COUNTY,COLORADO,ADOPTING AMENDMENTS TO THE PITKIN COUNTY
LAND USE CODE SECTION 3-190-040,FULLY DEVELOPED LAND SUBDIVISIONS

1. The Board of County Commissioners("BOCC")has directed the preparation of
amendments to the fully developed land subdivision section of the Pitkin County Land Use Code
("the Code").
2. The amendments to Section 3-190-040 of the Code are to provide additional flexibility in
the redevelopment of structures on parcels eligible for the fully developed land subdivision
exemption.
3. The Planning and Zoning Commission("P&Z")reviewed the Code amendments at a
regularly scheduled meeting on October 3, 2000 and recommended approval of the amendments
as contained in this Ordinance.
4. The BOCC considered the amendments at ls`Reading at a public hearing on November
15,2000, and finally approved the amendments at a duly noticed 2nd Reading at a public meeting
on December 6, 2000.
NOW,THEREFORE,BE IT ORDAINED by the Pitkin County Commissioners that it
hereby amends the Pitkin County Land Use Code as contained in Attachment A.

3-190-040 Fully Developed Land Subdivisions
A subdivision exemption for a fully developed land subdivision may be permitted in the discretion
of the County subject to compliance with standards in this section(refer to Section 4-50 for procedures and
Section 5-60 for submission contents).
A. The subdivision divides land which is fully developed under existing zoning one
principal use per minimum lot size) and the resulting lots or parcels will meet the underlying zone district
dimensional requirements.
B. Building envelopes shall be established for all lots created through this provision.
C.B-. Remodeling of an existing residential dwelling unit shall not result in any change in use,
expansion or relocation offootprint, or increase in door area resulting in an expansion of fl
pofmitted, .however, The restoration,FOGGHWUG60H,or replacement of any legally established structure
shall not resulting in any change in use,addition of dwelling units,or expansion of the building foetpri
floor area,is however, the existing footprint may be modified subject to special review approval
by the Planning and Zoning Commission.

_F.Fes: The applicant shall prepare a final plat in compliance with the submission contents in
Section 5-40;and
G. l A subdivision exemption for fully developed lands which creates non-conforming lots
may be approved if the lots are deed restricted to affordable housing occupancy and price restrictions as
