HomeMy WebLinkAboutpitkin.boa.81.28Dottie Fox moved that the following be adopted: BEFORE THE BOARD OF ADJUSTD9ENT OF THE COUNTY OF PITKIN STATE OF COLORADO RESOLUTION NO.gl-28 Parcel 3, Lower West Castle Creek WHEREAS, the subject property is within the unincorporated area of Pitkin County, Colorado; and, WHEREAS, the Board of Adjustment is jested with the power to grant or deny such variances by virtue of Title II, Section 16-1.3, Pitkin County Code (Land Use Code) and Colorado Revised Statutes, 1973, 30-28-118(2) (C); and, WHEREAS, based on the evidence presented, the Board of Adjustment makes the following findings: 1. Proper notice procedures, including the notification of all adjorning property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE IT RESOLVED that the applicant's request for a 62 foot frontyard setback variance to construct a two car garage Additional conditions or restrictions: WARNING: .Any violation of the terms of this resolution may result in rehearing and possible revocation. Applicant's description of proposed variance showing justification: Request for set back variance to construct two-car garage with sod roof. Garage must be located within the (100') front set back limit to allow access from existing driveway, while minimizing visual impact on the existing house and surroundings and to avoid extensive changes in existing grade. The original house constructed in 1977 also required a variance from the 100' set back due to the fact that all of the buildable portion of the site is on a bench within 100' of the front property line and the remainder of the site drops off severely down to the flood plain adjacent to Castle Creek. PITKIN COUNTY BOARD OF ADJUSTRIP~NT July 28, 1981 Members Present: Bill Pdason, Chairman Dottie Fox Paul Krausch Clark Smyth Associates: Bill Lukesr Robert Throm Kandi Shaffran Joe Zanin Meeting was called to order by Bill vlason. He asked whether there were any questions regarding the minutes from the last meeting. Kandi Shaffran pointed out that; with regard to .case 81-15, Paul Krausch stated that had the fence been 6 feet, a variance would not be necessary. It was corrected that the fence would not need a variance if it was under 6 feet. Clark Smyth made a motion to accept the minutes from June 30, 1981',' after noting the correction is made. Dottie Fox second the motion, All in favor, the minutes were accepted John Sc Catherine Ostwald Lot 63 Crystal River Park S/D 81-27 requesting a 70 foot frontyard setback varian- a 5 foot sideyard setback variance and a 15 foot rearyard setback variance to construct a single family residence, John Ostwald was there to represent himself, He explained that the Boning required a setback for a 100 feet and that the lot was only 100 feet deep. Bill "Mason asked whether what John was asking for was in compliance with the subdivision standard setback, John replied that they were the same setbacks as the rest of the houses, Bill "4ason stated that this cvas a typical case of downzoning. Dottie Fox asked if there was room for the septic tank, John stated that Bob Nelson of Enviromental Health had already checked and there was room, Clark Smyth moved to grant the variances as proposed due to the downzoning of the area, Paul Krausch second the motion, All in favor, so moved, Richard ~c Rosemary Furman Parcel 3 Lower West Castle Creek 81 28 requesting a frontyard setback variance to construct a two car garage, Dan Furman was there to represent Richard Furman Bill Mason and Joe Zanin had to disqualify themselves due to the fact that Bill sold the parcel to Air. Furman and Joe is the contractor of the house. The house sits on a steep slope and if you push the garage back the necessary 100 feet you are on the steep slope and getting into the flood plain. Also this position will save as many trees in the area as possible. He also stated that from the road nothing will be seen, Bill P;lason stated that a variance was given for the house when it was first built due to the steep- ness of the slope. Dottie Fox made a motion that a ~2 foot frontyard setbacl: variance be granted due to topographical hardship, Bill Lukes second the motion.
