Pursuant to Subsection 4-30-50(i) of the 2006 Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. The City of Aspen (hereafter, the "Applicant"), has applied to the Dvector for approval of a Temporary Commercial Use to store snow at Cozy Point Ranch at a site just north of Juniper Hill Road where the archery range exists. 3. Snow storage will be for the duration of the 2008-2009 winter season. As snow is dumped, it will be graded to reduce its visual mass. The Applicant has committed to cleanup trash and debris that may be incorporated throughout the snow. 4. This application was referred to the Environmental Health and Natural Resource Deparhnent (EH/NR) and the Brush Creek Metro District. The Applicant has satisfied the conditions of EH/NR. The Brush Creek Metro District has given its approval for the proposal. The City of Aspen Parks and Open Space Department has endorsed this proposal with conditions. 5. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4- 3-50(1) of the 2006 Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use Permit for the Cozy Point Snow Storage, subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. Snow dump shall be limited to archery range and be graded on a consistent basis to reduce visual impacts. 3. Snow shall be dumped a minimum of ] 00 feet from the intermittent stream just south of the site and at least 50 feet from riparian and wetland vegetation. 4. The Applicant shall comply with the Monitoring and Contingency Plan dated October 14, 2008. 5. Before snow storage operations aze to begin, the large flat areas designed to provide snow storage shall be "based" with a heavy layer of snow to provide a protection barrier from soil compaction and vegetation disturbance. 6. Trash and debris cleanup shall be performed immediately after spring melt. Cozy Point Ranch staff shall contact the City of Aspen staff for inspection at this time. 7. Access to the Archery Range must be provided as soon as possible in the Spring. 8. Failure to comply with the conditions of approval may result in revocation of this permit. The storage site lies in a shallow natural bowl. We will stockpile hay bales not suitable for equine consumption. A barrier of these bales will be placed across the low point in the bowl, adjacent to the stored snow to act as filtration and to encourage infiltration. 3. If melt water escapes this first barrier, we will install additional barriers of bales across down stream low points in the natural drainage pattern to increase filtration and further infiltration prior to the water reaching our existing irrigation ditch that traverses the property. 4. In the unlikely event that melt water reaches this ditch, it will be carried away from the river and not toward it. Please let us know if this plan meets with your approval. Well, I put in fora $500 permit last yeaz and Pitco did not get back to me in time to make any use of it. We have confirmed that this use of the property is appropriate with the following conditions, as previously set forth in our letter of December 11, 2006: 1. Snow storage shall be restricted to the large, flat expanse directly adjacent to the "Archery Range" area. No other snow storage locations shall be permitted for this type of snow storage. Other azeas on the ranch, where appropriate, are approved for snow removal from the ranch property itself. ' 2.
