PITIQN COUNTY, COLORADO, APPROVING THE CHEO SITE PLAN REVIEW
Administrative Decision No.3~-2008
RECITALS
1) Stan and Chris Cheo (hereafter "Applicant") have applied to the Community Development Director of
Pitkin County (hereafter "Director") to obtain Site Plan review approval to remodel and expand the
existing single-family residence. The Applicant proposes to utilize the previously established building
envelope as the activity envelope, with minor revisions. The parcel is within a designated scenic view
protection area.
2) The property is located at 8389 Upper River Road, and is more specifically described in Exhibit A.
3) The pazcel is zoned RS-20 and contains 1.5 acres.
4) The Hearing Officer granted 1041 hazazd review and conceptual submission approval in 1998
pursuant to a Determination recorded as Reception #422332 to accommodate expansion of the
residence. The 1041 site plan was recorded in Plat Book 48 at Page 87. The vested rights have
expired.
5) The Director finds that the request complies with the applicable provisions of the Land Use Code, as
follows:
A) The proposed addition is located in areas with slopes in excess of 30% and 45%. The slopes in
excess of 45% are an anomaly created by the construction of the existing residence; development
in this area is permitted pursuant to Sec. 7-20-20(cx3) ofthe Code. The development on slopes in
excess of 30% is permitted by Sec. 7-20-20(cx2) of the Code, since there is not adequate azea on
slopes of less than 30% to accommodate the allowable floor area.
B) Anew activity envelope should be established that includes only those areas that are currently, or
proposed as part of this application to be, disturbed.
C) The pazcel is within the mapped Scenic View Protection Area. The existing residence and
proposed addition aze not visible from Upper River Road, but can be seen from Highway 82. The
proposed addition complies with the Scenic View Protection standazds: existing landscaping
provides screening and the additional mass will have a minimal visual impact.
APPROVED by the Director, subject to the following conditions, which shall run with the land and be
binding on all successors in interest:
1. The Applicant shall adhere to all material representations made in the application and shall consider those
representations to be conditions of approval, unless amended by other conditions.
2. The conditions of this approval shall replace those found in the Hearing Officer Determination recorded
as Reception No. 422332.
3. Prior to submission of any future building permit applications, the Applicant shall be required to
submit for approval by the County Attorney and Community Development a Site Plan with an
Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual

Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and
recordation of them. The Site Plan shall also incorporate the following changes:
A. Establish a new activity envelope that includes only those areas that are currently, or proposed as part
of this application to be, disturbed. The envelope should exclude azeas that were included within the
previously approved building envelope, including the azea north of the well and steep slopes to the
west of the well and the house with the exception of the area where the addition is proposed.
B. Include the on-site waste water system components on the site plan.
4. The pazcel is exempt from the Growth Management up to 5,750 squaze feet of floor area.
5. Prior to issuance of a building permit application for the remodel and expansion of the residence, the
Applicant shall:
A. Submit a precise engineer or geologist approved plan that demonstrates that the site can be
engineered such that there is no hazard posed by the location of development on slopes in excess of
30% and 45%. The plan shall show the area of disturbed slope, any regrading and the exact size and
location of all mitigation devices.
B. Submit a drainage and erosion control plan for review and approval by the Planning Engineer.
C. Submit a construction management plan for review and approval by the Planning Engineer
showing the locations of staging, material storage and employee and construction traffic parking.
D. Pay the applicable road and employee housing impact fees.
E. Obtain a permit for construction of the on-site wastewater treatment system (OWTS). With the
permit application, the Applicant shall provide a copy of the well permit and the pumping record for
the well.
F. Submit a detailed revegetation plan for disturbed azeas with appropriate seed mixes.
G. Obtain a permit to demolish the deck and outbuilding to the south of the residence. The structures
shall be removed prior to issuance of a Certificate of Occupancy for the addition.
6. Areas disturbed by construction shall be re-vegetated within one growing season of the project's
completion.
No structural development in excess of 30", with the exception of fencing, shall occur within the
setbacks of the parcel. Landscaping in the form of berms shall not exceed four feet from the most
restrictive grade. Any development located within setbacks mandated by County zoning regulations
shall require a vaziance from the Board of Adjustment, with the exception of those portions of the
existing residence that encroach into the setback on the west side. Approval of an activity envelope
within such setbacks does not assure approval of a variance.
8. The Applicant shall comply with the following standards for Development in a Low Wildfire Hazazd
Area:
A. Defensible Space: The azea around all buildings/structures, limited by property boundaries that
may limit a property owner's ability to comply with this section, shall incorporate landscaping
with wildfire defensible space considerations as follows (note: actual vegetation manipulation to
meet these conditions may not be necessary where the natural vegetation patterns have already
fulfilled these conditions):
1) Brush, debris and non-ornamental vegetation shall be removed within a minimum ten-foot
(10') perimeter aoound all structures.

2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a
minimum of a thirty (30) foot perimeter azound a structure built on flat ground. (For greater
slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners,
which provides general guidelines that may be modified by a wildfire expert acceptable to the
County).
3) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be
a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be
equal to the height of the fuel. All measurements shall be From the edges of the crowns of the
fuel.
4) All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a
height of ten (10) feet above the ground with removal of ladder fuels from azound trees and
brush.
5) Tree crown separation within the thirty (30) foot perimeters shall have a minimum often (10)
feet between the edges of the crowns, except for mature stands of aspen trees where ladder
fuels have been removed. In areas of aspen regeneration, understory shrubs and down and
dead materials shall be removed.
6) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen
(15) feet of chimneys shall be removed.
7) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be
reduced where natural reduction has not already occurred.
8) All deadfall up to a one hundred (100) foot perimeter shall be removed.
9) No new conifer trees shal- be planted within ten (10) feet of a residence.
10) No flammable mulches shall be placed within two (2) feet of a residence.
11) The property owner shall be responsible for the continued maintenance of the defensible
space vegetation requirements.
B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted
Building Code. No wood shakes or shingles. All other adopted Building Code compliant
methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they
comply with the following:
1) All roof coverings shall be constructed of non-combustible materials and installed on a Class
A roof assembly.
2) AlI roof coverings shall have a surface that shall facilitate the natural process of clearing roof
debris.
3) Protrusions above the roofline, such as parapets, shall be prohibited.
4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum
pitch of 1:48.
5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the
Fire Marshal prior to submittal of a building permit application.
C. Maintenance and Miscellaneous Requirements
1) Roofs and gutters shall be kept cleaz of debris.
2) Roof vents shall be screened with con•osive resistant wire mesh, with mesh one-fourth ('/<)
inch maximum.
3) Any outbuilding shall adhere to the same wildfire requirements.
4) Yazds shall be kept clear of all litter, slash and flammable debris.
5) All flammable materials shall be stored on a pazallel contour a minimum of fifteen (15) feet

away from any structure.
6) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more
than six (6) inches.
7) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifreen (15) feet
away from the structure.
8) Swimming pools and ponds shall be accessible by the local fire district.
9) Fences shall be kept clear of brush and debris.
10) Wood fences shall not connect to other structures.
11) Fuel tanks shall be installed underground with an approved container.
12) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on
a contour away from the structure with standard defensible space vegetation mitigation
around any aboveground tank. Any wood enclosure around the tank shall be constructed with
materials approved for two (2) hour fire-resistive construction on the exterior side of the
walls.
13) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher.
14) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be
visible at the primary point of access from the public or common access road and installed on
anon-combustible post. ,
15) Utilities shall be extended underground.
9. No development shall occur outside of the approved activity envelope, with the exception of
vegetation removal necessary to comply with the wildfire mitigation measures described above.
10. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake
the corners of the envelope and instal] construction fencing around the construction site within the
perimeter of the envelope. The fencing shall remain in place until issuance of a Certificate of
Occupancy.
11. The Applicant shall comply with all standards for development within Scenic View Protection Areas
as represented in the application and approved in this Administrative Decision. The exterior materials
(facade and roofing) for the residence shall have natural earth tone colors that blend with the colors of
the surrounding landscape and shall be non-reflective. The residence shall be substantially consistent
with the images attached as Exhibit B. Driveway lighting is prohibited and all other lighting shall
comply with the lighting code.
12. No calculations for height, bulk, setback, size, floor azea, or any other building and zoning requirements
have been conducted. These requirements will be considered at the time of building permit. Any
structures represented in the application may not be permitted under building and zoning regulations.
13. Failure to comply with the conditions of this approval may result in revocation of this approval, or
any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this
property.
14. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use
C de, § 2-20-170 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on
2011.

RE: Cheo Site Plan Review -Response to Code Section 7-20-ZO(b) and (c)
Dear Suzanne:
This letter is a follow-up to our site visit to the Cheo properly at 8389 Upper River
Road to review the slopes at the location of the proposed residential addition.
The proposed addition is within the previously established building envelope,
but is located in areas with slopes in excess of 30% and 45%. It was determined
during our site visit that the slopes in excess of forty-five percent (45%) are an
anomaly and that the natural condition of the slope prior to the disturbance
created by previous construction is between thirty and foray-five percent. With
that understanding in place, we believe that the proposed addition should be
permitted because it complies with Section 7-20-20(c) related to exceptions for
development on slopes greater than thirty percent but less than forty-five
percent, as specifically described below:
(b) Forty-five (45) Percent or Greater Gradient
As mentioned above, it was determined during our site visit that the slopes
greater than forty-five percent are an anomaly created by disturbance during
previous construction. The natural slope of the site appears to be less than
forty-five percent, making this code section not applicable.
(c) Thirty (30) Percent or Greater Gradient
Development is prohibited onslopes with a slope gradient of thirty (30) percent or
more, except as follows:
(1) NO ALTERNATIVE BUILDING SITE
If there is no alternative building site available on the parcel with slopes of less than
thirty (30) percent, development (but not roads or driveways) may be approved by the
Community Development Department through the Sde Plan process subject to the
following development standards:

There is no alternative building site available on the parcel with slopes less than
thirty percent to accommodate the proposed addition. The flat area to the
north of the existing residence contains the well for the residence. A small
_ addition is proposed on that side of the house, but a larger addition would
block the only access to the well and would also encroach on steep slopes.
The flat area west of the existing structure is the only location appropriate for a
drywell per County regulations, and this area contains the septic leach field as
well. Only the proposed location is feasible as a site for the modest addition.
Based on the fact that there is no alternative building site, the proposed
location for the addition does meet the standards of this section, as described
below.
(a) An engineer or geologist licensed in the State of Colorado shall be required to
demonstrate that the site can be engineered so that there is no hazard posed by the
location of development on such slopes.
The applicant is working with KL8.A Structural Engineers in Basalt to properly
engineer an integrated retaining wall within the structure of the foundation
walls. This will ensure that there is hazard posed by the location of the
development related to the steep slopes. Engineered plans will be included
with the building permit submittal.
(b) To the extent possible, the development shall be designed so as to: avoid adding
water to the site that would cause decreased stability; avoid removing the toe of the
slope without adequate mechanical support; avoid increasing the weight load on top of
the slope; re-contour disturbed slopes so that they can be re-vegetated; avoid
steepening of existing slopes.
The development will not decrease the stability of the slope, increase loads on
the top of the slope, or steepen existing slopes. The disturbed slopes will be re-
contoured and re-vegetated per Pitkin County standards.
(c) Any development approved pursuant to this section shall be conddioned upon
compliance with the engineer or geologist's recommended mitigation measures.
The proposed addition will comply with engineer or geologist recommended
mitigation measures related to development on steep slopes.
(d) Following Site Plan review, and prior to the application for a Building Permit, a
precise engineer or geologist approved mitigation plan shall be submitted by the
applicant that shows the area of disturbed slope, any re-grading required and the exact
size and location of all mitigation devices. The mitigation measures must be
determined by the Community Development Department to be the least visually and
ecologically obtrusive alternatives.
All disturbed areas will be re-graded and revegetated in compliance with Pitkin
County standards. The applicant intends to excavate only enough to build the
proposed addition. Some excavated materials will be used to backfill and/or
re-vegetate the site. The remaining excavated materials will be removed from
the site. All disturbed grades outside of the proposed addition will be returned

to their existing condition. The foundation wall of the addition is being
engineered to withstand the forces of the steep slopes. It will be built into the
hillside and will not be visually or ecologically obhusive. No additional retaining
or mitigation measures are expected to be necessary.
(2) PARCELS WITH SOME AREAS OF LESS THAN THIRTY (30) PERCENT
SLOPES
(a) If a parcel contains areas with less than thirty (30) percent slopes that are
accessible by a road or driveway that meets the requirements of this Land Use Code,
but such areas (after exclusion of Constrained Areas) are not large enough to develop
the floor area permitted by undertying zoning, then areas containing slopes of less than
thirty (30) percent must be utilized to develop as much of the floor area as can feasibly
be accommodated. Areas containing slopes of thirty (30) percent or greater (but not
exceeding forty-five (45) percent) may then be used for development of the remainder
of the permitted floor area. The resulting area specked for development should define
a contiguous area with slopes of less than thirty (30) percent to the maximum extent
practicable.
The applicant's parcel contains some areas with less than thirty percent slopes,
but these areas are not large enough to accommodate 5,750 sq. ft. of floor
area permitted in the RS-20 zone district. The total size of the residence with the
proposed addition is 4,358 sq. ft., which is 1,392 sq. ft. less than allowed. The
proposed addition utilizes a flat area of the site before extending into steeper
slopes. The applicant is requesting approval to extend into areas naturally
considered to be greater than thirty percent but less than forty-five percent.
The footprint of the addition breaks down as follows in each slope area:

Note: The area greater than 45~ is considered an anomaly and is assumed to naturally
be greater than 30~ but less than 45~.
(b) Development on slopes equal to or exceeding thirty (30) percent (but less than or
equal to forty-five (45) percent) shall be subject to the development standards in Sec.
7-20-20(c)(1)(a) through (d)., and shall minimize disruption of natural terrain as viewed
from any of those roads identified in Sec. 7-20-120(b).
The proposed addition complies with Section 7-20-20)c) )1) )a) through )d), as
described above.
CONCLUSION
Because the existing house, along with the well and septic facilities, dictates the
possible location for this relafivey modest addition, there is no alternative

building site. The proposed addition complies with the code sections above
and there is no location on the site that would completely avoid slope impacts.
The entire addition is within the previously established building envelope. The
approval related to that envelope had no reference to concerns of future
development on the included slopes. The owner had reasonable reliance on
the development envelope as previously approved, which would permit the
proposed additions and there have not been significant changes to the code
with respect to slope development.

Dear Suzanne:
This letter is in response to your email regarding the proposed site plan for
the Cheo property at 8389 Upper River Road. The addition is located in
areas with slopes in excess of 30% and 45%, but the proposed development
is permitted pursuant to exceptions in Section 7-20-20(b) and (c) of the Pitkin
County Land Use Code.
Sections 7.20.20(b) and (c) permit development if there is no alternative
building site that avoids areas of steep slopes. As shown on the slope
analysis included in the application, a very small portion of the site has
slopes less than thirty percent (30%). However, this flat area is within the 50'
front yard setback off of Upper River Road. In order to comply with the
setback requirements, the addition must be located in areas with steep
slopes. Given that condition, the addition is located in the most ideal area
relative to the existing structure and existing vegetation.
The applicant is working with KL&A Structural Engineers in Basalt to properly
engineer an integrated retaining wall within the structure of the foundation
walls. Some excavated materials from the disturbed area will be used to
backfill and/or re-vegetate; the remaining excavated materials will be
removed from the site. These engineered plans will be included with the
building permit submittal.

This memo is in response to Joanna Schaffner's comments on the above referenced
application.
The deck encroachment dates back to a point long before the current
owner's purchased the property. It apparently was identified in a 1998
approval that required either a lot line adjustment or removal of the deck. The
current owners request that the deck encroachment be allowed to removed
during construction of the addition, rather than prior to recording the site plan.
The equipment needed to demolish and remove the deck will be on-site for
construction making it more efficient to remove at that time.
2. The proposed development has been revised so that it is entirely within the
building envelope. See attached revised site plan. The roof overhang on the
south side and the trellis on the west have both been pulling back to comply
with the building envelope and setback lines.
3. The existing encroachment is believed to be legal and is scheduled to remain.
It will not be increased in any way.
4. The 2,826 cubic feet of excavated soil cannot be retained on the site as
originally proposed. It will be trucked off-site so there will be no change to
existing grades or landforms.
5. It is understood that the building elevations shown in the application are for
illustrative purposes only.
6. The applicant and architect will be advised that the flat roof requires approval
from the Fire Marshall. The applicant will provide evidence of such approval
at building permit submittal.

AGREEMENT FOR PAYMENT OF LAND USE APPLICATION FEES
PITKIN COUNTY (hereinafter "COUNTY") and Stan and Chirs Cheo (hereinafter "APPLICANT") AGREE AS
FOLLOWS:
"PROJECT").
APPLICANT has submitted to COUNTY an application for 8389 Upper River Road (hereinafter, the
2. APPLICANT understands and agrees that Pitkin County Ordinance No. 32-2002 establishes a fee
structure for land use applications and the payment of all processing fees is a condition precedent to a determination of
application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the
cost of development review in the COUNTY. Fees have heen set to be consistent and fair to the public and to reflect the
expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed PROJECT, it
may not be possible at the time of application to ascertain the full extent of the costs involved in processing the
application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall
accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to
enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project
approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full
fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $1,155.00
which is based on 5 hours of staff time, and if actual time spent by staff to process the application exceeds the average
number of hours by more than 20%, then the COUNTY will bill the APPLICANT quarterly for the additional time spent.
Such periodic payments shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay
such accrued costs shall be grounds for suspension of processing.

On behalf of our clients, Stan and Chris Cheo, we are writing to request that
Pitkin County conduct a Site Plan Review for 8389 Upper River Road. This
application is in conformance with your Pre-application Conference Summary,
dated 21 June 2007. This application seeks site plan approval to remodel and
add an addition to an existing single-family home.
The existing residence is 2,972 square feet on a 1.5 acre parcel in the RS-20 zone
district. The applicant is requesting approval to add an addition of 1,386 sq. ft.
to the existing residence totaling 4,358 sq. ft. The total size of the proposed
residence is 1,392 sq. ft. less than the allowable 5,750 sq. ft.
The parcel has already established a building envelope (Rec. No. 428565)
through a Hearing Officer determination (Rec. No. 422332) recorded on 23
September 1998. Subsequently, vesting has expired on this approval. In a pre-
application conference between Pitkin County and the applicant, it was
determined that the previously established building envelope can be used as
an activity envelope so long as the proposed redevelopment is within its
boundaries. The proposed addition is within the existing envelope boundaries,
except as permitted by zoning regulations. Therefore, the applicant is seeking
approval of the proposed Site Plan without an amendment to the previously
established building envelope.
The applicant's property is on the east side of Upper River Road and is in a
mapped Scenic View Protection Area. The property is located on a bench
above Upper River Road making the existing building nearly invisible from the
Upper River Road viewplane. The property is only visible from a stationary
position at the shoulder of the westbound lane on Highway 82. The proposed
addition is not near the ridgeline and has been designed to minimize the visual
impact and perceived mass.

This application seeks Site Plan approval to remodel and add to an existing single-family
residence at 8389 Upper River Road. The existing house is 2,972 square feet and. is
located in the M/B Woody Creek subdivision. The applicant's parcel is 1.5 acres and is
therefore substandazd for the underlying RS-20 zoning district.
The applicant is requesting approval to add 1,386 sq. fr. to the existing residence of 2,972
sq. ft resulting in a 4,358 sq. ft. single-family home. The total size of the proposed
residence is 1,392 sq. ft. less than the allowable 5,750 sq. ft. No additional development
rights aze requested in this application.
The pazcel has an approved building envelope (Rec. No. 428565) through a Hearing
Officer determination (Rec. No. 422332), however that approval is no longer vested. In a
pre-application conference between Pitkin County and the applicant, it was determined
that the previously established building envelope can be used as an activity envelope so
long as the proposed redevelopment is within its boundazies. This application keeps all
development within the boundaries of the formerly approved building envelope.
The structure of the proposed addition is within the existing envelope boundazies except
as permitted by zoning regulations. An existing patio that is less than thirty (30) inches
above grade and sits partially outside the envelope boundaries will remain in place. The
cantilevered roof on a portion of the proposed addition extends 15" over the activity
envelope plane. As per the Pitkin County zoning regulations, a building eave is permitted
to extend eighteen (18) inches beyond a boundary line. Because the proposed structure is
within the existing building envelope, the applicant is seeking approval of the proposed
Site Plan without an amendment to the previously established building envelope.
The proposed site plan complies with all applicable sections of the Pitkin County Land
Use Code. The proposed residence is a modest sized house that complies with the
underlying zoning and is less than the allowable squaze footage for the site. The
applicant's addition focuses on energy efficiency and incorporates sustainable design
strategies. The remodel and redevelopment will include a green roof and water efficient
plumbing fixtures. The owners are also looking into the feasibility of solaz panels as an
alternative energy source.

2-30-20: ADMINISTRATIVE REVIEW PROCEDURE
(g) Criteria for Approval
(2) SITE PLAN
The proposed Site Plan complies with all applicable provisions of the Pitkin County Land Use
Code and with all prior development approvals applicable to the property. The proposed addition
is within the previously approved Building Envelope as established by a Hearing Officer
Determination and recorded as Reception Number 422332, including use of the building eave
exemption. This 1041 approval is no longer vested, however, it was determined in the applicant's
pre-application conference with Pitkin County that the previously established building envelope
can be used as an activity envelope so long as all redevelopment occurs within its boundaries.
The applicant is seeking approval of the proposed Site Plan without an amendment to the existing
building/activity envelope. The structure of the proposed addition is within the existing envelope
boundaries except as permitted by zoning regulations. Asper the Pitkin County regulations, a
building eave is permitted to extend eighteen (18) inches beyond a boundary line. The
cantilevered roof on a portion of the proposed addition extends 15"over the activity envelope
plane and therefore is in compliance with the code. An existing patio that is less than thirty (30)
inches above grade sits partially outside the envelope boundaries but is also allowed by zoning
regulations.
The approved 1041 plat and recorded determination call fora 30 foot front yard setback off of
Upper River Road. The proposed redevelopment complies with the approved 30' setback. The
setback requirement, however, is 50' from the Upper River Road right-of--way, as it is a collector
street. Approximately twenty-nine (29) linear feet of the existing garage encroaches on the 50'
setback line. No part of the proposed addition encroaches on this setback. Because the
proposed development is within the previously approved building envelope and because the
applicant's house is significantly higher in elevation than Upper River Road, the applicant is
requesting that the Site Plan be approved with the slight encroachment into the 50' setback.
7-20: RURAL CHARACTER, ENVIRONMENTAL PROTECTION, AND
NATURAL HAZARDS
7-20-70: SITE PREPARATION AND GRADING
(a) Grading and Fill Placement
All grading and filling will take place only within the defined Activity Envelope. Approximately 104
cubic yards (2826 cubic feet) of soil will be permanently displaced, as indicated on the site plan.
(b) Clearing, Grubbing, and Vegetation Removal
Clearing or grubbing of the land and removal of vegetation will occur only within the Activity
Envelope. Compliance is noted on the site plan. All disturbed areas will revegetated as per
Pitkin County requirements and the standards in Section 7-20-130. .
(c) Tree Removal and Mitigation
No trees will be removed for this redevelopment and all revegetation will comply with the Pitkin
County Revegetation Guidelines.

The site is previously disturbed with the existing dwelling. The modest addition of 1,386 sq. ft. to
the existing home is designed to have minimal on the surrounding site. The applicant wiN comply
with Pitkin County requirements intended to lessen or mitigate any physical and visual damage
caused 6y the proposed redevelopment.
(1) REVEGETATION
All disturbed areas will be revegefated per Pitkin County standards and guidelines.
(2) TOPSOIL
Topsoil will be conserved and reused to the greatest extent practical.
(3) WEED PREVENTION
The applicant will comply with all requirements related to weed prevention, thistle management,
and prohibition ofnon-native plants.
(4) UTILITY INSTALLATION
Utilities already serve the existing residence on the property
(5) EROSION, SEDIMENTATION, AND STORMWATER MANAGEMENT
The proposed redevelopment is not expected to cause erosion problems. Disturbance of natural
vegetation will be minimized and any cuts and fills will be adequately designed and vegetated to
control erosion and ensure stability of sloped areas. Natural drainage patterns will be preserved
and protected from increased water flows. The applicant's property is lot located adjacent to a
river, stream, lake, reservoir, wetland, or riparian area.
All necessary measures will be taken to provide erosion, sedimentation, and stormwater
management on this site. The plans will be completed per Pitkin County standards and submitted
with the building permit application.
7.20.20 STEEP AND POTENTIALLY UNSTABLE SLOPES
(e) Additional Standards
All activity and development on slopes with a gradient of thirty (30) percent or greater shall
comply with the following standards.
(2) LIMITS ON CHANGING NATURAL GRADE
The original, natural grade of areas within the Activity Envelope shall not be raised or lowered
more than four (4) feet at any point for construction of any structure or improvement, except:
(a) The site's original grade may be raised or lowered a maximum of seven (T) feet if retaining
walls are used to reduce the steepness of man-made slopes, provided that the retaining walls
comply with the requirements set forth in this section.
(b) As necessary to construct a driveway from the street to a garage or parking area, grade
changes or retaining walls up to seven (7) feet may be allowed.
The vicinity of the subject area is a series of elevated benches rising from the Roaring Fork River,
to Upper River Road, to the elevation of the existing dwelling, next to the raceway and/or W/J
bench, then McClain Flats. The existing dwelling is located on the flattest area of the subject
property. The proposed additions to this building are designed to minimize visual impact from
Highway 82 and to maintain the mature Aspen trees on the site. Some steep slopes are
encroached upon to meet these goals.
A portion of the 1,386 sq. R. addition will encroach on slopes from 15 to 45 percent. See attached
slope analysis. Approximately 2/3 of the proposed addition to the southern side of the existing
dwelling encroaches on slopes fifteen (15) percent and greater. This area of the home is

designed to be built into the hillside. The structure of the building will act as a retaining wall to
support the cut in the slope in this area.
At the northern side of the existing dwelling, a small addition, primarily serving as a storage area
with a deck above, is proposed adjacent to the existing garage. This area is approximately 126
sq. tt., 2/3 of which encroaches on slopes greater than thirty (30) percent. See attached slope
analysis. This is an appropriate location for this storage area creating an additional egress from
the second level rooms, minimizing visual impact by being placed toward the rear of the building,
and having access from the garage area.
The natural grade of the areas within the Activity Envelope will not be raised or lowered more
than four (4) feet at any point for this redevelopment. Similarly, the existing driveway from Upper
River Road to the residence will not be modified for this project. No grade changes or retaining
walls are proposed along the driveway.
(3) GRADING FOR ACCESSORY BUILDING PADS DISCOURAGED
No accessory buildings or structures are proposed as part of this redevelopment.
(4) LIMITS ON GRADED, EXCAVATED, OR FILLED MAN-MADE SLOPES
(a) Where grading, excavation, or filling is necessary, grading, excavation, or filling to create
slopes of twenty-five (25) percent or less is strongly encouraged.
Excavation is necessary along the perimeter of the southern addition to the existing dwelling.
The structure of this addition will act as a retaining wall against the slopes impacted by the
development. No grading is proposed.
(b) Graded or filled man-made slopes shall not exceed a slope of fifty (50) percent.
No man-made slopes are proposed.
(c) Cut man-made surtaces or slopes shall not exceed a slope of fifty (50) percent unless a soils
engineering or a geotechnical report is furnished stating that the site has been investigated and
that in the opinion of a qualified professional a cut at a steeper slope will be stable and not create
a hazard to public or private property.
No graded or man-made slopes are proposed.
(d) All cut, filled, and graded slopes shall be recontoured to the natural, varied contour of the
surrounding terrain.
The excavation for the proposed additions to the existing dwelling unit will allow the home to be
designed into the hillside. Re-contouring is not applicable to this proposal.
(5) GUIDELINES FOR RETAINING WALLS
Use of retaining walls is encouraged to reduce the steepness of man-made slopes and to provide
planting pockets conducive to revegetation.
(a) Retaining walls may be permitted to support steep slopes but should not exceed four (4) feet
in height from the finished grade, except for (i) a structure's foundation wall, or (ii) as necessary to
construct a driveway from the street to a garage or parking area, or (iii) as otherwise expressly
allowed by this Land Use Code.
(b) A retaining wall should not exceed seven (7) feet in height. Retaining walls greater than four
(4) feet in height shall be supported by appropriate engineering and reviewed and approved by
the County Engineer.

(c) Terracing should be limited to two (2) tiers. The width of the terrace between any two four (4)
foot vertical retaining walls should be at least three (3) feet. Retaining walls higher than four (4)
feet should be separated from any other retaining wall by a minimum of five (5) horizontal feet.
Terraces created between retaining walls shall be permanently landscaped or revegetated with
native vegetation.
(d) Retaining walls used to support existing road cuts may exceed (a), (b), and (c) of these
guidelines.
No terracing or new typical retaining walls are proposed for this project. Parts of the 1, 386 sq. ft.
addition to the existing dwelling will encroach on sloped areas from 15 to 45%, primarily where
the addition is proposed at the southern side of the existing dwelling. This area of the home is
designed into the hillside. The structure of the building will be engineered fo act as a retaining
wall to support the area surrounding the excavation. The structure of the building is significantly
more substantial than a lone retaining wall and therefore the retaining wall height restriction of
seven (7) feet is not appropriate in this context.
Similady, at the northern side of the existing dwelling, a small addition, primarily serving as a
storage area, is proposed adjacent to the existing garage. This area is approximately 126 sq. ft.,
2/3 of which encroaches slopes between 30 and 45 percent. The storage area and deck is
proposed at a height of less than 9 ft to the finished Floor. The storage area will also be
engineered and designed to act as a retaining wall against the steep slopes.
(B) STANDARDS FOR RETAINING WALLS
(a) Retaining walls shall be faced with stone or earth-colored materials similar to the surrounding
natural landscape.
(b) Ali retaining walls shall comply with the adopted building code, except that when any provision
of this section conflicts with any provision set forth in the adopted building code, the more
restrictive provision shall apply.
There are no stand-alone retaining walls. Since the proposed addition is to be built into the rear
hillside, the back structural walls of the residence will be engineered to hold up the excavated
hillside as discussed above.
(7) WATERWAYS PROHIBITED
The proposed redevelopment does not involve filling or dredging of water courses, wetlands,
gullies, stream beds, or stormwater runoff channels.
(8) DETENTION/STORMWATER FACILITIES
No detention basins or storm and erosion control facilities are expected to be required for this
project.
(!i) UTILITY CUTS
Utilities already serve an existing residence on the property. No additional utility cuts are
expected.
(10) REVEGETATION REQUIRED
All disturbed areas will be revegetated per Pitkin County standards and guidelines.
7-200: WATER COURSES AND DRAINAGE
(b) Encroachment or Channeling
No encroachment or channeling activities will occur for this project.
(c) Drainage

(1) GENERAL
Historic drainage will be maintained and unimpeded. The proposed redevelopment will (a)
maintain historical flow patterns and runoff amounts; (b) not impede the flow of natural water
courses and ditches; (c) provide adequate drainage for all low points; (d) include a drainage
system designed to accommodating runoff,' (e) maintain the current drainage system; and (f) treat
on-site stormwater with the use of best management practices.
(2) RUNOFF VOLUMES
Runoff volumes will not be affected by this development.
(d) Groundwater
The proposed residence will not contaminate the ground water or intertere with any recharge area
or aquifer. The existing well will continue provide potable water and serve the landscaping
needs.
(e) Irrigated Areas
The proposed redevelopment will not adversely affect the adequacy of water supplies or water
rights. The existing sprinkler system will continue to serve the landscaping. No additional
irrigation is expected to be needed as a result of this project.
(f) Irrigation Ditches
No irrigation ditches run across the applicant's property.
(g) Sedimentation
Sedimentation will be managed and controlled during all phases of the proposed development. A
Drainage and Erosion Control Plan will be provided with the building permit submission that will
show compliance with all Pitkin County requirements. No significant grading will occur on the
site. All disturbed areas will be landscaped or revegetated per Pitkin County regulations.
(h) Water Quality
The proposed addition and all redevelopment will be within the existing Activity Envelope, which
respects all setback requirements. All activities and development will comply with local, state and
federal water quality regulations.
(i) Efficient Water Use
The proposed development will emphasize efficient use of water. The existing well will provide
potable water and an existing septic system will continue to serve the proposed residence. The
proposed addition and remodel focus on energy efficiency throughout and will incorporate water
efficient plumbing fixtures.
7-20-80: RIVER AND STREAM CORRIDORS AND WETLANDS
(a) Riparian and Wetland Areas and Buffers
(1) PROTECTED FEATURES
There are no protected features such as perennial streams, intermittent streams, or wetland and
riparian areas on the applicant's property.
7-20-120: SCENIC VIEW PROTECTION
Preservation of the character of Pitkin County requires careful attention to the visible impacts of
proposed development. In general, the standards of this Sec. 7-20-120 are designed to minimize
the visual impact of new development (including expansions to existing structures) when viewed

from designated road corridors, as well as to preserve the rural character of all Rural Areas of the
county. Scenic View Protection Areas shall be considered at the time of Site Plan approval and
Building Permit issuance.
The applicant's property is on the east side of Upper River Road is in a mapped Scenic View
Protection Area. The property is located on a bench above Upper River Road making the
existing building nearly invisible from the Upper River Road viewplane.
The property includes over 15 existing mature Aspen trees planted along the southern side of the
property. These trees, in addition to the mature trees along the Roaring Fork River act as a
visual buffer of the existing building. The applicant intends to preserve all trees on the site.
The property is also approximately 20 ft lower in elevation from Highway 82. The property is only
visible from a stationary position at the shoulder of the westbound lane on Highway 82. The
proposed addition is not near the ridgeline and has been designed to minimize the visual impact
and perceived mass.
The proposed addition of 1,386 sq. ft. is organized to fit around and behind the massing of the
existing building. The position of the southern addition has a limited length of under ten (101inear
feet of elevation along the western side of the building (the side of the building visible from
Highway 82). This design minimizes the visibility of the additional square footage requested.
The total square footage of the residence with the proposed addition is 4,358, or 1,392 less than
allowable 5, 750 square footage for the site. The existing structure and proposed addition are
both situated tightly against and partially to the rear hillside and complement the natural
landscape with the use of neutral colors and a green roof.
(d) Standards for Development Within Scenic View Protection Areas
(1) The proposed development shall utilize existing topography and natural vegetation, such as
ridges, hills, and existing trees, to screen buildings to the maximum extent practicable when
viewed from those right-of-way listed in subsection (b) above.
The property includes over 15 existing mature Aspen trees planted along the southern side of the
property. These trees, in addition to the mature trees along the Roaring Fork River act as a
visual buffer of the existing building. The applicant intends to preserve all trees on the site.
The proposed two-story addition on the southeast part of the structure will be partially built into
the hillside. Much of the roof will 6e a green roof, planted with vegetation further blending into the
hillside palate.
(2) The proposed development shall avoid the location of structures within the Scenic View
Protection Areas, and shall avoid the location of structures within any Viewplane identified in the
State Highway 82 Corridor Master Plan and Down Valley Comprehensive Plan if possible. If
location outside the Scenic View Protection Area and defined Viewplanes is not practicable, then
the proposed development shall not be located on the highest ground or most visible portion of
any site as viewed from those corridors listed in subsection (b) above.
The proposed development is located in the viewplane
The applicant's entire lot is situated within the Scenic View Protection Area and within an
identified Viewplane, however, the lot is significantly lower than Highway 82 reducing visibility of
the existing (and proposed) building. The property can only be viewed from a stationary position,
in the shoulderlane of westbound Highway 82.
Similarty, the property is located over 10 feet above Upper River Road and setback 50 feet from
the west edge of the building envelope. The combination of the elevation above Upper River
Road and the setback position of the existing building make the building virtually invisible from
below.

(3) The proposed development's height and bulk shall be designed to avoid, to the maximum
extent practicable, the visibility of buildings from those corridors listed in subsection (b) above.
This may include, but shall not be limited to, breaking the mass of the building down into a series
of smaller forms, articulation of the building facades to avoid a wall or row effect, and staggering
rooflines to avoid a long unbroken plane.
The existing dwelling is a series of undulating facades along the westerly elevation reducing the
visual bulk and mass of the building. The proposed 1,386 sq. ft. additions to the existing dwelling
are similarly varied with the majority of the additional square footage tucked along the southwest
side of the existing building. The design results in a rippling elevation, minimizing the modest
mass of the building.
(4) The proposed structure shall be placed so it does not project above a ridgeline such that a
structure silhouettes against the sky when viewed from those corridors listed in subsection (b),
unless there are no alternate building sites on the lot or parcel.
The existing house and the proposed addition do not project above the ridgeline as shown on the
attached photo exhibit.
(5) The proposed development shall be designed to complement the natural topography of the
land through the use of techniques such as earth-sheltered design, the use of natural materials
and coloring, the use of low-reflectance materials, or clustering of structures on the least visible
portions of the site. When a building is proposed near a ridgeline, then its form (particularly its
roof form) shall replicate, parallel, or complement the natural form of the ridgeline so that it
appears to be an element of the natural ridgeline.
Both the design and materials of the proposed development complement the natural topography
of the land. The fagade will be treated with low-reflective, natural-toned materials and much of
the roof is a green roof to be covered with native vegetation. The structure is not near the
ridgeline and is setback in the hillside to appear as a natural element of the landscape.
(6) The proposed development shall preserve natural vegetation and avoid development within
irrigated meadows, to the maximum extent practicable.
The site is previously disturbed with the existing structure. The proposed addition of 1, 386 sq. ft.
to the existing structure is an effort to minimize disturbance and contain development on the
property to a single area. The proposed development will preserve the natural vegetation and all
disturbed areas will be revegetated as per Pitkin County regulations. The applicant's property is
not located in an irrigated meadow.
(7) The proposed development shall install utilities in locations and through procedures that
minimize visual impacts to the maximum extent practicable.
Existing utilities already serve the residence. No new utilities are necessary.
(8) All satellite dishes in the proposed development shall be located to minimize visibility from
those rights-of-way listed in subsection (b), and shall use earth tone colors and/or screening to
minimize their visual impact.
No satellite dish is proposed for this project. Any future dish will comply with Pitkin County
regulations regarding the screening and the minimization of visual impacts.
(9) The proposed development shall not use earth moving and berms as the primary means of
compliance with these regulations, but earth moving may be utilized in conjunction with other

techniques to comply with standards in this section. Where earth moving techniques are
necessary, man-made forms should be undulating and natural in appearance.
No berms are proposed as part of this project. Earthmoving will not be used as a means of
complying with Scenic View Protection Area regulations, as there wi116e no change to the
existing grade of the site.
(f0) In the Rural Areas only, development shall be located so that activities and development
occur in at least one of the locations specified in subsection (f) as they may apply to the particular
property.
The proposed addition to the existing home contains all development activity to a single area,
consistent with rural area design guidelines.
(11) EARTH TONE MATERIALS
The exterior of all development, except development located and designed in the form of a ranch
compound, shall be built or painted with indigenous earth tone materials or colors. The exterior of
a ranch compound should be built or painted with indigenous earth tone materials, or shall be
painted or stained using local, traditional ranch colors, which shall include shades of red, brown,
or white. Paints or stains that simulate weathered barn wood also shall be permitted.
The exterior of the proposed redevelopment will be built with earth tone materials, as represented
in the attached models and listed on the attached materials list.
(12) ROOFS
All roofs shall have anon-reflective color or composition. Reflective roof materials shall not be
used unless the materials are treated prior to installation to eliminate reflection, with the exception
of materials associated with solar or photovoltaic equipment.
The applicant hopes to cover much of the roof with a green roof. There will not be any reflective
materials used. The applicant is looking into the feasibility of solar panels but has not reached a
conclusion at this time.
(13) REVEGETATION OF DISTURBED AREAS
Lands disturbed by earth moving or berms should be revegetated using native species that are
already growing on or near the site. Topsoil shall be stockpiled and placed on disturbed areas.
Irrigation shall be provided to the revegetated areas if it is necessary to ensure survival of planted
native species.
All disturbed areas will be revegetated using native species already common to the area. Topsoil
will be kept on site and reused where practical. If necessary, irrigation with be used during
revegetation to ensure the survival of the planted species. All revegetation related to this project
will comply with Pitkin County regulation.
(74) DRIVEWAYS AVOID DIVIDING MEADOWS AND PASTURES
To the maximum extent practicable, roads and driveways shall be located to skirt the edge of and
avoid dividing meadows and pastures and to avoid major road cuts. Roads and driveways should
take advantage of the screening potential of natural topography and existing vegetation. Existing
roads and driveways shall be used where practical. To enhance screening, a row of trees may be
planted along the roads or driveways. To the maximum extent practicable, roads and driveways
located around the edge of or in meadows shall be laid out with soft, curving edges and shall
avoid straight line corridors that are incongruous with the natural setting.
No changes are proposed to the existing driveway.
(e) Rural Character Guidelines for Building Location
In addition to complying with the standards of subsection (d) above (if applicable), all
development in Rural Areas should be located so that activities and development occur in one or

a combination of the following locations as they may apply to the particular property: (1) at the
edge of an open meadow or pasture; (2) behind an existing stand of vegetation; (3) behind or
built into a change in natural topography; or (4) within a pasture or meadow, clustered in the form
of a ranch compound, or adjacent to or integrated into an existing ranch compound. Where
guidelines reference distances from a road, and more than one road borders the property, the
guideline applies to the road carrying the greater amount of traffic. Guidelines for each of these
locations follow:
(1) DEVELOPMENT LOCATED AT EDGE OF MEADOW OR PASTURE
Neither the existing residence nor the proposed addition are located at the edge of an open
meadow or pasture.
(2) DEVELOPMENT LOCATED BEHIND IXISTING STAND OF VEGETATION
(a) There is a group of mature aspen trees that sit in front of the existing residence. The
proposed addition and remodel will not interrupt or obscure this vegetation.
(b) Natural vegetation will adequately screen the proposed development, but if required, the
applicant will plant additional native vegetation to augment the existing vegetation and maintain
the visual integrity or the protected view.
(3) DEVELOPMENT BEHIND OR BUILT INTO NATURAL TOPOGRAPHIC BREAK
(a) The subject property is located on a relatively flat narrow bench. The existing house is
slightly visible only from very specific locations at Highway 82 near Smith Road. The proposed
additions to the existing house are designed to maintain the existing mature trees on the site as
well as minimize visibility. Apart of the proposed addition is designed into the slope immediately
behind the existing structure minimizing visibility.
(b) The existing landscaping plan will remain, no changes or additions of man-made landforms
are proposed.
(4) RANCH COMPOUND WITHIN IRRIGATED PASTURE OR MEADOWS
The proposed development is not located within an irrigated pasture or meadow in the form of a
ranch compound or adjacent to or integrated into an existing ranch compound.
(5) PARTIAL IMPRACTICABILITY
All of the proposed development can be located in conformance with the guidelines in
subsections (1) through (4) above.
(6) ALTERNATE LOCATION
The location of the proposed addition as sited is in conformance with the subsections above and
will not have a significant scenic impact.
7-20-130: LANDSCAPING AND VEGETATION PROTECTION
The proposed addition and remodel will comply with the Pitkin County Landscape Guidelines and
the Roadway Landscaping Guidelines as applicable. All existing vegetation surround the
proposed structure will remain untouched all disturbed areas will be propedy revegetated. The
proposed Site Plan seeks approval for a house that is significantly smaller than the zoning allows.
The addition will be situated tightly against the hillside and will complement the natural landscape
and preserve the rural character of the area. Much of the roof of the house will be a green roof
and will be covered with natura! vegetation.
(b) General Provisions
(1) PROTECTION OF NATURAL VEGETATION
Natural vegetation surrounding the residence will be preserved to the maximum extent
practicable and all disturbed areas will be revegetated as per Pitkin County requirements. No
new landscaping is proposed with the exception of the green roof and any required revegetation.
The plant materials used on the site will be those species that naturally occur in the area. The

removal of natural vegetation and all revegetation will comply with the requirements set forth in
the Pitkin County Land Use Code.
(2) CONFORMANCE WITH WILDFIRE REGULATIONS
The applicant's site was identified as a low to medium wildfire hazard area as part of the
previously approved 1041 Hazard Review. No wildfire prevention measures are required.
(3) BERMS
No berms are proposed as part of this project.
(4) LANDSCAPE ENCLOSURES
Landscaping will not be used to mark or enclose the boundary of the parcel.
(5) VISIBILITY CLEARANCE
No changes are proposed to the landscaping at the intersection of the driveway and Upper River
Road.
(B) UTILITYEASEMENTS
Utilities already serve the existing residence on the property. No trees or shrubs are proposed in
a location that would interfere with the utility lines or pipes.
(T) FINANCIAL SECURITY
The applicant will provide financial security if required by the County to ensure proper
revegetation and installation of landscaping.
(8) MAINTENANCE
All plants will be maintained continually in a healthy condition in accordance with generally
accepted professional horticultural standards and practices. Within areas required to be
landscaped with installed plant materials, plants that die or are unhealthy will be replaced.
Landscape areas will remain free of weeds, litter, junk, rubbish and other nuisances and
obstructions.
(c) Required Landscaping in Rural Areas
All landscaping on the site will comply with the standards for Rural Areas in Pitkin County. No
satellite dishes are proposed as part of this remodel and addition. All landscaping will use
indigenous species and will be naturally placed.
(d) Required Landscaping in Urban Areas
N/A. The applicant's property is in Rural Area.

THE KAHN 1041 HAZARD REVIEW AND CONCEPTUAL SUBMISSION
RECTTALS
1. Thomas and Michelle Kann, hereafter "Applicants", have applied to the Pitkin County Hearing
Officer, hereafter "Hearing Officer", fora 1041 Hazard Review and Conceptual Submission to
establish a building envelope to accommodate for the construction of a sun porch and any
future expansion to the existing residence.
2. The property is located at 8389 Upper River Road and is specifically described in Exhibit `A'.
3. The property is zoned RS-20 and contains approximately 1.494 acres.
4. The Hearing Officer heard this application at a public hearing on August 20, 1998 at which
thne evidence and testunony were presented with respect to this application.
NOW THEREFORE , BE PT RESOLVED by the Pitkin County Hearing Officer that
approval is hereby granted to the Kann 1041 Hazard Review and Conceptual Submission, subject to the
following conditions:
Prior to the issuance of a building permit, the Applicants shall submit an amended 1041 site
plan to the Community Development Department for approval and recording. The site plan
shall also be submitted in digital format for integration into the County's GIS system. The
site plan shall include the follow:
A. The site plan shall be identified as "Kann 1041 Hazard Review."
B. The building envelope shall be delineated on the site plan as amended by staff. The
setbacks for the building envelope shall include a 30 foot front yard setback, 20 foot side
yard setbacks, and a 30 foot rear yard setback.
C. A vicinity map shall be included on the face of the site plan.
D. The appropriate signature blocks shall be included on the face of the site plan.
E. The following 1041 Hazard Review warning and disclaimer shall be placed on the site
plan:
"The provisions of these regulations do rsot in any way assure or imply that areas outside
of the designated hazard area will be free from hazards, or that approved mitigation
nseasures will guarantee the safety of any property. "
2. No development, including grading, landscaping, vegetation removal or disturbance, shall
occur outside of the approved building envelope, except for utility and driveway extension
and maintenance.

The Applicants shall comply with the following standards for development on slopes of
greater than 15%:
A. Adequate mechanical support shall be provided for cut slopes.
B. Adding water which may decrease slope stability shall be avoided.
C. Adding weight to the top of the slope shall be avoided.
D. Disturbed slopes must be contoured so that they can be revegetated.
E. Steepening of existing slopes shall be avoided.
F. Confine cuts, fills, grading and excavation to the minimum area needed for construction.
4. The Applicants shall removed the lower limbs of the vegetation to the east of the house to
eliminate ladder fuels.
5. A fireplace/woodstove application must be filed and approved by the Environmental Heal
Department prior to the issuance of a building permit.
6. The future replacement of the existing septic system shall comply with the County's septic
regulations and be designed by a registered professional engineer.
7. Prior to recordation of the 1041 site plan, the applicant shall be granted lot line adjustment
approval for the deck encroachment, or the deck encroachment shall be removed.
8. Any additions or modifications to the out-building requires further County review and
approval.
9. Prior to the issuance of a building permit, the Applicants shall submit either an access permit
or a road encroachment permit to the County Engineer for review and approval for the
proposed modifications to the existing driveway. The proposed driveway entrance shall not
encroach into slopes of greater titan 30%. Due to the limited site distance, during driveway
modifications, the Applicants shall provide signage along Upper River Road for the
construction activity.
10. All material representations made by the Applicants in the application or in public meeting
shall be adhered to and considered conditions of approval, unless amended by other
conditions.

Description of Project/Development: The Applicants are requesting site plan approval to redevelop a single family
residence. The parcel has already established a building envelope (Book 48, Page 87, and Rec. No. 428565) through a
Hearing Officer Determination (Rec. No. 422332) however the approval is no longer vested. In apre-application conference
with the Applicants, it was determined that the previously established building envelope can be used as an activity envelope.
The Applicants are able to submit for site plan review using this envelope. If the Applicants propose development outside
the envelope, the envelope will need to be amended through formal planning review.

1 have reviewed the above referenced application and offer the following comments
+ The deck encroachment appears to be illegal and should be removed prior to recording site
plan, not prior to CO as suggested in the application.
+ The proposed development exceeds the building envelope to the south and west. No
development is permitted outside of [he building envelope.
+ There is a new encroachment into the 50 foot setback on the west side. The existing
encroachment, if legal, requires no further action. However, the new encroachment can not be
permitted without a variance from the Board of Adjustment.
+ The application proposes to excavate 2,826 cubic feet of soil. Will this soil be retained on site,
or will it be removed from the site. If it is to be retained on site, the applicant should submit a
regarding plan showing proposed grades and landforms.
+ The building elevations shown in [he application should be used for illustrative purposes only,
as they have not been reviewed for compliance with height or floor area regulations.
+ Flat roofs require approval from the Fire Marshall.
+ If the County is interested in ensuring certain existing trees remain because they screen the
house from the viewplain, then maintenance and replacement of the trees should be made a
requirement.
+ The applicant is not proposing any driveway improvements. Is the existing access drive
adequate or should improvements be required at this time? Condition 9 of the previous Kann
approval cites the limited site distance, and the Fire Marshall may also have concerns regarding
adequate emergency access.

SUMMARY OF RELEVANT PARTS OF APPLICATION: The applicant is requesting Site Plan
approval for a single family residence. A Building Envelope had been approved for this lot;
however, the approval is no longer vested.
DISCUSSION: The Pitkin County Environmental Health & Natural Resources Department has
reviewed the details of the Cheo Site Plan Review application under the authority of the Pitkin
Countv Land Use Code and the new Pitkin Countv Onsite Wastewater Treatment Svstem
(OWTS) Regulation (which will be effective March 8, 2008) and has the following comments.
This property has a septic system permitted in 1975 for a three bedroom home. Nancy
MacKenzie conducted a site visit to the property last summer to review possible sites to place
an expanded system to serve the potential remodel which would add a 4`" bedroom. The
existing plat showed an Activity Envelope; the current septic drywell site was not in the Activity
Envelope.
--- WATER SUPPLY:
There was an existing well on the property; a new replacement well has been drilled. This well
is within the Activity Envelope and meets the required setbacks from the components of the
proposed new OWTS. At the time of application for permit of the new OWTS, the well permit
and pumping record for the new well must be submitted.
--- SEWAGE TREATMENT AND COLLECTION:
Information regarding the proposed new OWTS has been submitted and reviewed by this
Department. The new design is for the proposed four bedroom house, which is less than 6,000
square feet. The system has been placed within the proposed Activity Envelope and is
designed under the new OWTS Regulation (which will be in effect at the time this application is
reviewed by the Pitkin County Community Development Director). If the proposed Activity
Envelope is approved and all other permit application materials are in order, this Department
should be able to issue an OWTS Construction Permit based on the design specifications by All
Service Septic.
