A reduction from the R-30, 30,000 square foot lot size shall be granted to the extent of permitting a minimum fee simple lot size of ten thousand (10,000) square feet for each single family unit. 2. In Cluster Area A and Cluster Area B, the minimum lot width of 100 feet shall be waived, but the rear and side yard setbacks required in R-30 zoning areas shall be observed. 3. In the Cluster areas A and B the front yard setback may be not less than 20 feet from the centerline of the private access and service road providing access to the :.ots within the Cluster areas. 4. It is contemplated that the subdivision plat to be prepared and submitted in accordance with the Pitkin County Subdivision Regulations may be prepared in conformity to the variances hereby granted, and that such variances may be carried forward to building permits hereafter granted, but with the exceptions hereby expressly enumerated the applicable zoning regu- lations shall be carefully adhered to. 5. Geittmann, owner of Lot 5, The Ridge of Red Mountain Subdivision, for variances from several of the covenants and ,restrictions contained in the recorded Pro- tective Covenants covering the subject Subdivision for purposes of constructing a tennis court on the above-described property. This application is submitted in accordance with Article IV, Section 3 of said Covenants,' which provides in pertinent part that "a majority of the members of the Architectural Committee may allow reasonable variances as to any of the covenants and restrictions contained in this instrument." Enclosed with this letter you will find a detailed site plan depicting the location of the existing house on the subject property, as well as the location of the proposed tennis court, related improvements such as cribbing and decking, and a relatively detailed showing of the nature and extent of the landscaping which Mr. Geittmann intends to accomplish in connection with this improvement. Since the tennis court will obviously cross over the boundary of the "Open Space Greenbelt Area" within the subject Lot as shown on the recorded Plat of the subject Subdivision, a variance is needed from the requirement in this Section that all structures be set back at least 10 feet from the interior boundary of said Greenbelt Area. 2. Article VII2, Section 1. This Section restricts the types of improvements which may be constructed upon Greenbelt Areas. Expressly permitted improvements do not include tennis courts, hence our request for a variance from the strictness of this provision of the Covenants as well. '3. Article X, Section 1. This Section reserves utility easements through all of the Greenbelt Areas, and the recorded Plat of the subject Subdivision dedicates to the private use of the Subdivision lot owners a 14 foot utility easement along the Greenbelt Line. Accordingly, a variance is sought to permit the construction of the proposed court over and across said reserved easements. It is respectfully submitted that the foregoing-described variances are each eminently reasonable requests, considering the underlying broad intent of the Covenants that "where cir- cumstances, such as topography, soil conditions, location of property lines, location of trees and brush, or other matters require, the Architectural Committee ... may allow reasonable variances...", and further considering the following-described conditions pertaining to the subject property: A. Lot 5 is one of :the largest lots in the Subdivision in terms of total acreage, and yet is by virtue of being a corner lot perhaps the most strictly circumscribed by the "Greenbelt" lines in that they permit improvements on less .than one-half of the platted lot area. B. The topography of Lot 5, particularly that poztion devoted to Greenbelt Area and thus originally to walking and riding trails, xs not and never will be suited for such uses, thus .the proposed tennis court in no way violates the intent of this particular Covenant and will not deprive other Sub- division owners of any usable rights nor otherwise interfere with their enjoyment of the property rights which they acquired and/or anticipated when .they purchased lands within the subject Subdivision. 000011 ~"'~';".~ ~IOLLAND RrHART Martin H. No perimeter setback restrictions will be violated by the proposed tennis court improvement, eliminating the threat of violations of the privacy of adjoining Subdivision lot owners. D. The reserved utility easements traversed by the proposed tennis court are in fact no more than that. All essential utility systems have already been installed through- out this portion of the subject Subdivision, and no existing lines occupy .the easements for which a variance is hereby applied for. In the unlikely circumstance that a utility line of some kind .should in future be needed across one of such easements, .the applicant does hereby agree for himself and his heirs, successors and assigns that he will at his own cost and expense remove so much of the proposed tennis court improvement as may be necessary to allow such installation, and then replace the same if its continued existence will not materially interfere with the functioning of said utility line. E. While perhaps not directly pertinent to the issues at hand, the applicant intends to expend substantial funds in landscaping the perimeter of the proposed tennis court improve- ment following its completion, for the dual purposes of rendering the entire area generally more attractive and in order to shield the court .from outside observation and those in homes nearby from observation from the court and any appurtenant areas. The prompt and serious consideration of this application by your Committee will be greatly appreciated. The results of this investigation are included in this letter. The proposed structure is to consist of a retaining wall for a tennis court. The exact type of retaining wall is not known to Lincoln-DeVore at this time. However, it is assumed that a rein- .fQrced concrete wall will probably be used. Other typ"e~--oF------ - retainirg s ructures w , rs , so be suitable. The exact height of the wall is not known, however, it is assumed that it will probably be a low wall of less than 10 feet in height. The wall is presumed to be free standing, rat- her than being connected with a residence or other structure. The soils encountered in tkle proposed retaining wall area con- sisted of silty, clayey sand, with scattered gravel sized rock fragments. The results of laboratory testing for this material are included on the enclosed grain size analysis sheet. The maximum allowable bearing capacity for this soil will be on the order of 3000 psi. The material is slightly expansive, however, expansion pressures are of such low magnitude, that no minimum dead load pressu~e_...rPC~mmendation will be made. For design of ttte retaining wall, an equivalent fluid pressure of 38 pcf may be used for the soil in the active state. The fric- tion coefficient between the base of the wall and the soil will be on the order of 0.45. This typically is accomplished by construction of a gravel drain immediately behind the retaining wall. The drain should be provided with a positive free gravity outfall to the ground surface. Care should be taken to avoid the discharge of :cater from the drain into the immediate area of the toe of the wall, since this would tend to reduce the bearing capacity of materials at tine toe, and woulc] reduce the factor of safety against sliding and overturning. We would recommend that backfill behind the retaining wall be compacted to a density between approximately 888 and 42~ of the soil's maximum standard Proctor density, ASTNI D-698. Overcompaction of material could result in unsuitably high pressures against the wall, and undercompaction of material could result in settlement of backfill. The backfill materials should be placed in lifts and compacted by mechanical means. No water flooding techniques of any type should he used in the. p aT-cement af-G~Ckf-ii~"~e~d`l:Fie wall. A stan ar roc or test (ASThi D-698) has been performed for the native materials encountered on this site. The results of this test are included with this letter. It is recommended that all concrete which is in contact with the soil be made using a sulfate resistant ceme~ty such as Type II Cement. In the event of a s or age of 't'ype II Cement, a normal or Type I Cement may be used, but only if the soil is separated from the concrete by a water resistant membrane. A reduction from the R-30, 30,000 square foot Iot size shall be granted to the extent of permitting a minimum fee simple lot size of ten thousand (10,000) square feet for each single family unit. 2. In Cluster Area A and Cluster Area B, the minimum lot width of 100 feet shall be waived, but the rear and side yard setbacks required is R-30 zoning areas shall be observed. 3. In the Cluster areas A and B the front yard setback may be not less than 20 feet from the centerline of the private access sad service road providing access to the lots within the Cluster areas. 4. It is contemplated that the subdivision plat to be prepared and submitted in accordance with the Pitkin County Subdivision Regulations may be prepared in conformity to the variances hereby granted, and that such variances may be carried forward to building permits Lhereafter granted, but vith the exceptions hereby expressly enumerated the applicable zoning regu- lations shall be carefully adhered to. 5. Present were: Stein, Stanton, Oakes, Parker, Mason. Reconvene recessed meeting of July 29, 1968 and July 15, 1968. ' Mr. Stanton notified Mc. Gossard and Attorney Wendt for Keating Coffey. Mr. Stanton reported that he had checked Mr. Reischl's plan with Mr. Delaney (Case 68-14). Mr. Delaney reviewed the plat and the objections which had been presented. He felt that it was very definitely a topographical hardship aad that the Board would be within their right if they so desired to grant the varlance.Mr. Stanton stated that in a talk with Mr. Kaiser, Kaiser did not think the plat presented was made by a registered surveyor. The Board did not feel this had a hearing on the case. Mr. Stein made a motion the, variance be approved. Motion was seconded by Oakes. Mason abstained. Motion carried. 68-12- Lynden Blue Cluster Development A rough draft of a resolution concerning the Lynden Blue, Ridge of Red Mountain Cluster Development was presented. Mr. Stanton asked if it were necessary to read the Resolution since everyone had a copy. They were asked for discussion on roads and eliminating setbacks. In the original resolution a 30 ft. setback from private driveways was suggested. Mr. Stanton pointed out that Mr. Reynolds has said that no setbacks are required on the other subdivisions from private road ways. The Board in general felt (as per resolution) that side yard setbacks should be maintained and a 20 foot setback fromthe center of the abutting street, private road or parking area should be required. Sanitation is covered under Building Codes and Sanitarian. The Board also felt that it would be necessary foz the final plat to be gone over again by the Planning Commission, County Commissioners and Mr. Delaney and a six months limitation on the variance be given to do the plan. Mr. Stein made a motion that the six months variance be approved with these stipulations set out in the resolution. Motion was seconded by Parker. Motion carried unanimously. Meeting was adjourned. Mason, Chairman Pitkin County Board of Adjustment Pitkin County Courthouse 506 East Main Street Aspen, Colorado 81611 Re: Geittmann Appeal Dear Bill: I simply wish to go on record as having no objections whatsoever to the tennis court which Mr. Geittmann proposes to build on his lot in the Ridge of Red Mountain Subdivision. Admittedly I was the first to ask Patsy Newbury what the initial excavation was all about, which I've since learned caused a stop work order to be issued on the project because a building permit had not been obtained, apparently through simple lack of procedural knowledge. My basic concern arose from the fact that the excavators loosened several large rocks which rolled across the Red Mountain Road and slightly damaged one of my boundary fences. These rocks were promptly removed, the fence repaired, and there is no remaining damage of which I am aware. It is my understanding that the Ridge Architectural Committee has approved Mr. Geittmann's project, and I can only concur with their judgment. When landscaped as his plans indicate, a tennis court in that area will have no detrimental privacy or visual effect upon those of us residing in my area of Red Mountain. Our Board meet at Bill Geittmann's to look over the site upon which he would like to construct a tennis court. Bill Geittmann's lot is approximately three-fourths green belt. The location of the proposed tennis court extends into the green belt area slightly. Our feelings on this proposed construction, as Board Members of the Ridge of Red Mountain Homeowners Association, was that as long as the neighbors in the proximity of Bill Geittmann's home did not have a problem with the construction of a tennis court on this site, we should recommend that he be able to construct the tennis court as proposed, and we have had to date no objections to this after polling his neighbors. It would definitely be a hardship if he could not construct the tennis court on this particular location and had to move it closer to his home. Thank you for your consideration.
