WHEREAS, the subject property is within the unincorporated area of Pitkin
County, Colorado; and,
WHEREAS, the Board of Adjustment is vested with the power to grant or deny
such variances by virtue of Title II, Section 16-1.3, Pitkin County Code
(Land Use Code) and Colorado Revised Statutes, 1973, 30-28-~118(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment makes the
following findings:
1. Proper notice procedures, including the notification of all adjorning
property owners, has been shown by the applicant.
2. The required hardship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment to the
public welfare and will not substantially impair the intent an3

Pursuant to Pitkin County Resolution of June 5, 1955, as amended, a Public Hearinq
will be held in the County Commissioners Room, Pitkin County Court House, Aspen, Colorado,
(or at such other place as the meeting may then be adjourned) to consider an application
filed with the said Board of Adjustment requesting authority for variance from the
provisions of the County Zoning Resolution.
All persons affected by the proposed variance are invited to appear and state their
views, protests or objections. If you cannot appear personally at such meeting, then you

We are writing to all owners of property adjacent to the above referenced
project in order to notify you that we have applied fora variance to the
Pitkin County Land Use Code.
The nature of the variance is primarily a technicality created by the language
of the Code regarding building setbacks. The Code requires the "front yard"
set back to be 100 feet minimum and further stipulates that the property
boundary from which access to the site is taken must be considered the
"front yard".
Due to the ruggedness of the terrain on this property and the desired
orientation of the house to the south for sun and views, the access for this
site from Carroll Drive is through the North boundary via a minimal access
easement granted to the Scotts by Mr. Edgar Stern, who owns the Lot to the
North. This allows a much less obtrusive entrance road which minimizes
cuts and fills and disturbance of the natural foliage.
Unfortunately, this causes the proposed house, as dictated by the Starwood
Homesite Marker, to be 40 feet from the "front yard" boundary to the PJorth.
If we had taken the access road from Carroll Drive through the East boundary,
ttre house would be over 300 feet from the "front yard" boundary. However,
this would have required a huye earth fil', under the road at the entrance
across a ravine which runs along the East boundary and would have created
an ugly scar on the hillside. fhe Starwood Homeowners Board of Directors
gave final approval to the access road easement and the proi~osed residence
just recently at their Piay meeting.
