STATE OF COLORADO
RESOLUTION NO. 81-8
Richard Rufer/Setback Variance - Lot R-88, Starwood
WHEREAS, the subject property is within the unincorporated area of Pitkin
County, Colorado; and,
WHEP.EAS, the Board of Adjustment is vested with the power to grant or deny
suer variances by virtue of Title II, Section 16-1.3, Pit'-in County Code
(Land Use Code) and Colorado Revised Statutes, 1973, 30-28-118(21 (Cj; and,
WHEREAS, based on the evid?nce presented, the Boar3 of Adjustment makes the
following findings:
1. Proper notice procedures, including the notification of all adjorning
.property owners, has been shown by the applicant. '
2. The required herdship or practical difficulty has been established.
3. Grantinci such rei.ief w+.11 not cause substantial detriment to t1~e
public welfare az.d will not substantially impair the in~ent and
purpose of the Zening Resolutions and the zoning mans.
NOW, THEREFORE, BE IT RESOL~IED that the applicant's request for a
20 foot frontyard setback variance is granted.
Additional conditions or restrictions:
WARNING: Any violation of the terms of this resolution may result in rehearing
and possible revocaticn.

Re: Starwood Homeowners Association - Rufer Residence
Dear Mr. Wold,
i am on the Board of Directors of Starwood Homeowners
and Zinnie Moore has forwarded me your coorespondence of
October 23, 1980 to review before she signs same. The
Architectural Committee as set forth in your letter has
approved the site plan and floor plan for the proposed
residence as set forth in the drawings of Seth Twichell &
Associates dated September 19, 1980. However, to make our
files complete, I would appreciate it if you would please
have Mr. Twichell submit a new building elevation plan which
confirms the agreement of the roofers to lower the highest
point of the house two feet.
Upon receipt by Starwood of that document, the Archi-
tectural Committee will have deemed to have given its appro-
val. The Starwood Homeowners Association will then sign off
on the plans, (duplicate copies should be given) and return
a signed copy to you.
The next meeting of the homeowners is scheduled for
mid-ilovember so I would suggest that if you desire to obtain
the written approval of the Homeowners Association at that
meeting, that you submit the requested document as soon
possible.
If you have any questions, please feel free to contact
me.
