Aspen Productions (hereafter, the "Applicant") has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit to conduct a photo shoot for Apple Computers. The shooting will be done on January 29th in the Ashcroft Area at the Pine Creek Cookhouse, on January 30th at the T Lazy 7 Ranch and on Maroon Creek Road toward the Maroon Bells, and January 31St at Aspen and Buttermilk Mountain, February 1St will be a weather day. The photo shoot will be from 6 A.M. to 6 P.M. and the crew will consist of 20 people. The Pitkin County Sheriffs Office, the Aspen Fire Department, Road and Bridge, the U.S. Forest Service, and the Emergency Management Department have all approved this event. County Risk Management has received and approved a Certificate of Insurance covering this event and naming the County as an Additional Insured. 4. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4-30-50(i) of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit for the Apple Computer photo shoot, subject to Applicant's compliance with each of the following conditions: The Applicant shall adhere to all material representations made in, or in connection with, the application. 2. The Applicant shall have people or signage on either side of a photo shoot alerting recreational users of their presence. 3. All crew members that are in avalanche hazard areas shall have avalanche beacons and all related rescue equipment. 4. The Applicant shall have radios in areas where cell phones don't work. 5. Please provide the following information as it applies to your event. Note that some questions will not be applicable, or appropriate, given the nature and/or scale of your event. Contact the Public Safety Council for additional information or direction regarding these requirements. • Is this acorporate-sponsored event for profit? ~ or a non-profit event? ^ (Check one.) The following statements assess the level of risk to the participanUcitizens of the County by the event and its potential to affect normal public safety resources. All participants of an event are encouraged to purchase and carry during the event a hiking, fishing, hunting, snowmobile, boat registration or back county certificate, which may cover costs of an emergency through the Colorado Department of Local Affairs-DOLA Grant. The Safety and Operations Plan can be written in outline format. It should: Outline, in detail, all of the activities, risks, or other safety issues associated with staging or participating in your event. 2. Once we hear back from the Ski Company we will let you know what mountain they prefer us to be on, our guess is they might prefer Buttermilk -Tiehack area. We also just got hired today to scout additional possibilities in Aspen Town. Once those areas are finalized & we of course will obtain permission from the business Owners - we will fax you all appropriate property releases. As soon as we finalize all locations we will send you any applicable information. In the meantime we wanted to submit this application to you as soon as possible. We understand that as soon as the shoot is "officially scheduled" we will notify you of where we propose to shoot what days so that the Sheriff's Dept. is aware of our exactlocation. As safety we will position people on either ends of the road while we are shooting to make them aware of our presence. We will not be blocking any traffic in any of the areas we will be in. The areas that we would like to shoot at currently have no avalanche issues but as safety we will have with us aback-country guide -Our guide is a "wilderness first responder" & medic. He will of course have a full first aid kit as well as oxygen tanks with him. We will also hope to have with us: Rick Dean -another registered wilderness first responder & the longest active member of Mountain Rescue. Rick Dean will have a radio with him so when we are in the Maroon Bells or in areas where cell phones do not work we can communicate with someone in the event of an emergency. In the event of an emergency & someone does need to be rushed to the hospital we will have a Suburban standing by to take them to the hospital. We will also have a hard line or radio available to use to call 911. ADDITIONAL INFORMATION REGARDING PARKING 8 VEHICLES• T - LOZy 7 Ranch: When shooting at the ranch we will park completely on ranch property. Buttermilk Mtn or Snowmass /Aspen Ski Co: When shooting on Buttermilk or Snowmass all of our vehicles will be staged in their parking lot at the base of the mountain. Aspen TOWn: Parking needs to be coordinated with the city of Aspen & we will start that process next week once we know exactly what areas our photographer might want to shoot at. UODU09 ATTACHMENT D Complete if liquor will be served at your event. A State of Colorado Special Event Liquor License Permit (if required) must be applied for with the County Clerk's Office. This permit process takes 30 days and is ONLY issued to incorporated, non-profit organizations. Proof of Liquor Liability insurance, with a $1,000,000 limit, must be provided. My comment is that there may very well be considerable avalanche concerns and that Rick Dean or some other qualified guide be ,. required to participate. 2) The applicant states that approximately 20 people will be in the crew. If they have snowmobiles and other equipment, I am wondering how this will impact folks who may be at Ashcroft or Mazoon Bells to enjoy the wilderness. This seems to raise the perennial question of interests of private, for-profit industry vs. rights of folks who want to enjoy recreational amenities in our azea. APPLICANT: Aspen Productions (hereafter, "Applicant"). LOCATION: On January 29~" the shoot will be in the Ashcroft area at the Pine Creek Cookhouse. On January 30'~ the shoot will be at the T Lazy 7 and Maroon Creek Road up towards the Maroon Bells. On January 31 st shooting will be on Aspen and Buttermilk Mountain. February 1 sc will be a weather hold day. A portion of the photo shoot occurs in the City and the Applicant will obtain a City Special Event Permit also. BACKGROUND: The photo shoot will be for Apple Computer. There will be 20 crew people. The shoot will take place from 6 A.M. to 6 P.M. The photos will feature a family of 4 enjoying various winter activities such as cross country skiing, skiing, snowball fights, etc. REFERRAL COMMENTS: The application was referred to the U.S. Forest Service, Tom Grady, Ellen Anderson, Ed Van Walraven, Kris Jewkes, and Gerald Fielding. Ellen Anderson and Tom Grady both commented that the Applicant may very well be in areas of considerable avalanche hazard. Ed VanWalraven reviewed and approved the application for the Fire Department. Kris Jewkes reviewed and approved the Certificate of Insurance provided by the Applicant. G.R. Fielding commented on the avalanche concern and the interface between the Applicant and recreational users. The U.S. Forest service has reviewed and approved the application. STAFF COMMENTS: Pursuant to Subsection 4-30-50(i) of the Land Use Code, Applicant must demonstrate that adequate provisions have been made for all of the following: 1 2 3 4 5 OOOOt?? Police supervision (if necessary); Public parking; Insurance; Site set-up, maintenance and clean-up Emergency services; and ~"~ 6. Safety of operations. Additionally, temporary structures must conform to applicable building codes and other County regulations. Each of these requirements is addressed, in turn, below. Police Supervision: No special provisions are deemed necessary. The Sheriff's Office has signed-off on the application. Public Parking: Parking will be on private property. Insurance: Applicant has provided adequate proof of insurance. Site Set-Ua, Maintenance and Clean-Up: Aspen Productions is identified as the responsible party for any clean up required. Emergency Services: The Applicant has provided a plan for dealing with emergencies during the photo shoot. The Applicant will have a backcountry guide who is also a wilderness first responder and medic. Local emergency personnel will be notified of the event. Safety of Operations: Crew will have radios where cell phones don't work. The Applicant will position people on either ends of the road while they are shooting to make any recreational uses aware of their presence.
