PERMIT FOR THE CITY OF ASPEN AT COZY POINT RANCH FOR SNOW STORAGE

RECITALS
1. Pursuant to Subsection 4-30-50(i) of the 2006 Pitkin County Land Use Code, the Community Development
Director of Pitkin County, Colorado ("Director") may approve a Temporary Commercial Use/Special Event
Permit for commercial activities or special events.
2. The City of Aspen (hereafter, the "Applicant"), has applied to the Dvector for approval of a Temporary
Commercial Use to store snow at Cozy Point Ranch at a site just north of Juniper Hill Road where the
archery range exists.
3. Snow storage will be for the duration of the 2008-2009 winter season. As snow is dumped, it will be graded
to reduce its visual mass. The Applicant has committed to cleanup trash and debris that may be
incorporated throughout the snow.
4. This application was referred to the Environmental Health and Natural Resource Deparhnent (EH/NR) and
the Brush Creek Metro District. The Applicant has satisfied the conditions of EH/NR. The Brush Creek
Metro District has given its approval for the proposal. The City of Aspen Parks and Open Space
Department has endorsed this proposal with conditions.
5. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4-
3-50(1) of the 2006 Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use Permit for the Cozy Point
Snow Storage, subject to Applicant's compliance with each of the following conditions:
1. Applicant shall adhere to all material representations made in, or in connection with, the application.
2. Snow dump shall be limited to archery range and be graded on a consistent basis to reduce visual
impacts.
3. Snow shall be dumped a minimum of ] 00 feet from the intermittent stream just south of the site and at
least 50 feet from riparian and wetland vegetation.
4. The Applicant shall comply with the Monitoring and Contingency Plan dated October 14, 2008.
5. Before snow storage operations aze to begin, the large flat areas designed to provide snow storage shall
be "based" with a heavy layer of snow to provide a protection barrier from soil compaction and
vegetation disturbance.
6. Trash and debris cleanup shall be performed immediately after spring melt. Cozy Point Ranch staff
shall contact the City of Aspen staff for inspection at this time.
7. Access to the Archery Range must be provided as soon as possible in the Spring.
8. Failure to comply with the conditions of approval may result in revocation of this permit.

Dear Warren:
We propose to mitigate snowmelt runoff for the 2008-2009 winter season as follows:
MONITORING AND CONTINGENCY PLAN
L The site of the snow storage will be checked daily during the spring runoff when
snow is melting.
2. The storage site lies in a shallow natural bowl. We will stockpile hay bales not
suitable for equine consumption. A barrier of these bales will be placed across the
low point in the bowl, adjacent to the stored snow to act as filtration and to
encourage infiltration.
3. If melt water escapes this first barrier, we will install additional barriers of bales
across down stream low points in the natural drainage pattern to increase filtration
and further infiltration prior to the water reaching our existing irrigation ditch that
traverses the property.
4. In the unlikely event that melt water reaches this ditch, it will be carried away
from the river and not toward it.

You may remember last yeaz I asked you if there was any Brush Creek HOA objection to us storing
snow north of juniper hill road. I believe you told me no one raised any objections (we had done it for
two yeazs previously and no one even noticed until Pitkin County red tagged us and told us we had to
have a permit to do so in the future.
Well, I put in fora $500 permit last yeaz and Pitco did not get back to me in time to make any use of it.
This yeaz I am starting eazly in case I need to move any snow over there during the winter.

Could you write me a brief note that I could include in my permit package stating that you have no
objection. The county won't consider it unless I have your approval. Approvals are for one season
only. Your note needs to be addressed to Michael Kramer, Pitkin County community Development,

The City of Aspen staff has reviewed your request for a continuation of our support for your
application for a Special Use Permit from Pitkin County to allow a portion of Cozy Point Ranch
to be utilized for snow storage from snow derived from locations other than Cozy Point. We have
confirmed that this use of the property is appropriate with the following conditions, as previously
set forth in our letter of December 11, 2006:
1. Snow storage shall be restricted to the large, flat expanse directly adjacent to the "Archery
Range" area. No other snow storage locations shall be permitted for this type of snow storage.
Other azeas on the ranch, where appropriate, are approved for snow removal from the ranch
property itself. '
2. Before snow storage operations are to begin, the large flat azeas designed to provide snow
storage shall be "based" with a heavy layer of snow to provide a protection barrier from soil
compaction and vegetation disturbance.
3. Snow shall be continuously graded in this area to prevent a large mound or mountain of snow
to be generated.
4. A cleanup of trash and debris shall be performed immediately after Spring melting. Cozy
Point Ranch staff shall. contact City of Aspen staff for an inspection of this azea in the Spring
following cleanup to confirm that the area is free of debris.
5. Noxious vegetation in this,area will be the responsibility of Cozy Point Ranch.
6. Access to the Archery Range must be provided as soon as-possible in the Spring.
7. The City of Aspen reserves the right to withdraw support of this snow storage area if, for any
unforeseen reason, the snow storage area creates any problems.

City of Aspen staff has reviewed your recent request to support your application for a
Special Use Permit from Pitki County to allow a portion of the ranch to be utilized for
snoav storage from snow deri ed from locations other than Cozy Point Ranch. After this
reL9e~~, ~~e i~~r:e confirmed th t this use of the property is appropriate with the following
conditions:
1) Snow storage shall be restricted to the large, flat expanse directly adjacent to
the "Archery Range" a ea. No other snow storage locations shall be permitted
for this type of snow s orage. Other areas on the ranch, where appropriate, are
~ipproved fur snow re oval from the ranch property itself.
2) 6etore snow storage operations are to begin, the large flat area designed to
provide snow storage hall be °based" with a heavy layer of snow so as to
prowde a protection b rrier from soil compaction and vegetation disturbance.
3) Snow :.hall be continuously graded in ~hls area so as not to allow a large mound
or mountain of snow t be generated'.
-+) A cleanup of trash and debris shall be performed immediately after spring
melting. Cozy Point R nch staff shall contact City of Aspen staff for an
inspection of this area in the spring following cleanup to confirm area if free of
