(hereinafter referred to as "Owner"), whose address is 151 Bulkley Drive, Aspen, CO 81611, located in the County of Pitkin, (State Parcel ID# 273515300005) and the BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO (hereinafter referred to as the "County"). WITNESETH WHEREAS, Owner owns the real property described in Exhibit A, attached hereto (hereinafter referred to as "Property"), which Property will contain an agricultural building as allowed pursuant to Sec. 6-30-140 of the Land Use Code. This agricultural structure is exempt from floor area calculation pursuant to Section 6-30-140(a). Said agricultural building will be located within the "barn accessory building envelope" recorded at Book 86, Page 61 (See Exhibit B). For the purposes of this Agreement, the approved agricultural building and all appurtenances and fixtures associated therewith shall hereinafter be referred to as the "Barn"; and WHEREAS, this Agreement imposes certain covenants upon the Property which restrict the use and occupancy of the Barn, as more particularly set forth herein. NOW, THEREFORE, in consideration of the mutual promises and obligations contained herein, the Owner hereby covenants and agrees as follows: w ~ 1. (hereinafter referred to as "Owner"), whose address is 151 Bulkley Drive, Aspen, (State Identification Number 2735-153-00-005) located in the County of Pitkin, and the BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO (hereinafter referred to as the "County"). WITNESETH WHEREAS, Owner owns the real property described in Exhibit A, attached hereto (hereinafter referred to as "Property"), which Property will contain an agricultural building as allowed pursuant to Sec. 6-30-130 of the Land Use Code. Said agricultural building will be located as shown on Exhibit B, attached hereto. The agricultural building shall contain approximately 7,800 square feet of exempt floor area as permitted by Building Permit 0067.2008.prbk. For the purposes of this Agreement, the approved agricultural building and all appurtenances and fixtures associated therewith shall hereinafter be referred to as the "Barn"; and WHEREAS, this Agreement imposes certain covenants upon the Property which restrict the use and occupancy of the Barn, as more particularly set forth herein. NOW, THEREFORE, in consideration of the mutual promises and obligations contained herein, the Owner hereby covenants and agrees as follows: 1. Pursuant to Section 2-20-I SO.b of the Land Use Code, RFLC Holding LLC ("Applicant") has applied to the Community Development Director of Pitkin County, Colorado ("Director") to amend the recorded 1041 site plan as follows: A. Relocate one of the approved Irrigation and Stock Pond Envelopes; B. Establish a "Bulkley Road Access, Landscaping and Utility Envelope" to encompass the road and all proposed improvements; C. Enlarge the Accessory Building Envelope for Barn and Caretaker Dwelling Unit ("Barn/CDU Envelope") by a few feet to the west; D. Establish a "Soil Nail Envelope" on the west side of the Barn/CDU Envelope; E. Establish Utility Envelopes for the following: 1) Undergrounding the existing overhead utility lines; 2) Connecting the Barn/CDU Envelope to the Accessory Building Envelope by the pond for the pump house that will drive the new sprinkler system; 3) Connecting the Barn/CDU Envelope to the Waste Water Disposal Envelope to accommodate the effluent line; 4) Connecting the Primary Building Envelope to the pond to accommodate a 4" PVC pipe to connect the geothermal system to the house; 5) Connecting the Accessory Building Envelope to the Irrigation and Stock Pond Envelope to link the primary house to the utility corridor along Maroon Creek Road; F. Enlarge the Main Waste Water Disposal Envelope; G. Establish a Drainage and Utility Envelope to provide an outlet from the pond to an existing culvert under Maroon Creek Road; H. Designate the envelope along Maroon Creek Road as a Landscape and Utility Envelope. 2. The property is located on Maroon Creek Road, and is more specifically described in Exhibit A. 3. The property is zoned AR-10 and contains approximately 184 acres. 4. The Hearing Officer granted approval of the following pursuant to Determination No. 37-2006: 1041 hazard review, conceptual submission, GMQS exemption and special review for a caretaker dwelling unit and to utilize TDRs to develop up to 15,000 square feet of floor area. The 1041 site plan is recorded in Plat Book 84 at Pages 39-41. 5. The Director further finds that the proposed envelope amendments comply with the applicable provisions of the Land Use Code, and that the proposed amendments will not change the use of the proposed development or the basic character of the land, are consistent with action taken during the original review, do not increase off-site impacts or the allowable floor area, and will not endanger the public health, safety or welfare. Within 60 days of the date of this Decision and prior to submission of any further development permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development Department an amended Site Plan. The above referenced approvals shall be a condition precedent to finalization and recordation. The mylar copy of the site plan must be signed by the owner prior to submittal for recording. The Site Plan shall be amended as follows, prior to submission: A. Change the title to "RFLC Holding LLC First Amended Site Plan." B. Change the Hearing Officer signature block to a Community Development Director signature block. C. Improve the labeling of the envelopes to accurately reflect the use(s) to occur in each envelope (i.e. Accessory Building Envelope for Barn and Caretaker Dwelling Unit). 3. The pond and associated grading shall be substantially consistent with the plan attached as Exhibit B. 4. The Applicant shall adhere to all material representations made in the application. On July 26, 2007 the applicant submitted the captioned ]and use application. You indicated that you would like to see a more detailed plan for the proposed irrigation and stock pond envelope. The applicant worked with a landscape architect and engineer to prepare a schematic pond and grading plan. During the time when the pond and grading plan was being prepared the applicant was completing more detailed plans for various land use proposed on the site and initiated some earthmoving work. As plans progressed it became apparent that a few additional minor changes needed to be made to the approved activity envelopes. This letter presents the schematic pond and grading plan and summarizes the additional minor changes to the approved site plan. Refer to the Parcel A RFLC Holding LLC Amended Hazard Review Site Plan. The proposed changes are shaded and described in a clockwise rotation beginning at Bulkley Road and ending at the utility envelope just to the east of Bulkley Road. Pond and Grading Plan -Please refer to the Schematic Pond and Grading Plan. The size of the pond has been reduced and the Plan illustrates grading which will take place to return the meadow to a natural appearance. The new grading will simulate the existing grades. The entire areas surrounding the pond will be revegetated with native vegetation. There will not be manicured ornamental vegetation surrounding the pond. 2. Soil Nail Envelope -Since Pitkin County now requires soil nail envelopes, we are proposing one on the west side of the Barn and Caretaker Dwelling Unit envelope. The soil nails will not protrude above the existing surface of the ground. 5. Utility Envelope from Barn CDU Envelope to Accessory Envelope Building Envelope by the new pond -This Envelope is for the pump house which will drive the new sprinkler system for the entire meadow. Utility Envelope from Barn CDU Envelope to Waste Water Disposal Envelope - This will provide a corridor for an effluent line. 7. Utility Envelope from Primary Building Envelope to Pond -This envelop is for a four inch PVC pipe which will connect the pond geothermal system to the main house. 8. Small Addition to Main Waste Disposal Envelope -The Plan proposes a very small addition to the main waste disposal envelope. This addition is necessary to provide a proper setback from the pond. 10. Change in Label for Debris Flow Mitigation, Landscape and Grading Envelope - We inadvertently forgot to shade this envelope which is located on the far east side of the Primary Building envelope. Utility Envelope on Far East Side of Property -This long envelope will link the overhead power line (at the pole) to a new underground line which runs parallel to Maroon Creek Road. 12. Utility Envelope in the Middle of Property Linking Accessory Building Envelope to Irrigation Utility and Stock Pond Envelope. This utility line will link the primary house to the utility corridor along Maroon Creek Road. 13. Drainage and Utility Envelope -This envelope provides an outlet from the new pond. The water will flow to an existing culvert under Maroon Creek Road. 14. Utility Envelope -This sliver compliments the existing envelope. 15. The property's location is shown on a map in Attachment 1 and the legal description is found in Attachment 2. The owner is represented by F.A (Fred) Smith and Co. The Applicant is requesting the minor amendment to the existing approval in order to relocate the approved Irrigation and Stock Pond Envelope to a more appropriate, lower location and to add a few small linear utility envelopes to underground the existing overhead utility lines in locations which allow the necessary connections to existing lines. This land use application is addressed under the following headings: Background, Proposal, Land Use Requests and Summary. BACKGROUND The subject property is located in the Maroon Creek Valley approximately 2.5 miles up Mazoon Creek Road from Highway 82. The Applicant received 1041 Hazard Review, Conceptual Submission, Special Review, GMQS Exemption and Caretaker Dwelling Unit approvals for the property on August 20, 2006. The Determination of Approval No. 37-2006 and the recorded RFLC Holding LLC Hazazd Review Site Plan aze found in Attachments 3 and 4. The property is located in the AFR-10 zone district. PROPOSAL The applicant wishes to move the approved Irrigation and Stock Pond Envelope from the approved location which sits on top of a small knoll to a naturally occurring swale in a lower, more appropriate location. Initially the Applicant thought the Irrigation Pond could provide (s~~prrnilnkler irrigation from the approved location, but that is not the case. Since this location is in a Swale it is a more natural spot for a pond. The previously approved Irrigation and Stock Pond Envelope will be vacated. The second minor amendment proposed is the addition of four small segments of property added in to the approved utility envelope which will allow the connection to the existing line northeast of the property and the undergrounding of the lines as they cross the property. A few small areas of the approved utility envelope no longer necessary will be vacated. Please refer to the Amended RFLC Holding LLC Hazard Review Site Plan in Attachment 5 which shows the additions and deletions proposed. LAND USE REQUESTS A pre-application conference summary is found in Attachment 6. As required in the summary, the following sections of the Pitkin County Land Use Code will be addressed: Section 2-30-20.g.2 Site Plan Criteria for Approval Section 2-20-150.b Minor Amendment to Development Permit; Section 7-10-80 Site Plan; and Section 7-20-20 Steep and Potentially Unstable Slopes• When appropriate, the Land Use Code language is given in bold, and the Applicant's response follows. SECTION 20-30-20.g.2 Site Plan Criteria for Approval The Criteria for Site Plan state that the Applicant's request must comply with: "a) all applicable provisions of the Land Use Code; b) any Activity Envelope previously approved for the property pursuant to Section 7-10-50; and c) all prior development approvals applicable to the subject property. If an Activity Envelope has not been previously established for the property pursuant to Section 7-10-50, one shall be established as part of the Site Plan Review process." All applicable provisions of the Land Use Code will be met. The subject property has approved -2- 0~~~~'J building, accessory building, landscape and utility envelopes pursuant to the old Land Use Code, but an Activity Envelope pursuant to Section 7-10-50 of the new Code has not been established for the property. The Amended RFLC Holding LLC Hazard Review Site Plan proposes adding azeas to the Utility Envelope and re-locating the Irrigation and Stock Pond Envelopes. No constrained areas are found in the azeas proposed for addition to the envelopes. All lands proposed for inclusion are below 30% in grade and aze typically less than 15% in grade, so steep and potentially unstable slopes are not an issue for the proposed underground utility and pond uses. As previously noted, the prior development approval documents are found in Attachments 3 and 4 and the proposed Amended Site Plan is in Attachment 5. The proposal will comply with all prior development approvals. SECTION 2-20-150.b Minor Amendment to a Development Permit A minor amendment to a development application or permit must meet the following criteria as determined by the Community Development Director: 1) Consistent with actions taken during previous development approvals for the property; and 2) Does not change the use of the proposed development between residential, commercial and tourist accommodations uses; and 3) Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; and 4) Does not constitute a new land development activity; and 5) Does not increase off-site impacts in the surrounding neighborhood; and 6) Does not endanger the public health, safety or welfare; and 7) Does not violate any Land Use Code standards; and 8) Does not substantially increase the need for on-site parking or utilities, or affect affordable housing generation; and 9) Does not increase the floor area of the use by more than five percent or decrease the open space on the site by more than five percent. The proposal to underground utility lines and move the irrigation and stock pond to a lower location meets these criteria for a Minor Amendment to a Development Permit. The use is consistent with the original approvals, the residential use is not changed, the basic chazacter is the same, there is no new development activity, it does not endanger the public in any way, nor does it violate the any Land Use Code Standards, increase pazking, utility or affordable housing impacts, increase floor area or decrease open space. The undergrounding of the utilities decreases utility impacts of the development. The request meets this section of the Land Use Code. -3- o~Q~~~ SECTION 7-10-50 Site Plan and Activity Envelope Please refer to the approved RFLC Holding LLC Site Plan in Attachment 4 and the proposed Amended RFLC Holding LLC Hazard Review Site Plan in Attachment 5. The proposed Amended Site Plan will meet all the previous conditions of approval. The applicant will comply with all the requirements of this section of the Code. All activity will take place within the approved envelopes. The proposed additions have grades less than 30% so slope constraints are not an issue for the pond and underground utility lines. SECTION 7-20-20 STEEP AND POTENTIALLY UNSTABLE SLOPES The new areas to be included in the proposed Irrigation and Stock Pond Envelope and the new segments of the Utility Envelope are shown on the Site Plan in Attachment 5. The surveyor at Schmueser Gordon Meyer has completed a slope analysis of these areas and has verified that there are no slopes over 30% in grade in the azeas proposed for inclusion into the envelopes. The proposed minor amendment complies with this section of the Code as there are no steep or potentially unstable slopes. SUMMARY The applicant is requesting approval of a minor amendment to a development permit. RFLC Holding LLC received the necessary approvals for their home which was approved in August of 2006. They aze now interested in re-locating the Irrigation and Stock Pond to a more appropriate, lower location and connecting to existing utility lines and installing the lines underground as the lines cross the property. The "Amended RFLC Holding LLC Hazazd Review Site Plan" found in Attachment 4 reflects the minor amendment, complies with the original conditions of approval and the Applicant will comply with all conditions of the original approvals. All areas disturbed by construction shall be revegetated to limit water consumption and additional runoff within one growing season after completion of construction. 17. The caretaker dwelling unit shall be limited to 1,000 net livable square feet. The kitchen shall contain a minimum of a two burner stove with at least a 5 cubic foot oven that can bake and broil, sink of at least 14"W X 16"D X 5.25"H, and at least a 5.3 cubic foot refrigerator and 0.73 cubic foot freezer. A minimum of one off-street parking space shall be provided for the unit. The Applicant shall provide one off-street parking space for each bedroom in the cazetaker unit. The caretaker dwelling unit must have separately accessible utilities. This does not preclude shared utilities. 18. Prior to submission of any building permits for the caretaker unit, the Applicant shall obtain and the Housing Office shall record a caretaker dwelling unit deed restriction. Actual floor plans of the unit shall be submitted to the Housing Office with the deed restriction. 19. APPLICANT understands and agrees that Pitkin County Ordinance No. 32-2002 establishes a fee structure for land use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to reflect the expense incurred in providing such services to the public. 3.
