SETTING FAILURE TO PAY TAX - PENALTY
FOR VEHICLE REGISTRATION FEES, PER C.R.S. 42-3-112.

Recitals
l. Pitkin County Board of County Commissioners, in conjunction with the County Clerk
and Recorder as an agent for the Department of Revenue, Motor Vehicle Division, is
authorized to establish penalty for failure to pay vehicle registration fees pursuant to
the provisions of C.R.S. § 42-3-112.
2. If a vehicle subject to taxation under this article is not registered when required by
law, the vehicle owner is subject to a late fee, as determined by the department or
authorized agent registering the vehicle, which is due when the vehicle is registered.
3. Pitkin County provides a renewal notice to county residents regarding vehicle
registration, yet is not required under C.R.S. Notices have historically been
forwarded to residents approximately one month prior to registration renewal
deadline(s), as a courtesy reminder.
4. Colorado law provides for a thirty-day grace period after a registration is due for
renewal, per C.R.S. 42-3-113(2)(e), after which time the late fee will be implemented.
5. The department or the authorized agent registering the vehicle may waive the late fee.
6. The late registration fee shall be retained by the department or the authorized agent
who registers the motor vehicle.
7. Colorado Legislation approved a late fee up to ten dollars ($10.00) effective July l,
2005. Hereafter, fees will be established in accordance with the schedule set forth by
Colorado Revised Statute § 42-3-112.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Pitkin County, Colorado, that upon a thirty-day grace period of a registration due for renewal
for each vehicle subject to taxation, a late fee will be assessed pursuant to provisions of
C.R.S. § 42-3-112, Failure to pay tax - penalty.
