Clark Smyth moved that the following be adopted: BEFORE THE BOARD OF ADJUSTf1ENT OF THE COUNTY OF PITKIN STATE OF COLORADO RESOLUTION NO. 81-36 Bill & Gale Burton, Maroon Creek WHEREAS, the subject property is within the unincorporated area of Pitkin County, Colorado; and, WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by virtue of Title II, Section 16-1.3, Pitkin County Code (Land Use Code) and Colorado Revised Statutes, 1973, 30-28-118(2) (C); and, WHEREAS, based on the evidence presented, the Board of Adjustment makes the following findings: 1. Proper notice procedures, including the notification of all adjorninq property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE IT RESOLVED that the applicant's request for a 90' frontyard setback variance and a 15' sideyard setback variant Additional conditions or restrictions: WARNING: Any violation of the terms of this resolution may result in rehearing and possible revocation. Dottie Fox made a motion to accept the minutes as mailed, :~4otion was second, All in favor to approve the minutes. Leon Norton, Lot #17, Double K S/D 81-34 ' requesting a 23' frontyard setback variance to construct an '. addition to existing residence. Leon Norton was representing himself. Leon explained that prior to downzoning ile would be { able to. construct this addition but now the setback is 100'. ~ Under the original zoning the setback was 75'. Bill Mason wanted to know if Leon would be within the covenance originally set. ~~ It was agreed that it would be. Bill wanted to know if the floor area ratio would be within its limit. Patsy Newbury assured ~ the Board that it would be. Paul Krausch moved to grant the i variance based on the fact that the property has been downzoned. + Dottie Fox second the motion. „4otion passed. Edward Lewis, Lot 20,_ Little Texas S/D Woody Creek 81-35 requesting a 20' frontyard setback variance and a 19' sideyard setback variance to construct a single .family residence, Roger Kerr was there to represent ?~1r. Lewis. He explained that the size of the lot makes it difficult to maintain the required setback. It would leave a 15' lot to build a house. Bill Mason wanted to know if a sign was posted anywhere on the property, Roger Kerr stated that to his knowledge no sign was posted. Bill ]4ason recommended that this case be tabled till the 29th of September. None of the adjacent property owners have objected to the Board. Bill 94ason questioned the Board as to whether they would like to hear the case and make a motion at the next meeting or hold the entire case until then. Patsy Newbury corrected the request to be a 10' frontyard setback variance. Stan Mathis was there to represent the Burton's along with Bill Burton. Stan explained that they could not place the structure any further back because of a 45% slope down into the river. They have gotten approval for their septic system and if they were to move the house they would not have an area for that. Bill Burton also mentioned that there were trees on the lot that he was trying to build around, Clark Smyth made a motion to approve the variance as presented on the topographical map which is approximately 1~' front and sideyard variance based on the topographical considerations and the odd shape of the lot. Joe Zanin second the motion. One of the adjacent property owners was there to make sure that the trees were not cut down, Bill :Mason replied that that was the reason Mr, Burton was trying to get a variance change so that he could leave the trees.
