 Plans anc Specifications. When required by the
permit application, two sets of plans and
specifications ` shall be s•,~mtted for revie:a by
the County. These plans and specifications shall
be prepared and s=fined by a qualified Civil
Engineer duly licensed by the State of Colorado
and shall show the .following:
a. Location may.

c. Land description and name and address of

d. Location: of all buildings, structures,

1.02.02 Supplemental Reports. Supplemental re_corts and
data (geology, soils, etc.) may also be recuired.
Supplemental repots are to be prepared by
qualified geolcgists or professional engineers.
Recommendaticns included in such reaorts as
approved by the Ccurty shall be incorporated into
the earthmcving plan.
1.02.03 Permit Limitaticns and Conditions.
a. General. The issuance of a permit shall
ccrstitute an aut.<orization for only
that wcrk (ro more ar no less) which is
described or illustrated on the approved
.plan or application for the permit. The
securemert cf other recuired permits by
the deve_oper shall not relieve it of
the responsibility for securing an

c. Time Limits. All of the worst authorized
by the permit shall be fully performed
and completed within the time limit
specified. If no time limit is
specified, tre wcrk shall be completed
within 18o days after the date the
permit is issued. Zf the work cannot_be
perfcrmed and completed within the
specified time, a recuest for an
extension of time setting forth the
reasons for the requested extension
shall be presented in writing for review
and approval by the County.
d.
Precautions. All perscr.s performing any
earthmoving operations shall put into
effect all necessary precautions such as
removing all loose dirt form ,the
earthmoving site, providing adequate
anti-erosion and/or drainage devices, '~
debris basins, or other safety devices
to protect the health and welfare of
persons or private and public property
from damage of any kind.

e. Liability, Neither the issuance of a
_ permit nor compliance with the
provisions hereof or with any conditions
imposed in the pernit issued hereunder
shall relieve the developer from the
full responsibility for any damage
whatsoe<rer to other persons or property,
nor impese any liability upon any
official, appointee,' or employee of
Pit.'cin County for damage to persons or
.property....

Denial of Pe~--,a~ t, A permit will not be issued in
any czsz where the work as proposzd by the
applicant will not comply to the requirements
contained hereih, or if the proposed work is not
consistent with land use cr development policies
currently 'adopted by the County. If it can be
shown to the satisfaction of the County that
compliance to recuirements can be attained by the
construction of___retai_*~ing .st_nYcturzs, drainage
devices or by other means the permit may be
issued with the condition that such werk be
performed.
The developer has the right to-appeal any decisior.
made by the County concerning the approval er
denial of the permit. Any appeal must ~e made tc
the County no Later than teh (l0} calendar days
after approval cr denial. of the perait. The
Ccuhty will respond to the appeal in a timely
manner. Ali decisions made within the response
are final..

permits issued hereunder shall be presumed to
include the_ provision that the applicant, his
agent, contractors or'emjsloye~s;;°s3~~11 carry='oIIt
the proposed work in accordance with the approved
plans and specifications and in compliance with
all apnl.icable requirements. If it is determined
by the County that the conditions present do not
confe±-a te~t-*~e~~ _ crated in the permit or on the
approved plans, work may be `stopped until approval
is'obtained for a revised earthmoving plan which
will conform to the existing conditions. All I
modifications of the approved earthmpving plans,'
must be approved by the County in writing. '
Modifications which affect basic tract design or
land use must first be reviewed and approved by
the County Planning Office or Commission, as

applicable, in accordance with the Subdivision°
Final Plat Review Procedure.
1.02.06 Authorization. The develcper shall, at the
recuest of the County, subriit procf that it has
authority or permission to conduct earthmoving
wor'.{ on the site(s) proposed. This documentation
shall be submitted with the application for
permit.
2.02.06 Protection of Utilities. During earthmoving
operations, the developer shall be respcnsible for
the prevention of damage to public or private
utilities or services. This responsibility is not
confined to the linits of the earthmoving. --
1.02.07 Protection of Adjacent Pro~ertv. The developer is
responsible for the prevehtion of damage to
adjacent prenerty, and no person shall excavate or
fill on land sufficiently clcse to the property
lire .to e^.dancer ,any adjoining public street or
zny. adjacent property. .Such property shall be
supported and protected from settling, cracking,
or other damage which might result.
1.03 Fees and Bords.
1.03.01 Plan Checking Fee. For earthmoving on the same
site, the £ee shall be based on the .total
excavation and fill quantities. Before a permit
is issued for earthmoving, a fee must be paid as
follows:

1.03.02 Berds and Other Securities. Bcnds, letters of
credit, or other financial assurances will be
recuire3 for all earthmoving in excess of 1,000
cubic yards or where, in the opinion of the
County, it would be necessary to guarantee
' enforcement o£ applicable requirements, including '~
landscaping or earthmoving on steep slopes.
Payment and Performance Bond, letter of credit or !-
cash payment for an amount set by the County shall
be provided and secured unto the County, and, if
the work authorized by the permit is not completed
as herein specified, any bands shall be in default
and the County shall recover them provided notice
of norcompliarce is given in writing to t:~e
developer by the County. The surety executing
such bcrd or deposit shill continue to be f i rmly
bound u.:.der a continuing obligation far the
payment of ali necessa`^~ costs znd excens2s that
may be incurred or erended by Pitkin County in
causing any unsatisfactory work to be"carrected or
any unfinished work to be completed." In the event
of default, the County shall have the right to go
onto the premises to perform the required work.
Ir. the case of a cash deposit, said deposit or any
unused portion. thereof shall be refunded. Other
securities, such as cash payment or letters of
credit, s:~ali be approved by'the County Attorneys
Office prior to permit issuance.
1.04 Standards..
1.04.01 Cuts. Cut slopes shall rot be steeper than 1-1/2
horizontal to 1 vertical unless approved by the
County,' whb may require that the developer furnish
a cua~ified ergineer's or geologist's report

specifications. Flatter slopes may be required if
needed for stability and-safety.
Cut slopes exceeding 40-feet in vertical height
measured £rcm the lower toe of the slope shall be
terraced. Drainace terraces are to be a minimum
cf 6 feet wide and 1 fcet deep, and slcoed at a
minimum of 4~.in the dir=_cton bf flow. 'Terraces
s;:al1 be cut every 30 feet vertically, except that
where' only one terrace is required it shall be
approximately mid-height.
1.04.02 Fills. Fill slopes shall not be steeper than 1-
1/2 horizontal-to l vertical unless approved by
the County, who mzy require the developer to
furnish a qualified engineer's or geologist's
report certifying that the site has been
investicated and indicating that the .proposed
deviation will fulfill the intent of these
scecifications.` Flatter slopes may be required if
needed for stability and safety. All fills shall
be compacted to a minimum of 90% of
density as per the latest max'mum`~
ASTM or A.ASHO test
methods.

The natural ground surface shall be prepared to
receive fill by removing vegetation, unsuitable
top soil, and, where existing slopes are steeper
than 5 horizontal to 1 vertical, by benching at
least 5 feet into the natural slope. no organic
material, rock, or similar irreducible material
with a maximum diameter as shown in the following
table shall be buried or placed in fills.'

Exposed fill slopes in excess of. 40 feet in
height, measured from the, lower toe of a slope,
shall have paved drainace terraces spaced acid

1.04.03 Setbacks. Toes and tops of cuts and fills- shall
be set back from property lines and buildings in
accordance with the following figure:

for complete revegetation of the earthmoving site.

Thank you for your. letter of October 13; 1993 relating to your
plans for a bike/pedestrian trail along State Highway 82 east of
Aspen.
The Colorado Department of Transportation (CDOT) is supportive
of this project in the interest of bicycle and pedestrian safety.
We will cooperate with your proposal to locate the path within the
highway right of way providing that you obtain the necessary
permits from other concerned government agencies and coordinate
prior to beginning any work with Mr. Wayne." Lupton, Senior
Maintenance Supervisor, CDOT, at 945-3840.
At present, we have no budgeted funds available for widening the
State Highway 82 roadway or for reimbursement of work done by
others.
I would suggest that you continue your support of this plan with
your Pitkin County Commissioners 'and continue to seek funding under
the Enhancement program. The Intermountain Transportation Planning
Region, which includes Pitkin County, will be se£ting priorities in
March, 1994 for projects to be funded by the Enhancement program in
fiscalyears 1995, 1996 and 1997.
I wish you well in your efforts to advance this plan, which is
certainly in our mutual interest.

_ This is in regard to the proposed trail alignments east of
town-- specifically, the section between Stillwater and the.
Preserve Bridges, and "the section through North Star Nature
.Preserve. In the former, I believe the most zeceht alignment
(flagged hot pink) avoids, to the maximum extent possible,
riparian and wetland impacts and therefore impacts the. Roaring
Fork minimally. This is, of course, with the understanding that
the trail will leave the river at Stillwater Bridge and connect
with the present trail adjacent to Highway 82 (looking
downstream).
Similarly, the alignment through North Star has. been sited to
avoid to the maximum extent practicable any wetland, riparian or
stream impacts. I've discussed the issue of interference with
deer and elk migration with Randy Cote, and we botK feel that any
impact would likely be insignificant.
We appreciate the opportunity to comment, and further greatly
appreciate the cooperation you have given.

1. Before a federal licensee or permittee commences any project in a watercourse,
which project may adversely affect water quality, it shall notify, at least fifteen days
prior to commencing work, the following:
A. Applicable local health department;
B. Owners or operators of municipal and domestic water supply intakes, which
are located within twenty miles downstream from the site of the project; and
C. Owners or operators of other intakes or diversions which are located within
five miles downstream from the site of the project.
2. Construction operations in watercourses and water bodies shall be restricted to
areas specified in the. appiicatidn fdr the federaj lice^se or' perrnd.
3. Permanent erosion and sediment control measures shall be installed at the earliest
practicable time consistent with good cdristruction' practices and shall be
maintained as necessary throughout the operation of the project. One of the first
construction activities shall be the plademenTofpermaherit and temporary erosion
and sediment control measures around the perimeter of the project of the initial
work areas to protect the, project water resources.
4. Temporary erosion and sediment control measures shall be coordinated with
permanent measures to assure economical, effective, and continuous control
throughout the construction phase.. and during the operation of the project.
5. Work should be carried out„diligehtly and completed as soon as possible.
6. The use of chemicals such as soil stabilizers, dust palliatives, sterilants, growth

inhibitdrs, fertilizers, deicing salts, etc., during construction and operation should
be limited to the best estimate of optimum application .rates. All reasonable
measures shall be taken to avoid excess application and introduction of chemicals
into the waters.
7. Measures shall be taken to preveht spilled fuels, lubricants, or other toxic materials
.from entering the vvatercou~se.
8. Whenever practicable, discharges of dredged or fill materials shall. bg conducted
during low flow periods, during periods when spawning is not occurring and during
periods when recreational use is relatively low. If such discharges will occur when
water temperatures arenear freezing and where a domestic water supply diversion
is located. within twenty miles downstream, the permittee shall coordinate with the
water purveyor in order to minimize impacts oh treated water quality.

9. Solids, sludges, dredged, stockpiled di` othar rridterials which are potential sources
of toxic pollutants, shall be controlled ih a manner so as to prevent such materials
from entering water oourses. Materials which are not a pdtential source of toxic
pollutants shalt be disposed or controlled in a mariner reasonably designed to
prevent them from entering water courses.
10. Upon discovery of solids, sludges, dredged or stockpiled materials, or other
potential sources of pollutants entering a watercourse, the licensee or permittee
shall immediately make every reasonable effort. to notify:
A. Applicable bcai health departments and the Colorado Department of Health;
B. Owners or operators of municipal and domestic_water supply intakes which
are located withih twenty miles downstream from the site bf the. project; and
C. Owners or operators of other intakes or diversions which are located within
five miles downstream from the. site of the project.
11. Measures shall be taken to prevent the entrance of wet concrete .into .the
watercourse when placed in forms and/or from washing of trucks.
12. Fill materials shall be clean as practicable.
13. Structural fill or bank protection shall. consist, of materials, which are placed and
maintained so as to withstand. predictable .high flows in the watercourse.
Hazardous areas should be clearly marked. or made. inaccessible to the. public.
14. Concrete slabs which may be unstable are not authorized for use as riprap.
Broken concrete chunks are. authorized but shall, be free, of protruding reinforcing
materials.
15. Areas. disturbed py a project and which. are suitable for vegetation shall be seeded
or revegetated to prevent subsequent soil erosion..

ACTIVITY
Pitkin County Open Space and Trails proposes to build a native surface trail 20 feet wide.
The following three alternatives were analyzed for the trail locations:
1. Adjacent to the Roaring Fork River.
2: Midway between the Roaring Fork River and Highway 82.
3. Adjacent to Highway_82.
Alternative 3 was chosen because it had the least impact on wetlands, riparian areas,
wildlife,'. waterfowl and. the Roaring Fork River. The total disturbance to wetlands from
construction of the proposed trail is estimated at 28,220 square feet (0.65 acre). There
will be four wetland crossings for a total distance of .164 feet, resulting in 3,280 square
feet of disturbed wetlands. Encroachment into wetlands from the edge of pavement of
Highway 82, shown on Table 1, results in a disturbance of 24,940 square feet of wetlands
for a total impact of 28,220. square feet (0.65 acre) to jurisdictional wetlands.
To further reduce impacts to wetlands, wood. or rock retaining walls will be used. This
.will result in a maximum width of disturbed areas of 26 feet. Ih areas where wetlands are
encountered, the trail will be within 10 feet`of the edge of pavement of Highway 82. This
is acceptable with the Highway Department as long as some form of separation is placed
between the trail and the. road (conversation between Mark Fuller and CDOH). Figure
1 shows several typical cross-sections encountered along fhe trail

the Preserve Subdivision Bridge will be avoided by setting the trail back from this

The U.S: Fish & Wildlife Service and the State Historical Preservation Office have been
contacted as per Section 5-1 and 5-1f of the notification requirements. In addition to these
agencies, Randy Cote, Division of Wildlife, and Tom Cardamone, Aspen Center for
Environmental Studies, were also contacted regarding any federally listed endangered
or threatened species or critical habitat iri the proposed area of bike. trail construction.
Jim Green of the SHIPO office (866-4674) was contacted regarding the proposed bicycle
trail. Jim responded on August 5th that they had no recorded historical sites within the

Jim was contacted again in January, 1994, regarding the section of trail moved from the
edge of the river to the area adjacent to Highway 82. He responded that they had no
record of historical sites within that area.
The Division of Wildlife and the Aspen Center for Environmental Studies both responded
that they were not aware of any federally listed endangered or threatened species or
critical habitat in the proposed bike trail alignment.
PURPOSE
The trail is designed to provide a safe route adjacent to Highway 82 for recreational
users.
DISCHARGE OF FILL MATERIAL
Total fill required for trail construction is estimated at 1,281 cubic yards. Fill material will
consist of native material, road base, and cobbles. Retaining structures will be concrete,
wood or rock. An additional 15 cubic yards of fill consisting of cobbles will be used for
the loose rock check dams proposed for mitigation (refer to Table 1).
PROPOSED MITIGATION
To mitigate the 0.65 acre of wetlands disturbed adjacent to Highway 82, an equivalent
,acreage will be created adjacent to a perennial tributary to the Roaring Fork River. The
tributary is located in the Northstar Nature Preserve and is down cut to a point where
there are no wetlands adjacent to it. A series of loose rock check dams will be installed

in the creek between Highway 82 and the Roaring Fork River. Specifications are included
in Appendix A. The objective of the loose rock check dam installation will be to back up
surface and groundwater, saturating adjacent upland areas. One hundred fifty 6" clumps
of Carex will be planted to encourage establishment of wetlands. To improve the riparian
habitat lost through grazing and hay cutting, willows will also. be planted in areas
identified on the mitigation map. Three methods of willow planting will be used, willow
staking, willow wattling and transplanting of large clumps of willows. A total of 500 willow..
stakes will be planted, 7 clumps of willow transplanted by backhoe and 50 feet of willow
wattling on a reshaped section of the Roaring Fork River (specifications for planting are
included in Appendix A).
MONITORING
The applicant assumes full responsibility for implementing the recommendations
contained in this report and assuring that the created wetlands and riparian areas. are
similar to existing site conditions. Pitkin County will hire Earth Resource Investigations,
Inc. to supervise the restoration work and prepare the required annual monitoring report
to be submitted to the Corps of Engineers outlining the progress on the created wetlands
plant survival. The report will include the procedures implemented and photographs
taken .from set photo points. The. applicant agrees to perform any additional. work as
deemed necessary by the COE to fulfill mitigation requirements. Photographs will be
taken during the month of August for three consecutive years following the issuance of
the permit. The annual mohitoring report will be submitted to the COE by January 15th.

PROJECT DESCRIPTION..
Pitkin County Open Space and Trails is proposing to construct a new section of trail
starting at the end of the: existing bike trail and extending to the upper end of the
Northstar Nature Preserve. The exact location is identified on the attached fold-out map.
Critical areas of jurisdictional wetlands and riparian habitat, identffied, have been. avoided
and the. trail relocated adjacent to Highway 82.
WETLAND DELINEATION::. .
Wetlands and waters of the U.S. were delineated on July 15th, 18th, October 2nd, and
November 8, 1993, using-the routine on-site determination method as described iri the
1987 Federal Manual for Identifying and Delineating Jurisdictional Wetlands. Twenty-two
representative sites were sampled for the presence of wetland soils, vegetation, and
hydrology (see Appendix B).
SOILS
There are two soil mapping units within the area of the proposed bicycle trail, the mine
loam and the redrob loam. The soils have been mapped by the Soil Conservation
Service as a part df their nationwide soil survey program. Of the two mapping units, only
the redrob contains hydric inclusions:
The mine loam is a deep, well-drained soil found` on fans and valley side slopes. It is
formed irr moderately coarse textured alluvium and colluvium derived predominantly from
metaphoric rocks. However, on this site it is derived from granitic parent material. Runoff

is medium and the hazard of water erosiori is moderate. The site is well suited for wildlife
habitat.

The redrob loam is a deep, somewhat poorly drained soil, found on alluvial valley floors,
low terraces and flood plains. It is formed in mixed alluvium derived predominantly from
sandstone and shale and again on this site, it'is derived from granitic parent material
Runoff is slow and the hazard of water erosion is slight or moderate on the steeper
slopes. Due to the granitic origin of both soils, I would suspect that the erosion hazard
is in the moderate to high range on steeper slopes based on the parent material as
compared with the SCS rating. which js based on a metaphoric sandstone antl shale
parent material. This would indicate that care should be taken during` the construction
of the tail to avoid any erosion problems which might discharge sediment into the
Roaring Fork River. Table f is a summary of soil observations at the twenty-two test pits:
VEGETATION
Vegetation types ranged from wet meadow and emergent wetlands in the Northstar
Nature Preserve to scrub-shrub and forested wetlands,adjacent to the Roaring Fork River
between the Benedict property and the Preserye Subdivision bridge. There is a transition
from wetlands to swell-defined strip of riparian vegetation and then to upland vegetation
on portions. of the. trail Riparian vegetation is missing in much. of the Northstar Nature
Preserve due to past grazing and haying practices.

wetland determination:
HYDROLOGY
The Roaring Fork River on the north portion of the area delineated is relatively stable due
to moderate entrenchment and significant riparian vegetation along the banks. The river
along the southern portion of the mapping area is less stable where it changes to a flatter
gradient, and bank material changes from a substrate with a high percentage of rock to
a predominantly sand/silt substrate.
Groundwater was looked at on July 7th which was several days after`the peak of the
runoff on the Roaring Fork River. It is estimated that the peak was 7 to 8 inches above
what the level of the riverwas on"the day that groundwater was looked at. From this
information, an estimate was made and the groundwater was projected at a higher level
to simulate the hydrology during the peak of the. runoff period to determine if the
hydrology criteria was met for jurisdictional, wetlands. The depth of the various test pits
were primarily dependent upon the amount of rock found within the site.. An attempt was
made to dig of least 24 inches at each location, particularly those where the soils and
vegetation met the criteria.
Hydrology of the wetlands in the Northstar Nature Preserve and Preserve Subdivision is
dependent on the elevation of the~f~oa"ring f=ork River during periods of high runoff and
throughout much of the summer. There is also significant influence from adjacent areas
during other times of the year, keeping groundwater levels higher in wetlands uphill from
the Roaring Fork River.
Hydrology of the wetlands and riparian areas adjacent to the Roaring Fork River in the
vicinity of the Benedict. Percel is dependent on the river elevation as well, as seepage from
the Nellie Bird ditch, which runs year round. This abundant. source. of water has, given
rise to exceptionally high quality wetland and riparian habitat in this area. The rail has
been relocated to avoid this area and protect this important wildlife habitat.
The Nellie Bird Ditch carries approximately three cubic feet per second of flow on a year-'
round basis. Historically, the ditch only ran during the summer time during the irrigation
system. It now runs year-round to provide water to Stillwater Pond on the Benedict
property. Seepage from the ditch enhances the.,. riparian and wetland vegetation and
hydrology found in this location. There_s some. evidence of erosion from past
overtopping of the ditch along this area.
CONCLUSION
The mapping between the Benedict property and the Northstar Bridge was field checked
by Mike Claffey. Alan Czenkusch of the Division of Wildlife and Michelle Carlne from
Pitkin County were also present during our site visit. After walking the proposed trail
alignment, the group felt there were a significant impact to wetlands. end. riparian areas
as well as wildlife habitat. The trail was relocated to the,area,identified_on the attached
map to avoid these sensitive areas. The trail through the Northstar Nature Preserve was
.also relocatedaway from the Roaring Fork River to an area adjacent to Highway 82 in
efforts to avoid wetland impacts.

APPENDIX A
MITIGATION SPECIFICATIONS
Specifications
Draa Structures
The loose rock check dams will,_be cpnstructed frarn`well
graded rack ranging in size from 2-$ inches. Spillway height
will be l to 1.5 feet above the bottom of the channel with
the sides-sloping up to the top of the bank at, the point
where ib is keyed in. Dams wilt be spaced-50-?5 feet apart,
based on the "heel to Toe" concept. That is, water backed up
from the initial dam should reach the toe of the-next dam
upstream.
Rock check dams can be brake into 3 distinct parts: 1, dam
proper, 2, key and 3, apron (see figure 5i, The key should
be approximately ! foot deep by ~ feet wide, extending 3
feet Into the bank.. It i hecommerded that 80i: of the rock
making up the key be less than 5 inches in diameter to avoid
undermining. The dam proper should be-keyed into the banks 3
feet and slope doaJn to 1.5 tc, 2 feet above the channel
botforn at the spillway, Aprons are an"extension of the dam
on. the downstream side. The apron should be excavated to a
depth of .8 feet-and should extend appraximateTY 3 feet
ddvJnstr•eam of .the dam.
After excavation of the key and apron, filter cloth is Laid
across the trench and rock placed over it. Enough cloth is
used to extend the cloth up the downstream side of the check
dam. More rack is then placed offer the cloth to build-the
dam to a height of l to 1.5 feet.
Bank ReshaPino far Willow Wattllho
Bahks on the inside of the meahder will be laid back to a
2:l slope of flatter, starting at an elevation approximately
3 feet above the bottom of the channel. Banks on the outside
of the meander will only be laid back in areas where no
riparian vegetation exists, Slopes will be laid back td a
1:1 on these areas.
Willow Wattlino
Bundles shall be prepared from live, shrubby Salix sp.
Cwilldw). Wattling bundles may vary"'ih length, depending on
materials available. ThE bundles shall taper at the ends an d°
shall be 1 to i 1/2 feet longer than the average `length of
stems to achieve this taper. The butts of the branches shall
not be more than 1 1/2 inches in diameter.
The bundles shall be tied on IS inch centers with a minimum
of tG10 turaps of binder twine at each. point. The bundles
shall be wrappEd tightly to an average diameter of 8 inches.

The bundles shall be prepared not. more than five days in
advance of placement. They should be stored in the shade and
sprinkled as often as needed to be kept moist.
The bundles shall be laid in a trench dug to 11~ the

Cuttings shall be prepared no longer than one week before
planting and shall be m.:intained in moist conditions. Stakes
may be stored in water filled buckets placed in the shade or
in udet burlap under refrigerafion C32 to 45 Gegrees F).
Cuttings shall be kept moist during planting.
Planting of Willow Stakes
Cuttings may be pushed into ground that is soft. Holes on
compacted soils shall be created with rzbar or similar
devices to avoid damage to Gark. Cuttings shall be plahted
so that appror.imately 2;'3 to 3:'4 of the stake is buried. Two
to three inches shall remain above the ground level. The
soil around the cuttings shall be firmly tamped. No air
pockets or voids =__hali remain around the cuttings. The base
of the cutting must intersect groundwater br saturated soil.
Tran planting of Riparian Vegetation
Clumps of narro4oleaf cottonwoods and willows can be
transplanted from areas of dense riparian vegetation with a
front- end loader or backhoe. Care should be taken to remove

the entire root mass. Transplanting shall be completed
before F,ugust IS to a1Tow sufficient time for establishment
.and growth. Pads of vegetation should be removed and
transplanted as rapidly as possible. Stockpiling shall be

removal, and moisture shall be maintained during this

Six inch square clumps of Carex Sp, car, be transplanted from
areas of dense vec~etaticn by hand. Care should he taKen to
remove enough rcpt mass to insure survival of the plants.
Pads of vegetation should be rembved and transplanted as
rapidly as possible. Stockpiling shall 6e minimized.
Soils shall be`mc,ist but nct saturat4ed at the time of pad
removal, and moisture shall be maintained during this
procedure to avoid drying and injury to plants. Ammonium
phosphate fertilizer ?Y6-20-0 + sulphur) shalt be top-

Plantin^ Time
Late fall or early spring after snow leaves the. site. Summer
plantings wilt require supplemental irrigation.
Seedbed Preparation
Proper seedbed preparation is essential to the survival of
grasses. 'The top four to six ifiches should be }filled,
leaving a friable, mai=_.t surface for seeding... This can be
accomplished by a small cat with rippers, a tractor pulling
a harrow, a rototiller, or suitable approved equipment.
Seeding of Perennial Native Gra ses
Seed should be broadcast uniformly at the rate of fifty 16s.
per acre. Immediately after seeding, the seed should be
covered with 1/2 inch of mineral sail. Seed can be raked in

The perennial grasses are slow graving the-first year of

BMP35 ROCK RETAINING WALL
Definition
A rock retaining wall is a low wall constructed with irregu-
larly shaped rock stacked at the toe of an oversteepened
slope. Commonly referred to as rock breastwalls, gravity
walls, or toe walls.
Purpose
To stabilize a slope against mass-movement, to protect the
toe or face of a slope against scour and erosion by storm
runoff, and to allow flattening above for revegetatioh
purposes.
Applicability
Applicable to cut or fill slopes which are steeper than 2:1
and cannot be regraded to achieve this gradient. Retaining
structures are usually located between the bas e. of a slope
and an adjacent roadway or driveway.
Advantages
1. Prevent slope failures.
2. If properly installed, retaining structures can prevent
sediment from entering the storm drain system.
3. Allows flattening of the slope above the retaining.
structure which enables the establishment of revege-
tation.
Disadvantages
1. Structures may fail if not properly designed, in-
stalled, and maintained.
2. Structures can be damaged by snow removal equipment
when located close to rights-of-way.
Planning Criteria
Rock retaining walls can be considered as a type of gravity
wall. Gravity walls resist earth pressure by their weight
or mass. They are installed on firm ground and placed
against a slope with only a small amount of fill behind

them. Rock walls are not intended to resist large lateral
earth pressures, thus, they behave more like a revetment
than a retaining wall. Rock walls can be quite porous and
as a result, provide interspaces which can be planted.- Rock
walls are normally 3 to 4 feet .high and are usually built
from rock 10 inches to 3 feet in diameter. The rocks should
be laid on a firm foundation of undisturbed or compacted
soil. The rock wall can be topped off with a sloping bench.
This bench provides a transition slope which can be revege-
tated afterwards. The backfill behind the wall should be
well tamped.
Installation
1. Remove all large rocks from the slope face and stock-
pile on-site.
2. Excavate a footing trench along the toe of the slope
and stockpile material for fill behind the rocks.
3. The footing trench shall not be located such that it
reduces an adjacent road right-of-way to less than the
standards of the agency with jurisdiction over the
road.
4. Place the largest boulders in the base course with
their longitudinal axis into the slope face.
5. The rocks shall be laid with at least a three-point
bearing on the. footing trench or on previously laid
rocks.
6. The rocks shall be placed such that their centers of
gravity are as low as possible, with the bedding planes
sloping inward toward the slope toe.
7. AS the rocks are placed, fill material shall be added
around and behind the rocks and tamped thoroughly.
8. The rock wall should be constructed such that the
external face is inclined slightly (6:l batter angle).
Battering shifts the center of gravity awa7 from the
toe, into the slope, and increases the resisting
movement against overturning.
9. When a rock wall is constructed adjacent to a paved
.surface, a stabilized drainage system shall be placed
at the outside toe of the rock wall. The runoff must
be conveyed to a stabilizeddischarge areawthout
undercutting the rock wall.

10. If the roadway is to be paved after the rock wall
construction, 'pave up to base of the wall and provide a
curb or paved. Swale.
11. Revegetate the slope above the rock wall as soon as
possible. Rock riprap can'also be used to stabilize
theslope, butvegetation is the preferred practice.
Maintenance
Zf properly installed, rock retaining walls require little
maintenance. The walls should be inspected periodically for
damage caused by subsurface drainage, material sloughing, or
snow removal equipment. Repair as needed.
Effectiveness
Rock retaining walls are very effective in preventing soil
erosion from oversteepened slopes. They are most effective
when used in combination with vegetative practices. Rock
retaining walls are more"cost-effective 'than gabions, and
more aesthetically pleasing.

Definition
A wood retaining wall is a low wall of posts and planks.

or face of a slope against scour and erosion by storm
runoff, and to allow flattening above for revegetation
purposes.
Applicability
Applicable to slopes which are steeper than 2e1 and cannot
be regraded to achieve this gradient. Wood retaining walls
are usually located between the base of a slope and an
adjacent roadway, driveway, or drainageway. A wood retain-
ing wall functions primarily by preventing sloughing off of
material into storm drain systems or stabilized roadside
drainageways.

Planning Criteria
Lumber, timber, and posts should be treated with an approved
wood preservative. The alignment of a wood .wall needs to be
straighter than that required for a rock wall. Some rough
grading may be required to provide an adequate alignment.

Installation
For a 3 foot high wood retaining wall, the following steps
can be used for installation:
1. Set 5 foot posts (6 in. x 6 in.) on 5 foot centers in a
concrete footing.
2. Install planking (3 in, x.12 in. or 2 ih. x 12 in.) on
theupslope`side of the posts.
3. Leave sufficient spacing to allow drainage at the base
of the wall and between planks.
4. Steel bolts and washers shall be used to secure plank-
ing to posts.. Bolts shall be galvanized or zinc-
coated.
5. Hackfill behind the wall with drain rock and cover with
soil from the slope above.
6. Revegetate the backfilled bench and slope behind the
wall as soon as possible.
7. Install subsurface drainage if needed.
Maintenance
If properly installed, wood retaining walls require little
maintenance. The walls should be inspected periodically for
- damage caused by subsurface drainage or snow removal equip-
ment. .Repair as needed.
Effectiveness
Wood retaining walls are effective in preventing soil
erosion from small, oversteepened slopes. They are most
effective when used in combination with vegetative prac-

Items of work to be performed in conformance with this specification are

a. Bid Item 11, Timber Retaining Walls
(1) This item shall consist of furnishing and placing the timber
retaining walls, as shown on the drawings the structure excava-
tion, structure backfill, and concrete footing shall be considered
part of this item.
(2) All timber shall be adequately seasoned and dried before impreg-
nation with preservative so as to obtain the required retention
' rate. The moisture content before treatment shall not exceed 25
percent.
(3) The 6x6 column post shall be undressed No. 1 Post, coast region
douglas fir. Post shall be treated .with amoniacal copper argenite
as specified in Federal Specification TT-W-571. ~'
(4) The 4x12 .timber plank shall be undressed No. 2 Plank, coast
region douglas fir. .Planks shall be treated with amoniacal
copper argenite or chromated copper arsenate, at the same rate,
specified for post as specified in Federal Specification TT-W-571.

Definition
Straw bale sediment barriers are temporary berms,
diversions, or other barriers that are constructed of
baled straw.
Purpose
Straw bale sediment barriers are constructed to inter-
cept and detain small amounts of sediment from un~+ro-
tected areas of .limited extent.
Applicability
Applicable to all construction sites, especially where
runoff can discharge onto adjacent properties. These
barriers are temporary in nature and should not be used
where there is concentration of water in a channel or
other drainageway. •-•
Advantages
_, 1. If properly installed, the barriers can remove the
bulk of coarse sediment from runoff before leaving
the site.
2. Prevents sediment damage to adjacent property
owners.
3. When the bale deteriorates, it can be broken up
and spread as mulch.
Disadvantages
1. The barriers have a short life expectancy of 3-6
months.
2. The barriers
. are not intended for use on cut and
' fill slopes
3. The barriers are riot intended for use on paved
surfaces.
4. The barriers are ineffective if not properly
installed because of undercutting and end flow.
5. Some counties discourage the use of straw bales

The barriers .shall be checked periodically. Sediment
which has accumulated needs to be removed after each
storm. Bales 'must be replaced when rotten, disinte-
grating, or broken.
Effect~ess
The straw bale sediment barriers are. only effective if
they are properly installed and in accordance with the
design criteria. Sandbags are more effective on paved
surfaces than the straw bales, and filter fences are
more effective on soil surfaces. The barriers are not
effective for use to preveht or check channel erosion.

Definition
Filter fences are a temporary sediment barrier con-
sisting of filter fabric attached to supporting posts.
Usually a wire mesh or similar material is used to help
support the fabric.
Purpose
Filter fences are constructed to intercept and detain
sediment while decreasing the velocity of runoff.
Applicability
Applicable to all construction sites, especially where
runoff. can discharge onto adjacent properties br
directly into streams. These barriers are temporary in
nature and limited to siltations in which surface'
runoff is expected. They should not be used where
there is cohcentrated volumes of water in channels or
"other drainageways: `
Advantages
1, If properly installed, the filter fehces can
remove most of_tlie sediment from surface runoff
leaving the. site.
2. Prevents sediment damage to adjacent property
owners.
3. Prevents degradation of water quality, especially
when used adjacent to water courses.'
4. Reduces the velocity of runoff, runoff, and hence
the erosive capacity.
Disadvantages
1. The filter fences have a useful life expectancy of
.one year.
2. The fences are not intended for use in channels,
drainageways or on"ciit and fi:11 "slopes.` ~ "
3. The fences areineffective ifnot prbperly in-
stalled because of undercutting and end cutting.

to entrench the filter fabric.
5. The fences require periodic maintenance and
cleaning.
Planning Criteria
Since the fences are designed to intercept surface
runoff, they are effective for areas of about 1-2 acres
and where the maximum slope length behind the. barriers
is 100 feet. The fences may be used on slopes of less
than 50 percent.
Installation
Filter fences are usually made by attaching filter
fabric (Mirifi 100X, Exxon GTF 1005, or equivalent)
to a wire mesh fence. Steel posts are spaced from 4 to
10 feet along the contour depending on the application
and driven, at .least l foot into .the. ground. A trench
(4 in. x 4 in.) is excavated along the line of posts
and uphill from the barrier. The. filter cloth is not
only buried vertically, but also across the bottom of
the trench into the direction of the water flow. The
( wire mesh is fastened to the uphill side of the posts
and extended into the trench. The filter cloth is then
fastened to the uphill side of the posts and extended
into the trench. The trench is backfilled over the .toe
of the filter cloth and the soil compacted against the
filter cloth.
Maintenance
The filter fences should be checked immediately after
each rain storm and shallbe repaired as necessary to
keep them functional. Sediment should be removed when
deposits reach approximately one-half the height of the
barrier and properly removed from the site. The
material must never be placed below the filter fence.
Any required repairs should be made immediately.
Effectiveness
The filter fences are only effective if they are
properly installed and in accordance with the design
criteria. In general, a filter fence can_last about
twice as. long as a straw bale sediment barrier and is
more. effective in trapping sediments. The greater
effectiveness of the filter fence is due to stronger
construction, greater depth of ponding, and by allowing
fewer soil particles to pass through it.
