Applicant's description of proposed variance showing justification: The Applicant requests a front yard setback variance from the required 30 foot setback to an 18 foot setback. The property lies in the R-6 zone. The Applicant is requesting the reduction in the required setback by 12 feet in order to accommodate the requirements of the Redstone historic Preservation Commission and to provide solar access. Attached is a letter dated April 10, 1981 from the Commission indicating that the preference of the Commussion would require the requested ~rariance. The historic settlement pattern of buildings located in Redstone would be accommodated by this additional distance which would be created between an existing neighboring structure and the proposed structure as well as the preservation of a large and historic conifer in the middle of the building site. Solar access to the proposed structure and the immediately adjacent existing structure may be impaired if the variance is not granted.. Without the variance a portion of the proposed structure would lie to the north and within the shadow of the existing conifer and the shadow of the proposed structure would also restrict"'" solar access to the adjacent existing structure. The Board of Pdjustrnent is authorized kr~_ _. grant variances if necessary for adequate access to sunlight for solar energy purposes. The Applicant intends to utilize passive solar design together with sane active solar heating supplementary systems in the design of the house. In siumiary, the requirements of the R~stone Historic Preservation Commission, the necessity to maximize solar access and the existence of a large and historic conifer in the middle of the property all create "peculiar and exceptional practical difficulties" upon the Applicant in the develojanent of the property. The granting of this variance will not create any detriment to the public good nor substantially alter or impair the intended purpose of the zone district regulations. The adjoining property owners favor the variance as it will help maintain the character of the neighborhood. A list of adjacent property owners with addresses is attached. The applicant, Mr, Chuck Morris, explained that he is desirous of locating the house 18 feet from the access point rather than the specified 30 foot setback, In reviewing his plans, the Commission felt that the 18 foot setback would be considered desirable because it does meet with points listed in the historic guidelines, namely: A) Preservation of existing foliage, in particular large trees; B) Preserving the in-line historic settlement pattern; C) That similar shallow setfiacks do exist on the north end of Redstone Boulevard, We are aware that there are certain legal questions involved, but from the standpoint of the Commission, there was a unanimous vote in favor of Mr, Morriss request.
